<section id="HDD8CA70E3FE84E3EA0107298557D83C2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Let Pregnancy Centers Serve Act of 2025</short-title></quote>.</text> </section> <section id="HDE33B01C527A42E084B82EF734EA27FC"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="H3F23841A8F994421980F9A9BF45B3084"><enum>(1)</enum><text display-inline="yes-display-inline">Pregnancy centers are community-based, nonprofit organizations that provide free compassionate care, support, and resources to help meet the physical, psychological, emotional, and spiritual needs of women, girls, couples, and families navigating pregnancy and offer life-affirming alternatives to abortion. These services can include pregnancy tests, ultrasounds, STD/STI tests, prenatal education programs, parenting education programs, after-abortion support, lactation consultations, certified dietician and nutritionist consultations, and well-women exams.</text></paragraph> <paragraph id="HA3A5AA05A0E64DD1B4ABFE9AF47E59D5"><enum>(2)</enum><text display-inline="yes-display-inline">Pregnancy care centers are committed to providing clients with complete and accurate information regarding their pregnancy options and the development of an unborn baby. Most pregnancy centers are affiliated with at least one of three national networks. These networks require their affiliates to adopt a Commitment of Care and Competence, setting ethical, legal, and regulatory standards.</text></paragraph> 
<paragraph id="H26A26A4EAD564F358C5D7ED38601AA4D"><enum>(3)</enum><text display-inline="yes-display-inline">In 2022 alone, 2,750 pregnancy centers across the United States provided an estimated 3,255,856 total client sessions, including in-person and virtual sessions. 97.4 percent of clients seen by pregnancy centers reported having a positive experience with pregnancy centers.</text></paragraph> <paragraph id="HDBF0361F0D25462A9345907AC645A7A8"><enum>(4)</enum><text display-inline="yes-display-inline">The total values of the material goods and services provided by pregnancy centers in 2022 was at least $367 million. 808,737 clients received material resources, which included packs of diapers and wipes, baby formula, baby clothes, new cribs, new car seats, and strollers.</text></paragraph> 
<paragraph id="HE3850F03372B465AAF2AC06662A733A3"><enum>(5)</enum><text display-inline="yes-display-inline">Out of the 62,576 individuals who worked at pregnancy centers in 2022, 44,930 (7 in 10 workers) were volunteers.</text></paragraph> <paragraph id="HE79ABE5820724693AD3F972115837835"><enum>(6)</enum><text display-inline="yes-display-inline">Many pregnancy centers offer medical services. In 2022, 10,175 medical staff and volunteers provided care to clients across the Nation. Pregnancy centers performed 546,683 free ultrasounds, at an estimated total value of $136 million.</text></paragraph> </section> 
<section id="H008C1CD29ACB48CBBDED7C74848D30CC"><enum>3.</enum><header>Prohibiting discrimination against entities that do not participate in abortion</header><text display-inline="no-display-inline">Title II of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/202">42 U.S.C. 202 et seq.</external-xref>) is amended by inserting after section 245 the following:</text> <quoted-block id="H2276320F69B1498D8035E7C2F279CD9E" style="OLC"> <section id="HB5E26B56034A4226AC734C5DFF53B9F4"><enum>245A.</enum><header>Prohibiting discrimination against entities that do not participate in abortion</header> <subsection id="H90C73EAC54BB4D5B804485A842CEB3E3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other law, the Federal Government, and any individual or entity that receives Federal financial assistance, including any State or local government, may not discriminate against, penalize, or retaliate against an entity because the entity offers life-affirming support and resources to women facing unexpected pregnancy, offers life-affirming alternatives to abortion, or refrains from actions that counsel in favor of, suggest, recommend, assist, provide, promote, or in any way participate in the performance of abortions.</text></subsection> 
<subsection id="H858F2BE9B6AE44CABCC04D7E85682039"><enum>(b)</enum><header>Prohibited actions</header><text display-inline="yes-display-inline">The actions that are prohibited under subsection (a) include, at a minimum—</text> <paragraph id="H9B99AB3DA9724CF88D0FD448CF4B5E31"><enum>(1)</enum><text display-inline="yes-display-inline">requiring an entity to offer or perform an abortion;</text></paragraph> 
<paragraph id="H87D553E7A74A44339D77DD1152D957B9"><enum>(2)</enum><text>requiring an entity to offer, provide, or distribute an abortion-inducing drug;</text></paragraph> <paragraph id="H22FE5AE226DF4F26AADA384279F8AC50"><enum>(3)</enum><text>requiring an entity to refer a person for an abortion or an abortion-inducing drug;</text></paragraph> 
<paragraph id="H161CAE12290C4ADCA7312845E8A084D6"><enum>(4)</enum><text>requiring an entity to counsel in favor of an abortion or an abortion-inducing drug;</text></paragraph> <paragraph id="HAE891864FDE04918BD047C63C64AE971"><enum>(5)</enum><text>requiring an entity to post any advertisement, sign, flyer, or similar material that promotes or provides information about obtaining an abortion or an abortion-inducing drug; and</text></paragraph> 
<paragraph id="HCE0F5FBDB1004B789D4DDE9548A4FD2E"><enum>(6)</enum><text>prohibiting an entity from providing information, care, counseling, classes, or other services related to pregnancy, childbirth, or parenting because the entity does not perform, refer, or counsel in favor of an abortion or an abortion-inducing drug.</text></paragraph></subsection> <subsection id="H02D957E1FE3B453990EBE45B1AB1AFC3"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed—</text> 
<paragraph id="H34315926FE864F5CB34CE25907496632"><enum>(1)</enum><text>to prevent any entity from voluntarily electing to participate in abortions or abortion referrals where not prohibited by any other law; or</text></paragraph> <paragraph id="HB4447D06D8444FC2A598E432BF4E985D"><enum>(2)</enum><text>to affect, or be affected by, any Federal law that requires stabilizing treatment for a pregnant woman or her unborn child when either needs emergency care.</text></paragraph> </subsection> 
<subsection id="H0F5B300C634C49E684770CC3D2096477"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section:</text> <paragraph id="H7A29A9F7BB544CBCACEAA479233406E0"><enum>(1)</enum><header>Abortion</header><text>The term <quote>abortion</quote> means the use or prescription of any instrument, medicine, drug, or any other substance or device—</text> 
<subparagraph id="HF1D20AD4C556458296261F6BC43A600E"><enum>(A)</enum><text>to intentionally kill the unborn child of a woman known to be pregnant; or</text></subparagraph> <subparagraph id="HDBCBC562506840DAA57A6FE492DF3961"><enum>(B)</enum><text>to intentionally terminate the pregnancy of a woman known to be pregnant, with an intention other than—</text> 
<clause id="HCA2EAA9022E948FEB310845EB0BC9B85"><enum>(i)</enum><text>after viability to produce a live birth and preserve the life and health of the child born alive;</text></clause> <clause id="H94B7708C8F5D4B19B82B3BC13DE8BAA7"><enum>(ii)</enum><text>to remove a dead unborn child; or</text></clause> 
<clause id="HD59AF9D79052447B99D034CD811EDB34"><enum>(iii)</enum><text>to remove an ectopic pregnancy or other pregnancy implanted outside the uterus.</text></clause></subparagraph></paragraph> <paragraph id="H06F99D8F2CAD46DD945BD0D3337EC0AF"><enum>(2)</enum><header>Federal financial assistance</header><text display-inline="yes-display-inline">The term <quote>Federal financial assistance</quote> means Federal payments to cover the cost of health care services or benefits, or other Federal payments, grants, or loans to promote or otherwise facilitate health-related activities. Such term does not include expenditures made under direct spending programs.</text></paragraph> 
<paragraph id="H548862F1DF2B426485AEBABC5950C708"><enum>(3)</enum><header>Life-affirming alternatives to abortion</header><text>The term <quote>life-affirming alternatives to abortion</quote> means one or more programs that promote childbirth as an alternative to abortion, through life-affirming social services providers, which may include pregnancy centers, adoption assistance providers, and maternity homes. For purposes of the preceding sentence, the term <quote>life-affirming social services providers</quote> does not include entities that provide, facilitate, counsel in favor of, or refer for abortions.</text></paragraph> <paragraph id="H4BC099AF09D44364AD991635060442CF"><enum>(4)</enum><header>Life-affirming support and resources to women facing unexpected pregnancy</header> <subparagraph id="H62CB219AA9E341CD83B50E28A97A5509"><enum>(A)</enum><header>In general</header><text>The term <quote>life-affirming support and resources to women facing unexpected pregnancy</quote> means one or more of the following:</text> 
<clause id="HB4B439761D8C4B2FB1DA2DC71C8C66E7"><enum>(i)</enum><text>Providing information, care, counseling, classes, or other services related to pregnancy, childbirth, or parenting without providing, referring, or counseling in favor of abortion or abortion-inducing drugs.</text></clause> <clause id="H19C8FD8271A44B9A8BC999BD93356B5B"><enum>(ii)</enum><text>Providing prenatal and postnatal resources, such as diapers, baby clothes, baby furniture, formula, and similar items.</text></clause> 
<clause id="H8F676423C0A941768C03B438B5E52B22"><enum>(iii)</enum><text>Providing medical testing, counseling, and care related to pregnancy or childbirth.</text></clause> <clause id="H5183CF3EF5BF4B02B2D21218E4A864AA"><enum>(iv)</enum><text>Counseling a woman on pregnancy-related care or treatment, including care or treatment that may reverse the effects of abortion-inducing drugs.</text></clause></subparagraph> 
<subparagraph id="H813363D302D649C2BEF0C7A8B5229886"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">The term <quote>life-affirming support and resources to women facing unexpected pregnancy</quote> does not include performing, referring, or counseling in favor of abortion or abortion-inducing drugs.</text></subparagraph></paragraph> <paragraph id="H67D905C61CE54E19B12FF1EBE8AC27C5"><enum>(5)</enum><header>State or local government</header><text>The term <quote>State or local government</quote> includes every agency and other governmental unit and subdivision of a State or local government, if such State or local government, or any agency or governmental unit or subdivision thereof, receives Federal financial assistance.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HA69860C9282C4F27ABF2F568CA161512"><enum>4.</enum><header>Strengthening enforcement of Federal conscience laws</header><text display-inline="no-display-inline">Title II of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/202">42 U.S.C. 202 et seq.</external-xref>), as amended by section 3, is further amended by inserting after section 245A the following:</text> <quoted-block id="H3A36E082460B404FA0BEBE7F82FFCAEA" style="OLC"> <section id="H5E6396E74DB34BD5B2FBF9B29DE046E9"><enum>245B.</enum><header>Civil action for discrimination against entities offering abortion alternatives</header> <subsection id="H2483E4CC52CA467084A5737244D72056"><enum>(a)</enum><header>In general</header><text>A qualified party may, in a civil action, obtain relief described in subsection (e) with respect to a designated violation.</text></subsection> 
<subsection id="H6484A0472C5E4AD19CB47AA043267AED"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section:</text> <paragraph id="HCC662B3B8ECF461789E90822486113D8"><enum>(1)</enum><header>Designated violation</header><text>The term <quote>designated violation</quote> means an actual or threatened violation of any provision of law described in section 245A.</text></paragraph> 
<paragraph id="H0A02884E246A439685339559773CDFB7"><enum>(2)</enum><header>Qualified party</header><text>The term <quote>qualified party</quote> means—</text> <subparagraph id="H0AB5FF88EEB74402AB37C6A4FC50DF2F"><enum>(A)</enum><text>the Attorney General; or</text></subparagraph> 
<subparagraph id="HA258A67A11A840CFAC8ECAADC542F223"><enum>(B)</enum><text>any individual or entity adversely affected by the designated violation.</text></subparagraph></paragraph></subsection> <subsection id="H09018072AA2645D7B2F76D46B15A1553"><enum>(c)</enum><header>Administrative remedies not required</header><text>An action under this section may be commenced, and relief may be granted, without regard to whether the party commencing the action has sought or exhausted any available administrative remedies.</text></subsection> 
<subsection id="HFBE77050ABF946BFBAA8F652D842F7BE"><enum>(d)</enum><header>Defendants in actions under this section may include governmental entities as well as others</header> 
<paragraph id="HB5385A8F108940389DC4BD8A2BFD305A"><enum>(1)</enum><header>In general</header><text>An action under this section may be maintained against any individual or entity receiving Federal financial assistance (as defined in section 245A(c)), including a State governmental entity. Relief in an action under this section may include money damages even if the defendant is a governmental entity.</text></paragraph> <paragraph id="H0B03C45EB80144C0961B99232BA4D82E"><enum>(2)</enum><header>Definition</header><text>For the purposes of this subsection, the term <quote>State governmental entity</quote> means a State, a local government within a State, and any agency or other governmental unit or subdivision of a State, or of such a local government.</text></paragraph></subsection> 
<subsection id="H7A07E165028C4EB19AB093C0DBB396C9"><enum>(e)</enum><header>Nature of relief</header><text>In an action under this section, the court shall grant—</text> <paragraph id="HDD964E47EA0644C889A32DBDA571FD8D"><enum>(1)</enum><text>all appropriate relief, including injunctive relief, declaratory relief, and compensatory damages to prevent the occurrence, continuance, or repetition of the designated violation and to compensate for losses resulting from the designated violation; and</text></paragraph> 
<paragraph id="HE559EFFAE8234FF8B045FA99F21F012E"><enum>(2)</enum><text>to a prevailing plaintiff, reasonable attorneys’ fees and litigation costs.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H21787A42E8DD4719BAFFFF55A9CDA735"><enum>5.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or an amendment made by this Act, or the application of such a provision or amendment to any individual, entity, government, or circumstance, is held to be unconstitutional, the remainder of this Act and the amendments made by this Act, and the application of such provision or amendment to any other individual, entity, government, or circumstance, shall not be affected.</text></section>
