which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles XVIII and XIX of the Social Security Act, title XXVII of the Public Health Service Act, and the National Organ Transplant Act to prohibit certain organ transplants with specified connections to the People’s Republic of China.</official-title></form><legis-body id="H380B44F272A94442AD85F8EB0F045E5B" style="OLC"><section id="HDE584835C8974E0A9B95FDFE6C27B780" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Block Organ Transplant Purchases from China Act of 2025</short-title></quote> or the <quote>Block Act of 2025</quote>.</text></section><section id="HC70A873A18B84F53B78E469880B8C3B8"><enum>2.</enum><header>Prohibiting certain organ transplants</header><subsection id="H0A85161C25EA4C2DB19584511DF1647D"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1862(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)</external-xref>) is amended—</text><paragraph id="H247DFBC1382E41F1AD6B30B5AD387301" display-inline="no-display-inline"><enum>(1)</enum><text>in paragraph (24), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HBB6A466D05E5444B9381E421D2B35781"><enum>(2)</enum><text>in paragraph (25), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H3D6B3A5A9E8B48F4BB648DACC723244B"><enum>(3)</enum><text>by inserting after paragraph (25) the following new paragraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H03439599ADE34408A856FAFBAB1F38B8"><paragraph id="H6ED21F891D1A48AC9C6DD13BA4B83EB8"><enum>(26)</enum><text>where such expenses are for—</text><subparagraph id="H33D45BC0256E4DF4966A9693A9317A6B"><enum>(A)</enum><text display-inline="yes-display-inline">a prohibited organ transplant (as defined in section 402(d) of the National Organ Transplant Act) furnished on or after January 1, 2026; or</text></subparagraph><subparagraph id="HC20C17AB710C47F3AF653A96C5889FD1"><enum>(B)</enum><text display-inline="yes-display-inline">any item or service furnished on or after January 1, 2026, in connection with such a prohibited organ transplant, including a follow-up appointment, laboratory test, or drug, unless such item or service is furnished to save the life of an individual after such individual receives such a prohibited organ transplant.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H696C43B7AF4F473DB4ECBCA78FA4E297"><enum>(b)</enum><header>Medicaid</header><paragraph id="H2DCD11529D6D4DCDAF4AD1EE8EAA4D35"><enum>(1)</enum><header>In general</header><text>Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended—</text><subparagraph id="H64BAFF56289041A8BFF02354E37AEEFA" display-inline="no-display-inline"><enum>(A)</enum><text>in paragraph (86), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H433E643DF6D741838D328030E586676E"><enum>(B)</enum><text>in paragraph (87)(D), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H64769054E95947619DD24D9B7FC545D1"><enum>(C)</enum><text>by inserting after paragraph (87) the following new paragraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H70B4004398EA4158BEA9BA214C5175D4"><paragraph id="HCC70005069C049F0B2D4C9004953B838" commented="no"><enum>(88)</enum><text display-inline="yes-display-inline">provide that no payment may be made under the plan for—</text><subparagraph id="HF2D2A9E4F6934FFBBB6DF257ACDFA86D"><enum>(A)</enum><text display-inline="yes-display-inline">a prohibited organ transplant (as defined in section 402(d) of the National Organ Transplant Act) furnished on or after January 1, 2026; or</text></subparagraph><subparagraph id="H2A8D6A7BB32B462581C073F792223A18"><enum>(B)</enum><text display-inline="yes-display-inline">any item or service furnished on or after January 1, 2026, in connection with such a prohibited organ transplant, including a follow-up appointment, laboratory test, or drug, unless such item or service is furnished to save the life of an individual after such individual receives such a prohibited organ transplant.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H692061C7DCF042A7AB9179107ADDD9BF"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 1903(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(i)</external-xref>) is amended—</text><subparagraph id="H98A984C274BA4961B8F00606D71DF61D"><enum>(A)</enum><text>in paragraph (26), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HE998737095364518A4FC45E9FDBDA19D"><enum>(B)</enum><text>in paragraph (27), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="HE2D3F2FE967248868C813D38ED068CA6"><enum>(C)</enum><text>by inserting after paragraph (27) the following new paragraph:</text><quoted-block style="OLC" id="HC640380A3FC24976BFDBBD4EA2614FD8" display-inline="no-display-inline"><paragraph id="HC90C60D081CE45D4B410578C3454A654" commented="no"><enum>(28)</enum><text display-inline="yes-display-inline">with respect to any amount expended for—</text><subparagraph id="H62F3484454C8401FA9E0D1270A469D09"><enum>(A)</enum><text display-inline="yes-display-inline">a prohibited organ transplant (as defined in section 402(d) of the National Organ Transplant Act) furnished on or after January 1, 2026; or</text></subparagraph><subparagraph id="H3C802654757F47E0AA0469476870B083"><enum>(B)</enum><text display-inline="yes-display-inline">any item or service furnished on or after January 1, 2026, in connection with such a prohibited organ transplant, including a follow-up appointment, laboratory test, or drug, unless such item or service is furnished to save the life of an individual after such individual receives such a prohibited organ transplant.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD968EA9BBC094B6392F4BFE58825E2E9" commented="no"><enum>(3)</enum><header>Application to managed care entities</header><text>Section 1903(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(i)</external-xref>), as amended by paragraph (2), is further amended in the flush left text following paragraph (28) by striking <quote>and (18)</quote> and inserting <quote>(18), and (28)</quote>.</text></paragraph></subsection><subsection id="H74CCA4392FA54D27BAF8290B14DE609C"><enum>(c)</enum><header>Public Health Service Act</header><paragraph id="H402B062037E6496381D2FC289889606A"><enum>(1)</enum><header>In general</header><text>Subpart II of part A of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-11">42 U.S.C. 300gg–11 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H978316B6814C49E887D6B3C8D08643F5" display-inline="no-display-inline"><section id="H1AAE56EF32C94EFFA06B790E2FA46CB1"><enum>2730.</enum><header>Prohibition on coverage for certain organ transplants</header><text display-inline="no-display-inline">A group health plan, and a health insurance issuer offering group or individual health insurance coverage, may not provide coverage for—</text><paragraph id="H5C5CF845431E479786AD8898E850E5E7"><enum>(1)</enum><text display-inline="yes-display-inline">a prohibited organ transplant (as defined in section 402(d) of the National Organ Transplant Act); or</text></paragraph><paragraph id="H04B8E8EA4CE84AA9BB36FF591F498C29"><enum>(2)</enum><text display-inline="yes-display-inline">any item or service furnished in connection with such a prohibited organ transplant, including a follow-up appointment, laboratory test, or drug, unless such item or service is furnished to save the life of an individual after such individual receives such a prohibited organ transplant.</text></paragraph></section><after-quoted-block>. </after-quoted-block></quoted-block></paragraph><paragraph id="H38C85F9CAAB240B3A374E6EF41B15E44"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply with respect to plan years beginning on or after January 1, 2026.</text></paragraph></subsection><subsection id="H61F0077F42964BAA9090A8EE61C6E582" commented="no"><enum>(d)</enum><header>Penalty for providing certain organ transplants</header><text>Title IV of the National Organ Transplant Act (<external-xref legal-doc="public-law" parsable-cite="pl/98/507">Public Law 98–507</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H48C384A24C5745E180080C0FCD633963" display-inline="no-display-inline"><section id="H17D54F12E7D54AABB5AEA681C65AEB7F" commented="no"><enum>402.</enum><header>Prohibition on certain organ transplants</header><subsection id="HBDE6941AEC944505BCAC93653D37103D" commented="no"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Beginning on January 1, 2026, no health care provider may furnish—</text><paragraph id="HC83AD02C5E2A4948A0F5946EDEB8B888"><enum>(1)</enum><text display-inline="yes-display-inline">a prohibited organ transplant; or</text></paragraph><paragraph id="H665A98B094AA4F3A9E54EF48A3B871E7"><enum>(2)</enum><text display-inline="yes-display-inline">any item or service in connection with such a prohibited organ transplant, including a follow-up appointment, laboratory test, or drug, unless such item or service is furnished to save the life of an individual after such individual receives such a prohibited organ transplant.</text></paragraph></subsection><subsection id="H4D51BFA2D6B84C5D9384106ECB1684C6" commented="no"><enum>(b)</enum><header>Criminal penalty</header><text>Any person who knowingly violates subsection (a) shall be fined under title 18, United States Code, imprisoned for not more than 2 years, or both.</text></subsection><subsection id="H14C6F0B9DE3F42D7AD1B72F38A2F052C" commented="no"><enum>(c)</enum><header>Civil penalty</header><paragraph id="H1DE50DB5F8504875913E5B50B4364064"><enum>(1)</enum><header>In general</header><text>The Attorney General or the attorney general of a State where the prohibited organ transplant or item or service described in subsection (a) is furnished may bring a civil action in the appropriate United States district court against any person who knowingly violates subsection (a) and, upon proof of such violation by a preponderance of the evidence, such person shall be subject to a civil penalty equal to three times the cost of furnishing such prohibited organ transplant or item or service (as determined by the Secretary of Health and Human Services).</text></paragraph><paragraph id="HFDCB73C3F0C741A2A0C002F7577AFBDA"><enum>(2)</enum><header>Authority to intervene</header><text>The Attorney General may intervene in any civil action brought by the attorney general of a State under paragraph (1).</text></paragraph></subsection><subsection id="HDFC7E95943974398BC05B6D5C2564A59"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4F4EFB1034EA450C9DE092DDE0BC5117"><enum>(1)</enum><header>Health care provider</header><text>The term <term>health care provider</term> has the meaning given such term in section 1171 of the Social Security Act. </text></paragraph><paragraph id="HEC8168F5C3AF439F8FDB99964A0734E7"><enum>(2)</enum><header>Prohibited organ transplant</header><text>The term <term>prohibited organ transplant</term> means the transplantation of a specified human organ that—</text><subparagraph id="H07D7A7F765F44A2C9FA2F99088D44CEF"><enum>(A)</enum><text>occurs in the People’s Republic of China; or</text></subparagraph><subparagraph id="H957C5F938D8A47C58BFAF92A52AC6469"><enum>(B)</enum><text>transplants a specified human organ that is not procured through the Organ Procurement and Transplantation Network established under section 372 of the Public Health Service Act.</text></subparagraph></paragraph><paragraph id="H179DFAD93BBE478BB56ABCE46BF2FC40"><enum>(3)</enum><header>Specified human organ</header><text display-inline="yes-display-inline">The term <term>specified human organ</term> means the human (including fetal) kidney, liver, heart, lung, pancreas, bone marrow, cornea, eye, bone, intestine (including the esophagus, stomach, small intestine, large intestine, and any other portion of the gastrointestinal tract), any vascularized composite allograft (as defined in section 121.2 of title 42, Code of Federal Regulations (or any successor regulation)), or any subpart thereof (including that derived from a fetus).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H35B5EB989D964BCF802A4BD52725CF20" commented="no"><enum>(e)</enum><header>Rulemaking</header><text>Not later than January 1, 2026, the Secretary of Health and Human Services shall issue such rules as are necessary to identify—</text><paragraph id="H2DAA54A8020C4773AD54B84C380AF3AE"><enum>(1)</enum><text>the items and services prohibited under the amendments made by this section; and</text></paragraph><paragraph id="H278A604F624142B09892B0B26188F291"><enum>(2)</enum><text display-inline="yes-display-inline">the cost of furnishing a prohibited organ transplant (as defined in section 402(d) of the National Organ Transplant Act, as amended by this Act) or such items and services for purposes of calculating the civil penalty under the amendments made by subsection (d).</text></paragraph></subsection></section></legis-body></bill>
