<section id="H3E40645E47C54A6FB54C80955C222C63" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Physician Led and Rural Access to Quality Care Act</short-title></quote>.</text></section> <section id="HDF3BCC8915F64E5AAB61A503E8100E44"><enum>2.</enum><header>Revising certain physician self-referral exemptions relating to physician-owned hospitals</header> <subsection id="H83E4FD8B81734D93A532C7FAACFD943E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1877 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn</external-xref>) is amended—</text>
<paragraph id="H425F06175BA34BF78BA62CE25E8BBBF5"><enum>(1)</enum><text>in subsection (d)—</text> <subparagraph id="H387F42FC190547099A911DB1D8FDB7E8"><enum>(A)</enum><text>in paragraph (2)(C), by inserting <quote>(other than a covered rural hospital (as defined in subsection (h)))</quote> after <quote>a hospital</quote>; and</text></subparagraph>
<subparagraph id="H2E56B93714FA4347A1E9211CE4B38806"><enum>(B)</enum><text>in paragraph (3)(D), by inserting <quote>in the case of a hospital other than a covered rural hospital (as defined in subsection (h)),</quote> before <quote>the hospital</quote>; and</text></subparagraph></paragraph> <paragraph id="H20656DAE0A9E491090DCA5211578737C"><enum>(2)</enum><text>in subsection (h), by adding at the end the following new paragraph:</text>

<paragraph id="H36D17BCF33FB4391A276B081134D512E"><enum>(8)</enum><header>Covered rural hospital</header><text display-inline="yes-display-inline">The term <quote>covered rural hospital</quote> means a hospital that—</text> <subparagraph id="H1FC061CEB2B24560ABD4839B89224614"><enum>(A)</enum><text display-inline="yes-display-inline">is located in a rural area (as defined in section 1886(d)(2)(D)); and</text></subparagraph>
<subparagraph id="HBA198A2993F74ECAAD33F2CC014BC067"><enum>(B)</enum><text display-inline="yes-display-inline">as of the date that such hospital enrolls under this title, is located more than a 35-mile drive (or, in the case of mountainous terrain or in areas with only secondary roads available, a 15-mile drive) from a hospital or a critical access hospital.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HF36918D0E72D4A17A3287DA3C99852AF"><enum>(b)</enum><header>Allowing for expansion of existing physician-Owned hospitals</header><text>Section 1877(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn(i)</external-xref>) is amended—</text>
<paragraph id="H7C2BDA8C30F8411DA2CD643A99F6A29A"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>in paragraph (3)</quote> and inserting <quote>in paragraph (3) or (7)</quote>; and</text></paragraph> <paragraph id="H3FDADEAD95CF4055A2A7687C8758B2F8"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H8E14A6CBE9FE471DBEF9F8BD94BCD7A3"><enum>(7)</enum><header>Sunset of expansion prohibition</header><text display-inline="yes-display-inline">The requirement described in paragraph (1)(B) shall not apply beginning on the date of the enactment of this paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> </legis-body></bill>
