R. 2249</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250321">March 21, 2025</action-date><action-desc><sponsor name-id="C001115">Mr. Cloud</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5, United States Code, to provide the President discretion to negotiate collective bargaining agreements entered into under such chapter, and for other purposes.</official-title></form><legis-body id="H29BB38ABD2E34A0D9895BB4E19689048" style="OLC"><section id="HA9F66EFAC2994F00B8DEA25D28C076F6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Presidential Management Authority Act</short-title></quote>. </text></section><section id="H9290456129934F9095742ECD69331468"><enum>2.</enum><header>Discretion to Negotiate Collective Bargaining Agreements By President and Clarifying Effect of Conflicting Presidential Actions</header><subsection id="H87EDE9DA7F99401E8C2E8E19194CF8C3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H136CAAE1C3FA43FD8CA05AE94EC1BC70" display-inline="no-display-inline"><section id="H09BFEE033EA04FDFA4737AAFF5EBC1AE"><enum>7107.</enum><header>Presidential authority to negotiate collective bargaining agreements; clarification of effect of conflicting presidential actions</header><subsection id="HAABDE188807C4B15AD513150621F9EBF"><enum>(a)</enum><header>Authority of President To negotiate agreements</header><text>The President may, acting through the head of an agency, terminate any provision of a collective bargaining agreement entered into under this chapter that is in force and effect on the date such President swears or affirms the oath of office as President.</text></subsection><subsection id="H497002BB883B416498AA1CA563DD1921"><enum>(b)</enum><header>Clarifying effect of conflicting presidential actions</header><text>A provision of any collective bargaining agreement that conflicts with a rule, executive order, presidential memorandum, or any other presidential order, as determined by the President or the head of an agency, shall not be enforceable.</text></subsection><subsection id="H642B85A1511B4BABA13B2B9DA41D9558"><enum>(c)</enum><header>Limitation</header><text>The authority under subsection (a) may not be exercised by an incumbent President.</text></subsection><subsection id="H45F825339A404F4F86B2E4BCEFFA441C"><enum>(d)</enum><header>Notification</header><text>On the date the President orders any termination under subsection (a) or a determination is made under subsection (b), the head of the relevant agency shall submit a notice (in writing) to the applicable exclusive representative describing such termination or conflicting provisions of such an agreement.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H51A55E16D5F8406BB8D38F1F73049569"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for such subchapter is amended by adding after the item relating to section 7106 the following:</text><quoted-block style="USC" id="HE5E01C15CE9945ADB3B61B455659F0B7" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">7107.
