<section id="H6DC35E8E05D34AA7BDD9C5094708E5E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Penalties for Victims of Fraud Act</short-title></quote>. </text></section> <section id="HBDF5E5E741E14B349B5CB2AFB11C4DE1"><enum>2.</enum><header>Waiver of early withdrawal penalties for victims of fraud</header> <subsection id="H983419916AD74CFD9C1D24ABCB67D90A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/72">Section 72(t)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="H8E21C8B17A4B4DCB80B3BEEE9611C7BA" display-inline="no-display-inline"> 
<subparagraph id="H1E389357E42744EDBCE1916C1E0FB29F"><enum>(N)</enum><header>Distributions from retirement plans in case of victim of fraud</header> 
<clause id="H2F4F3D4D584144E8ABEC430D817E8826"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any distribution from an applicable eligible retirement plan to an individual if such distribution is made on account of the individual being a victim of fraud.</text></clause> <clause id="H992803A2AA8F4DE7A11929D2F77745FC"><enum>(ii)</enum><header>Victim of fraud</header><text display-inline="yes-display-inline">For purposes of this subparagraph, the term <quote>victim of fraud</quote> means an individual who—</text> 
<subclause id="H48D8206DF9C44B06A39A861C7F6248AF"><enum>(I)</enum><text display-inline="yes-display-inline">submits an application for waiver to the Secretary (in such time and manner as the Secretary may prescribe) which fulfils the documentation requirement of clause (iii), and</text></subclause> <subclause id="H027B95A3C90041CAB024F7CEBAD99C8D"><enum>(II)</enum><text>is designated as a victim of fraud by the Secretary. </text></subclause></clause> 
<clause id="H727664ECF921410E993E5F6164B0E464"><enum>(iii)</enum><header>Documentation requirement</header><text display-inline="yes-display-inline">The documentation requirement under this clause is fulfilled if the taxpayer provides documentation (in such time and manner as the Secretary may prescribe) from a law enforcement agency or a court of competent jurisdiction establishing that the individual is the victim of a fraudulent act that resulted in a distribution from an applicable retirement plan.</text> </clause> <clause id="H7EDD5824112A437B9052755D18DEC0EB"><enum>(iv)</enum><header>Amount distributed may be repaid</header><text>Rules similar to the rules of subparagraph (H)(v) shall apply. </text></clause> 
<clause id="H5AF6313342CA4BA1A103DA46C9DD3B5B"><enum>(v)</enum><header>Applicable eligible retirement plan</header><text display-inline="yes-display-inline">The term <quote>applicable eligible retirement plan</quote> means an eligible retirement plan (as defined in section 402(c)(8)(B)) other than a defined benefit plan.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HB8E4D1B883DB44F385BD2A4698AD8D0C"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply to distributions made after the date of the enactment of this Act.</text></subsection></section> 
<section id="H596B60E2EB7A4E9EA5AB3C24820E0177"><enum>3.</enum><header>Information and outreach<editorial></editorial></header> 
<subsection id="H19BAFECBD7164370889C4D3829BE1811"><enum>(a)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of the Treasury (or the Secretary’s delegate) shall issue guidance on the process for claiming the waiver of early withdrawal penalties for victims of fraud under <external-xref legal-doc="usc" parsable-cite="usc/26/72">section 72(t)(2)(N)</external-xref> of the Internal Revenue Code of 1986, as added by section 2 of this Act.</text></subsection> <subsection id="H5ADFB03893E140F98FEFA7F79D20D1BE"><enum>(b)</enum><header>Public awareness campaign</header><text display-inline="yes-display-inline">As soon as practicable after the date of the enactment of this Act, the Secretary of the Treasury (or the Secretary’s delegate) shall conduct a public awareness campaign to educate the public about the protections and relief available under <external-xref legal-doc="usc" parsable-cite="usc/26/72">section 72(t)(2)(N)</external-xref> of the Internal Revenue Code of 1986, as added by section 2 of this Act.</text> </subsection></section>
