Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Administrator of General Services to establish a pilot program to sell motor vehicles to certain small businesses that provide ground transportation service, and for other purposes.</official-title></form><legis-body id="HF7A99777CD7D4DDBAC7831FFD21FF6BE" style="OLC"><section id="H08A028252E2A49CD87DD17D90D6251BD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Transportation Investment Act of 2025</short-title></quote>.</text></section><section id="H0EE53DE6B91D4A0C93059BA3BB5D6EB0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HE453B53791B4438A9AAFD10D18BA0C13"><enum>(1)</enum><text>The General Services Administration fleet management program provides essential vehicle procurement services to Federal agencies, State and local governments, and Tribal organizations at cost-effective prices.</text></paragraph><paragraph id="HCAE0992ECB51485DA0C0006EB8A0B9B1"><enum>(2)</enum><text display-inline="yes-display-inline">Expanding access to the vehicle acquisition services of the General Services Administration to the commercial for-hire industry can increase efficiency, reduce costs, and provide for an improved fleet turnover with modern, environmentally-friendly vehicles.</text></paragraph></section><section id="H05B8257258AB46A091403454515DE422"><enum>3.</enum><header>GSA Federal fleet pilot program</header><subsection id="H7354C261B4244DD28BA2226EE20DC515"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Administrator shall establish a pilot program that does the following:</text><paragraph id="HA6F37F0486E14F099A5EDF52C61C4845"><enum>(1)</enum><text display-inline="yes-display-inline">In accordance with this section, allows covered small businesses to purchase vehicles through the Federal supply schedules of the General Services Administration.</text></paragraph><paragraph id="H02220DEEE46F4074BF3D8648D6DC1346" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Provides the access described in paragraph (1) at cost and from the same selection pool as an eligible entity under any of the following:</text><subparagraph id="HC2D6FCF85490432181076AA4B30CD193" commented="no"><enum>(A)</enum><text>Section 502 of title 40, United States Code.</text></subparagraph><subparagraph id="H7A17C62F07BE4C598E4B458A43659165" commented="no"><enum>(B)</enum><text>The Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5329">25 U.S.C. 5329(c)</external-xref>). </text></subparagraph><subparagraph id="H08CABDF3D7314EB884AF528C98FEB916" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">The Tribally Controlled Schools Act (<external-xref legal-doc="usc" parsable-cite="usc/25/13">25 U.S.C. 13</external-xref>). </text></subparagraph><subparagraph id="H5906FE48F7DB4967B5CD8A0FE68D5FF1" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">Section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>).</text></subparagraph></paragraph><paragraph id="H4D3CAD40CA474B62BA8544D4175B6817"><enum>(3)</enum><text>Prohibits a covered small business from purchasing more than 50 vehicles in a fiscal year.</text></paragraph></subsection><subsection id="HE5C01F0A042F43989BEE81CB04FCDDA7"><enum>(b)</enum><header>Terms of purchase</header><text>To participate in the program a covered small business shall agree to the following terms:</text><paragraph id="HA2FEB7AA5A6D4741834CBCFA29758779"><enum>(1)</enum><text display-inline="yes-display-inline">The covered small business shall use each motor vehicle purchased through the program to provide ground transportation service for not less than two years after the purchase of the motor vehicle unless the motor vehicle becomes unable to operate during that period.</text></paragraph><paragraph id="HDE593478D39E43FB9B706DF7013EF72F"><enum>(2)</enum><text display-inline="yes-display-inline">If the covered small business sells any such motor vehicle before the end of the two-year period, the operator shall reimburse the Administrator in the amount that is the difference between the open market value of the motor vehicle and the amount the operator paid to the Administrator for the motor vehicle.</text></paragraph><paragraph id="HE63DB154D2874F1A8F3C4A0B49741875"><enum>(3)</enum><text display-inline="yes-display-inline">The covered small business shall donate not less than one out of every five of such motor vehicles to a local nonprofit organization after the motor vehicle is no longer used to provide ground transportation service.</text></paragraph></subsection><subsection id="H1A690A24595748C78F4580EE7DD34F59"><enum>(c)</enum><header>Reporting and evaluation</header><paragraph id="HA6A80F9E85DA495F80EE3EFE88ED7E7E"><enum>(1)</enum><header>Annual report</header><text>Not later than 12 months after the date of the enactment of this section, and one year thereafter, the Administrator shall submit to Congress a report on the progress of the pilot program for the previous 12 months, that includes the following:</text><subparagraph id="H2830212714994FC3A2EF9926505D1C51"><enum>(A)</enum><text>Participation data by covered small businesses.</text></subparagraph><subparagraph id="H0321BAC6523746DD804E10872FCA1E21"><enum>(B)</enum><text>Cost savings and operational improvements reported by covered small businesses that participated in the pilot program.</text></subparagraph><subparagraph id="H556DA300F1E044CD9F56FABB9477F479"><enum>(C)</enum><text>Environmental impacts, including reductions in vehicle emissions due to fleet modernization.</text></subparagraph></paragraph><paragraph id="H68B85F0F8E3443208C927B02021E00F5"><enum>(2)</enum><header>Final report</header><text>Not later than the conclusion of the pilot program, the Administrator shall submit to Congress a final report that assesses the effectiveness of the program and provides recommendations on whether to make the program permanent or expand the scope of the program.</text></paragraph></subsection><subsection id="HEF841FE00D8044B18D8C5D8140931A7B"><enum>(d)</enum><header>Rulemaking</header><text>The Administrator may issue any rules necessary to implement this section.</text></subsection><subsection id="HE4708B5512F04F2882CAEBE23446CBE7"><enum>(e)</enum><header>Sunset</header><text>The pilot program established pursuant to this section shall expire 3 years after the date of the enactment of this section.</text></subsection><subsection id="H71D33CA9E27E4348B26D8E094B3E2B5F"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0E3E22D13DE24161BC21E86495BB189E"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph id="HC4AAF8EF03E14DB4BA026AAE5BF1C518"><enum>(2)</enum><header>Covered small business</header><text>The term <term>covered small business</term> means a small business that provides ground transportation service.</text></paragraph><paragraph id="HAA8228C497634BDF86747CE0DEA4D197"><enum>(3)</enum><header>Ground transportation service</header><text>The term <term>ground transportation service</term>— </text><subparagraph id="HDDAD88E2B50E4F4FB6770E5E9D91F2F8" display-inline="no-display-inline"><enum>(A)</enum><text>means transportation for a passenger that is provided—</text><clause id="HEA4433AC5E4A49DAA8037CC53C27F93A"><enum>(i)</enum><text>for compensation; and</text></clause><clause id="H86B64658A2BA40128DA547A34F510E3B"><enum>(ii)</enum><text>in a motor vehicle, including a taxicab, limousine, shuttle, over-the-road bus, or sedan; and</text></clause></subparagraph><subparagraph id="H8F9E32D005EF4A549D507A69D82C05B6"><enum>(B)</enum><text>includes paratransit transportation and non-emergency medical transportation.</text></subparagraph></paragraph><paragraph id="HE10D3740B8A9482EB24245232601C924"><enum>(4)</enum><header>Non-emergency medical transportation</header><text>The term <term>non-emergency medical transportation</term> means the provision of transportation services for individuals who require assistance.</text></paragraph><paragraph id="HDB5606A902114FD59EEA5FD8A9EC79EA" commented="no"><enum>(5)</enum><header>Small business</header><text display-inline="yes-display-inline">The term <term>small business</term> has the meaning given the term <term>small business concern</term> in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>). </text></paragraph></subsection></section></legis-body></bill>
