which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To exempt the Secretary of Energy of certain prohibitions with respect to an unmanned aircraft system, and for other purposes.</official-title></form><legis-body id="H100A461693894692B841E0E7A8DEAF4C" style="OLC"><section id="H4399076DFE30475086D2064D58ABCE5A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Ecosystem Drone Defense Act</short-title></quote> or the <quote><short-title>NEDD Act</short-title></quote>.</text></section><section id="HA1CE5BACD4894850870ACB558BAA1724"><enum>2.</enum><header>Authority of Secretary of Energy with respect to covered unmanned aircraft systems from covered foreign entities</header><subsection id="H1F1BABCF9CC34A8784C001DF783C480A"><enum>(a)</enum><header>Exemption from prohibition on procurement of covered unmanned aircraft systems from covered foreign entities</header><text display-inline="yes-display-inline">Section 1823(b) of the National Defense Authorization Act for Fiscal Year 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/31">Public Law 118–31</external-xref>; 137 Stat. 692) is amended, in the matter preceding paragraph (1), by inserting <quote>Secretary of Energy,</quote> after <quote>Secretary of State,</quote>.</text></subsection><subsection id="H73A14F3AE9394FFB9DFF6F7424E85857"><enum>(b)</enum><header>Exemption from prohibition on operation of covered unmanned aircraft systems from covered foreign entities</header><text display-inline="yes-display-inline">Section 1824(b) of the National Defense Authorization Act for Fiscal Year 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/31">Public Law 118–31</external-xref>; 137 Stat. 693) is amended, in the matter preceding paragraph (1), by inserting <quote>Secretary of Energy,</quote> after <quote>Secretary of State,</quote>.</text></subsection><subsection id="H7EE4C486C69849AB99A564EA3CE211D3"><enum>(c)</enum><header>Exemption from prohibition on use of Federal funds for procurement and operation of covered unmanned aircraft systems from covered foreign entities</header><text>Section 1825(b) of the National Defense Authorization Act for Fiscal Year 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/31">Public Law 118–31</external-xref>; 137 Stat. 694) is amended, in the matter preceding paragraph (1), by inserting <quote>Secretary of Energy,</quote> after <quote>Secretary of State,</quote>.</text></subsection><subsection id="HB71447E1C3CD49D9ADB40866A69A54AE"><enum>(d)</enum><header>Granting Secretary of Energy authority To determine usage of classified tracking</header><text>Section 1827(b) of the National Defense Authorization Act for Fiscal Year 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/31">Public Law 118–31</external-xref>; 137 Stat. 696) is amended by striking <quote>the Secretary’s designee</quote> and inserting <quote>the Secretary of Energy, as appropriate, or their respective designees</quote>.</text></subsection><subsection id="H0D395A772CFC4C2399CE12D340B5072B"><enum>(e)</enum><header>Granting Secretary of Energy accounting exception</header><text>Section 1827(c) of the National Defense Authorization Act for Fiscal Year 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/31">Public Law 118–31</external-xref>; 137 Stat. 696) is amended by inserting <quote>Department of Energy,</quote> after <quote>Department of Transportation,</quote>.</text></subsection><subsection id="H4588EFE29CA741EEAFE62EBEB72CDB10"><enum>(f)</enum><header>Expansion of Secretary of Energy authority related to the protection of certain nuclear facilities and assets from unmanned aircrafts or unmanned aircraft systems</header><text display-inline="yes-display-inline">Section 4510(e)(1)(C) of the Bob Stump National Defense Authorization Act for Fiscal Year 2003 (<external-xref legal-doc="usc" parsable-cite="usc/50/2661">50 U.S.C. 2661(e)(1)(C)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H85F48C1D58CA45F2872E308B0A7592DA" display-inline="no-display-inline"><subparagraph id="HBD91BA3235184280908DE9733C6B68F4"><enum>(C)</enum><text display-inline="yes-display-inline">owned by the United States or contracted to the United States—</text><clause id="H0AB176929F654A00B2923C4D7D303E7E"><enum>(i)</enum><text>to store, transport, or use special nuclear material; or</text></clause><clause id="H5FBFDC39D6BF43BE97D04465A7BA7B5A"><enum>(ii)</enum><text>for the research, design, manufacture, or production of non-nuclear components for nuclear weapons.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
