<section section-type="section-one" id="H6CF51DFA93E1457392BEA72646D0DF7A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defining Male and Female Act of 2025</short-title></quote>. </text></section> <section id="HB502D6E23C26433982CCAA934C22CD35"><enum>2.</enum><header>Definition of <quote>sex</quote>, <quote>male</quote>, <quote>female</quote>, and related terms</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/1/1">Chapter 1</external-xref> of title 1, United States Code, is amended by adding at the end the following:</text>

<section id="H03A33BA6F3ED4AEE8A38C926E1689DCB"><enum>9. </enum><header>Definition of <quote>sex</quote>, <quote>male</quote>, <quote>female</quote>, and related terms</header><text display-inline="no-display-inline">In determining the meaning of any Act of Congress, or of any ruling, regulation, or interpretation of the various departments and Federal agencies of the United States, the term—</text> <paragraph id="H9EAA8B26BC3B4F87BEBC8394B1ED8458"><enum>(1)</enum><text><term>boy</term> means a minor human male;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB6286089C8074D8985720FAC601072D7"><enum>(2)</enum><text display-inline="yes-display-inline"><term>father</term> means a male parent;</text></paragraph> <paragraph id="HA9F1162A530D47B982734F15A40EEA24"><enum>(3)</enum><text><term>female</term>, when used to refer to a natural person, means a person belonging, at conception, to the sex characterized by a reproductive system with the biological function of producing eggs (ova); </text></paragraph>
<paragraph id="H79FBE88376CC4C04B6D29CA4C498B0FD"><enum>(4)</enum><text><term>gender identity</term> means an identity that reflects an internal and subjective sense of self, disconnected from biological reality and sex and existing on an indeterminate continuum, and, because such an identity does not provide a meaningful basis for identification for purposes of Federal law, the term shall not be recognized by the Federal Government as a replacement for sex; </text></paragraph> <paragraph id="H75805E076B5540299BB7864A9D3BE5F9"><enum>(5)</enum><text><term>girl</term> means a minor human female;</text></paragraph>
<paragraph id="H931D4754FD5B41CE8A1C3AC532EF4EFD"><enum>(6)</enum><text><term>male</term>, when used to refer to a natural person, means a person belonging, at conception, to the biological sex characterized by a reproductive system with the biological function of producing sperm; </text></paragraph> <paragraph id="HC28BFD68B92A4E7C9782DC3E9D7C2B06"><enum>(7)</enum><text><term>man</term>, except when used as a generic reference to human beings, means an adult human male; </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC2C8FAB2939C453E90498E45F2477D37"><enum>(8)</enum><text><term>mother</term> means a female parent;</text></paragraph> <paragraph id="H5675717DD8C94ED3854E7093957DB27F"><enum>(9)</enum><text><term>sex</term>, when referring to a natural person's individual’s sex, means the person’s immutable biological classification as either male or female, as biologically determined and defined by this section; and </text></paragraph>
