<section id="H7A81640B4B8D4559BE1FC011FE4035A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Spectrum Coordination Act</short-title></quote>.</text></section> <section id="H0220CEE181874893843C49855144D098"><enum>2.</enum><header>Improving spectrum management</header><text display-inline="no-display-inline">Part A of the National Telecommunications and Information Administration Organization Act is amended by adding at the end the following:</text>

<section id="HCF6ACB83100349D987BAAE61B36F68DE"><enum>106.</enum><header>Improving spectrum management</header> 
<subsection id="HECF9D6D7CC0E40278F92F8DE7171842C"><enum>(a)</enum><header>Federal coordination procedures</header> 
<paragraph id="H82B1B5A4BF5A456A8F3515529D9EFB7F"><enum>(1)</enum><header>Notice</header><text display-inline="yes-display-inline">With respect to each spectrum action, the Assistant Secretary shall file in the public record with respect to such spectrum action, not later than the end of the period for submitting comments to the Commission with respect to such spectrum action, information (redacted as necessary if the information is protected from disclosure for a reason described in paragraph (3)) regarding—</text> <subparagraph id="H4CEB0CF3375D4AAABE358559B65C3C15"><enum>(A)</enum><text>the date on which the Commission provided to the Assistant Secretary notice of the spectrum action, as required under the Memorandum;</text></subparagraph> 
<subparagraph id="H9F43D52D453F4E53B56F1DDF63E72A03"><enum>(B)</enum><text>the Federal entities that may be impacted by the spectrum action;</text></subparagraph> <subparagraph id="H8AC3CBB128C843C292497D1F50F93004"><enum>(C)</enum><text>the date on which the Assistant Secretary provided to the Federal entities described in subparagraph (B) notice of the spectrum action;</text></subparagraph> 
<subparagraph id="H40B919ECA59B44BDAEDE798789A60E17"><enum>(D)</enum><text>a summary of technical or procedural concerns, if any, of Federal entities with respect to the spectrum action; and</text></subparagraph> <subparagraph id="H765B740604AD48699F5288F5A6CC6781"><enum>(E)</enum><text>a summary of policy concerns, if any, of the Assistant Secretary with respect to the spectrum action.</text></subparagraph></paragraph> 
<paragraph id="H2F5177F545604840B491F823AE553D94"><enum>(2)</enum><header>Final rule</header><text display-inline="yes-display-inline">If the Commission promulgates a final rule under section 553 of title 5, United States Code, involving a spectrum action, the Commission shall prepare, make available to the public, and publish in the Federal Register along with the final rule an interagency coordination summary that describes—</text> <subparagraph id="HD9F19DAAF9AC4D6584B738EE39B94620"><enum>(A)</enum><text>the date on which the Commission provided to the Assistant Secretary notice of the spectrum action, as required under the Memorandum;</text></subparagraph> 
<subparagraph id="H4539107D40244C9E930C7EE2E63651EF"><enum>(B)</enum><text>whether concerns were raised under subparagraph (D) or subparagraph (E) of paragraph (1) and, if so, the concerns raised; and</text></subparagraph> <subparagraph id="H73F98204C87E400596645E2EC59B346B"><enum>(C)</enum><text>how any such concerns were resolved.</text></subparagraph></paragraph> 
<paragraph id="H53E3677BE91E44668A53B6B8ABEE3FC4"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to require the disclosure of classified information, or other information reflecting technical, procedural, or policy concerns that are exempt from disclosure under section 552 of title 5, United States Code.</text></paragraph></subsection> <subsection id="H87A8F0AED7E342CDA699F94CF4F1E73C"><enum>(b)</enum><header>Memorandum</header> <paragraph id="H5E57BB51E79A4DD4B3417951EDAE6B7B"><enum>(1)</enum><header>Memorandum updates</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this section, and not less frequently than every 4 years thereafter, the Commission and the NTIA shall update the Memorandum.</text></paragraph> 
<paragraph id="H923998D8DA0B46ABB49A91702ED32E23"><enum>(2)</enum><header>Nature of updates</header><text display-inline="yes-display-inline">In updating the Memorandum under paragraph (1), the Commission and the NTIA shall ensure that each update reflects changing technological, procedural, and policy circumstances, as determined necessary and appropriate by the Commission and the NTIA.</text></paragraph></subsection> <subsection id="H6B4853DD24454F59B1A8E03AD642013E"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H7BBB56EAF1BA4C7BA5C1269F51EE49FA"><enum>(1)</enum><header>Memorandum</header><text display-inline="yes-display-inline">The term <term>Memorandum</term> means the Memorandum of Understanding between the Commission and the NTIA (relating to increased coordination between Federal spectrum management agencies to promote the efficient use of the radio spectrum in the public interest), signed on August 1, 2022, or any successor memorandum.</text></paragraph> <paragraph id="H6095CC47F5C04E7CA267A1032BA6D948"><enum>(2)</enum><header>Spectrum action</header><text display-inline="yes-display-inline">The term <term>spectrum action</term> means any proposed action by the Commission to reallocate radio frequency spectrum that is anticipated to result in a system of competitive bidding conducted under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) or licensing that could potentially impact the spectrum operations of a Federal entity.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
