<section id="HC6E0D68FAE98420AB1526B7F57576FCB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Farm Workforce Support Act of 2025</short-title></quote>. </text></section> <section id="HC36CDC2188B746D58BBB9F0A290616F8"><enum>2.</enum><header>Report on H–2A temporary visa program</header> <subsection id="H2CF3C69D06FC4E8987C923CA93417866"><enum>(a)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to certain Congressional committees on the H–2A program, including—</text>
<paragraph id="H56A016DE61E5492887096F912F690116"><enum>(1)</enum><text>an analysis of the impact the program has on hiring, including the impact on domestic workers and guest workers and whether there is an increasing reliance on the program by American employers;</text></paragraph> <paragraph id="H82A9A0BCDA6642DB871EE830CA88EC9D"><enum>(2)</enum><text>identification of any challenges in securing adequate, affordable housing for guest workers; </text></paragraph>
<paragraph id="H1EC2A0768B6F4CA7BD402504D46321C5"><enum>(3)</enum><text>implications of wage rate requirements under the program on an American employer’s ability to recruit domestic workers in comparison to guest workers; </text></paragraph> <paragraph id="H69432B80FA6C491F8C030896F05794D3"><enum>(4)</enum><text display-inline="yes-display-inline">an analysis of the economic impact of lost wages from a spouse and unmarried children of a guest worker; and</text></paragraph>
<paragraph id="HF6952305DABB4B85892948BAB007F364"><enum>(5)</enum><text display-inline="yes-display-inline">examining compliance with working condition guarantees outlined in a guest worker’s contract made pursuant to the H–2A program.</text></paragraph></subsection> <subsection id="H9961E1F266804BCE9D7E67BAC3F05FFF"><enum>(b)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HC26C72CC2A164E69ACB3AC304976B2AC"><enum>(1)</enum><header>American employer</header><text display-inline="yes-display-inline">The term <term>American employer</term> means an individual, company, or organization that hires another individual and pays such individual a salary or wage, in the United States. </text></paragraph> <paragraph id="H10FBD60456394FE8B92915200489A75A"><enum>(2)</enum><header>Certain Congressional committees</header><text>The term <term>certain Congressional committees</term> means the—</text>
<subparagraph id="H771C2EF9174C4A4FA6695FC872021A54"><enum>(A)</enum><text>Committee on Education and the Workforce of the House of Representatives;</text></subparagraph> <subparagraph id="H9AAAD68968EC45AD933F30FA7DA7F82B"><enum>(B)</enum><text>Committee on Agriculture of the House of Representatives; </text></subparagraph>
<subparagraph id="H987F9790296A461C8E64531984D4BEDB"><enum>(C)</enum><text>Committee on Health, Education, Labor, and Pensions of the Senate; and</text></subparagraph> <subparagraph id="H39CB98AA5FD144C7BAD296C9BA075565"><enum>(D)</enum><text display-inline="yes-display-inline">Committee on Agriculture, Nutrition, and Forestry of the Senate. </text></subparagraph></paragraph>
<paragraph id="HA5E8B437419C472AA1AF7859E956843B"><enum>(3)</enum><header>Domestic worker</header><text>The term <term>domestic worker</term> means a United States citizen who is employed in the United States. </text></paragraph> <paragraph id="HF9C40C27235A432585EC1F145DD6FAA8"><enum>(4)</enum><header>Guest worker</header><text display-inline="yes-display-inline">The term <term>guest worker</term> means a worker who is a nonimmigrant described in section 101(a)(15)(H)(ii)(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(ii)(a)</external-xref>). </text></paragraph>
<paragraph id="HC94B6288C6F44F70A997CB166F4DE416"><enum>(5)</enum><header>H–2A program</header><text>The term <term>H–2A program</term> means the admission of nonimmigrants described in section 101(a)(15)(H)(ii)(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(ii)(a)</external-xref>).</text></paragraph></subsection></section> </legis-body></bill>
