R. 2137</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250314">March 14, 2025</action-date><action-desc><sponsor name-id="L000603">Mr. Luttrell</sponsor> (for himself, <cosponsor name-id="M001220">Mr. McGarvey</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, and <cosponsor name-id="P000048">Mr. Pfluger</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to limit the authority of the Secretary of Veterans Affairs to deny the claim of a veteran for benefits under the laws administered by such Secretary on the sole basis that such veteran failed to appear for a medical examination associated with such claim.</official-title></form><legis-body id="H1A41F24F7970494CA33ED0181F2CA510" style="OLC"><section id="HFD178D67424243B6B5139452C328E1AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Review Every Veterans Claim Act of 2025</short-title></quote>. </text></section><section id="H7B2E60490AD94DAD9D8ADB1BF1ADE010"><enum>2.</enum><header>Prohibition on denial of claims for benefits under laws administered by Secretary of Veterans Affairs on sole basis that veteran failed to appear for certain medical examination</header><text display-inline="no-display-inline">Subsection (d) of section 5103A of title 38, United States Code, is amended—</text><paragraph id="H747F351B4BD24C6A8A1DBC5AC2CCF982"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="USC">compensation claims</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">claims for benefits</header-in-text></quote>;</text></paragraph><paragraph id="HD8F37B74778B49EC92CEF30F2CC54B73"><enum>(2)</enum><text>in paragraph (2), by striking <quote>treat an examination or opinion as being necessary to make a decision on a claim for purposes of </quote> and inserting <quote>provide for a medical examination or obtain a medical opinion under</quote>; and</text></paragraph><paragraph id="HA206560D1979425E85A9ADBFAB995A79"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" id="H0A1A0C2423444914A6B9E138CBD853F4" display-inline="no-display-inline"><paragraph id="H20E6D709C3BD4694850F3DD12DD580F9" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">If a veteran fails to appear for a medical examination provided by the Secretary in conjunction with a claim for a benefit under a law administered by the Secretary, the Secretary may not deny such claim on the sole basis that such veteran failed to appear for such medical examination.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
