<section section-type="section-one" id="HD61681F3D77C4FF2AF8FD65AB891D04C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tipped Employee Protection Act</short-title></quote>.</text></section> <section id="HA04F84C750CC4FF2BBA12AC64B731A9B"><enum>2.</enum><header>Tipped employees</header><text display-inline="no-display-inline">Section 3(t) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(t)</external-xref>) is amended—</text>
<paragraph id="H83C3320CE3DD45CDB08669674CBEC0E8"><enum>(1)</enum><text>by striking <quote>(t)</quote> and inserting <quote>(t)(1)</quote>; </text></paragraph> <paragraph id="H0A6A8BC3A043405EA27CFDD6AED53929"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>engaged in an occupation in which he customarily and regularly receives more than $30 a month in tips.</quote> and inserting <quote>, without regard to the duties of the employee, who receives tips and other cash wages for a period described in paragraph (2) at a rate that when combined with the cash wage required under subsection (m)(2)(A)(i) is greater than or equal to the wage in effect under section 6(a)(1).</quote>; and</text></paragraph>
<paragraph id="H50601005F57A4EDFBB352506D2F082AD"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H61D0999D27FA4A87A8D690F29651194A"> <paragraph id="H855D9E4223584504833AE3CD4C3EABC4" indent="up1"><enum>(2)</enum><text>The period described in this paragraph may be (as determined by the employer) a period of 1 day, 1 week, every other week, every pay period, or 1 month.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
