GAO Report.</toc-entry></toc></subsection></section><title id="HE6A0968C107D43ACA80CB7D8AD3AED8C"><enum>I</enum><header>Amendments to the National Labor Relations Act</header><section display-inline="no-display-inline" section-type="subsequent-section" id="H77F83BF1679C497A9E2430C1279D6A7D"><enum>101.</enum><header>Definitions</header><subsection id="H2A9041B3343749DD845FB1FDB83CF498"><enum>(a)</enum><header>Joint employer</header><text display-inline="yes-display-inline">Section 2(2) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(2)</external-xref>) is amended by adding at the end the following: <quote>Two or more persons shall be employers with respect to an employee if each such person codetermines or shares control over the employee’s essential terms and conditions of employment. In determining whether such control exists, the Board or a court of competent jurisdiction shall consider as relevant direct control and indirect control over such terms and conditions, reserved authority to control such terms and conditions, and control over such terms and conditions exercised by a person in fact: <italic>Provided,</italic> That nothing herein precludes a finding that indirect or reserved control standing alone can be sufficient given specific facts and circumstances.</quote>.</text></subsection><subsection id="HA23371D4DBCF43B789BCE6CA3494E4DB"><enum>(b)</enum><header>Employee</header><text display-inline="yes-display-inline">Section 2(3) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(3)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="H709421F61DAF43CB8F9AD8FB2407CDA6"><text>An individual performing any service shall be considered an employee (except as provided in the previous sentence) and not an independent contractor, unless—</text><subparagraph id="HD39D73D5FD184089AF82D0AC6048C170"><enum>(A)</enum><text>the individual is free from control and direction in connection with the performance of the service, both under the contract for the performance of service and in fact;</text></subparagraph><subparagraph id="H8789076368504CF0BBBF455B86ACF418"><enum>(B)</enum><text>the service is performed outside the usual course of the business of the employer; and</text></subparagraph><subparagraph id="H596CDE35CD4F43C19D8866D390CD05D0"><enum>(K)</enum><text>by adding at the end the following:</text><quoted-block style="traditional" display-inline="no-display-inline" id="HDC7E7E59EAEA4361AA32D1CDA75CEA0B"><paragraph id="H3907E6D1DA9242B38F2D6837A89AEDE1" indent="up1"><enum>(3)</enum><text>Whenever collective bargaining is for the purpose of establishing an initial collective bargaining agreement following certification or recognition of a labor organization, the following shall apply:</text><subparagraph id="H771B2A24517C4A24A4708303356E486F"><enum>(A)</enum><text>Not later than 10 days after receiving a written request for collective bargaining from an individual or labor organization that has been newly recognized or certified as a representative as defined in section 9(a), or within such further period as the parties agree upon, the parties shall meet and commence to bargain collectively and shall make every reasonable effort to conclude and sign a collective bargaining agreement.</text></subparagraph><subparagraph id="H5757340F5C474AB19BBA216802E17C9B"><enum>(B)</enum><text>If after the expiration of the 90-day period beginning on the date on which bargaining is commenced, or such additional period as the parties may agree upon, the parties have failed to reach an agreement, either party may notify the Federal Mediation and Conciliation Service of the existence of a dispute and request mediation. Whenever such a request is received, it shall be the duty of the Service promptly to put itself in communication with the parties and to use its best efforts, by mediation and conciliation, to bring them to agreement.</text></subparagraph><subparagraph id="HF0D7E9E5464B4C9BB2618F35F7E919FC"><enum>(C)</enum><text display-inline="yes-display-inline">If after the expiration of the 30-day period beginning on the date on which the request for mediation is made under subparagraph (B), or such additional period as the parties may agree upon, the Service is not able to bring the parties to agreement by conciliation, the Service shall refer the dispute to a tripartite arbitration panel established in accordance with such regulations as may be prescribed by the Service, with one member selected by the labor organization, one member selected by the employer, and one neutral member mutually agreed to by the parties. The labor organization and employer must each select the members of the tripartite arbitration panel within 14 days of the Service’s referral; if the labor organization or employer fail to do so, the Service shall designate any members not selected by the labor organization or the employer. A majority of the tripartite arbitration panel shall render a decision settling the dispute as soon as practicable and not later than within 120 days, absent extraordinary circumstances or by agreement or permission of the parties, and such decision shall be binding upon the parties for a period of 2 years, unless amended during such period by written consent of the parties. Such decision shall be based on—</text><clause id="H16290592E6894FD6B3270C8E632A17DD"><enum>(i)</enum><text>the employer’s financial status and prospects;</text></clause><clause id="H8BB6AC8219C34DA5B97E8DF0D0461509"><enum>(ii)</enum><text>the size and type of the employer’s operations and business;</text></clause><clause id="HDCDB8655CB8140FD9025824EA58F8E6F"><enum>(iii)</enum><text>the employees’ cost of living;</text></clause><clause id="H407D5B4F63C44C208C0489EC76423AA7"><enum>(iv)</enum><text>the employees’ ability to sustain themselves, their families, and their dependents on the wages and benefits they earn from the employer; and</text></clause><clause id="H0448D809A1DB4A59A2AF3C065E3BE318"><enum>(v)</enum><text>the wages and benefits other employers in the same business provide their employees.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H37677BB137F04DD0A51099A8991B2D4B"><enum>(5)</enum><text>by amending subsection (e) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBA1FCC2010D148A4BE15AEA498C51473"><subsection id="H67D8012019F2450CA7E8A7203F056A55"><enum>(e)</enum><text>Notwithstanding <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/1">chapter 1</external-xref> of title 9, United States Code (commonly known as the <quote>Federal Arbitration Act</quote>), or any other provision of law, it shall be an unfair labor practice under subsection (a)(1) for any employer—</text><paragraph id="HCAF8EC212FD64F8EAC77780F2BC26E01"><enum>(1)</enum><text display-inline="yes-display-inline">to enter into or attempt to enforce any agreement, express or implied, whereby prior to a dispute to which the agreement applies, an employee undertakes or promises not to pursue, bring, join, litigate, or support any kind of joint, class, or collective claim arising from or relating to the employment of such employee in any forum that, but for such agreement, is of competent jurisdiction;</text></paragraph><paragraph id="HD589C006C01D4A95B48EED32E049A723"><enum>(2)</enum><text display-inline="yes-display-inline">to coerce an employee into undertaking or promising not to pursue, bring, join, litigate, or support any kind of joint, class, or collective claim arising from or relating to the employment of such employee; or</text></paragraph><paragraph id="H574BED767AAC45CCA8F29CF5C42F9DF0"><enum>(3)</enum><text>to retaliate or threaten to retaliate against an employee for refusing to undertake or promise not to pursue, bring, join, litigate, or support any kind of joint, class, or collective claim arising from or relating to the employment of such employee: <italic>Provided</italic>, That any agreement that violates this subsection or results from a violation of this subsection shall be to such extent unenforceable and void: <italic>Provided further</italic>, That this subsection shall not apply to any agreement embodied in or expressly permitted by a contract between an employer and a labor organization.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H76F4F3B9F18049019D3E51296D88CA34"><enum>(6)</enum><text display-inline="yes-display-inline">in subsection (g), by striking <quote>clause (B) of the last sentence of section 8(d) of this Act</quote> and inserting <quote>subsection (d)(2)(B)</quote>; and</text></paragraph><paragraph id="H92344C63B27F4EBE920D411CFC0EA218"><enum>(7)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7585C347B6C5463885F0B2B33EE66E94"><subsection id="HE20B3A5C79C3420BB50A661F434037C7"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HEA47447937394100B801A01B578345D3"><enum>(1)</enum><text>The Board shall promulgate regulations requiring each employer to post and maintain, in conspicuous places where notices to employees and applicants for employment are customarily posted both physically and electronically, a notice setting forth the rights and protections afforded employees under this Act. The Board shall make available to the public the form and text of such notice. The Board shall promulgate regulations requiring employers to notify each new employee of the information contained in the notice described in the preceding two sentences and to ensure that such notice is provided to employees in a language spoken by such employees.</text></paragraph><paragraph commented="no" id="H466D0CA508E34524A02433BCCE6F0E8F" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Whenever the Board directs an election under section 9(c) or approves an election agreement, the employer of employees in the bargaining unit shall, not later than 2 business days after the Board directs such election or approves such election agreement, provide a voter list to a labor organization that has petitioned to represent such employees. Such voter list shall include the names of all employees in the bargaining unit and such employees’ home addresses, work locations, shifts, job classifications, and, if available to the employer, personal landline and mobile telephone numbers, work email addresses, and personal email addresses; the voter list must be provided in a searchable electronic format generally approved by the Board unless the employer certifies that the employer does not possess the capacity to produce the list in the required form. Not later than 9 months after the date of enactment of the <short-title>Richard L. Trumka Protecting the Right to Organize Act of 2025</short-title>, the Board shall promulgate regulations implementing the requirements of this paragraph.</text></paragraph></subsection><subsection commented="no" id="H68745D57D66F4DEC8FB918C9BACB176F"><enum>(i)</enum><text>The rights of an employee under section 7 include the right to use electronic communication devices and systems (including computers, laptops, tablets, internet access, email, cellular telephones, or other company equipment) of the employer of such employee to engage in activities protected under section 7 if such employer has given such employee access to such devices and systems in the course of the work of such employee, absent a compelling business rationale for denying or limiting such use.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H4E38C5E0978A4CD9A866B1A69ECCF30E"><enum>105.</enum><header>Representatives and elections</header><text display-inline="no-display-inline">Section 9 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159</external-xref>) is amended—</text><paragraph id="H4A1FD033134141E39330B03BF773C317"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="H971DEA1A961E4EBD83AE3309058DC177"><enum>(A)</enum><text display-inline="yes-display-inline">by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4F60E5A61D0447E7860A5B81A5243677"><paragraph id="HFB1E920F4467414FB55CEE14C19CCC58" indent="up1"><enum>(1)</enum><text display-inline="yes-display-inline">Whenever a petition shall have been filed, in accordance with such regulations as may be prescribed by the Board, by an employee or group of employees or any individual or labor organization acting in their behalf alleging that a substantial number of employees (i) wish to be represented for collective bargaining and that their employer declines to recognize their representative as the representative defined in section 9(a), or (ii) assert that the individual or labor organization, which has been certified or is being recognized by their employer as the bargaining representative, is no longer a representative as defined in section 9(a), the Board shall investigate such petition and if it has reasonable cause to believe that a question of representation affecting commerce exists shall provide for an appropriate hearing upon due notice. Such hearing may be conducted by an officer or employee of the regional office, who shall not make any recommendations with respect thereto. If the Board finds upon the record of such hearing that such a question of representation exists, it shall direct an election by secret ballot and shall certify the results thereof. The Board shall find the labor organization’s proposed unit to be appropriate if the employees in the proposed unit share a community of interest, and if the employees outside the unit do not share an overwhelming community of interest with employees inside. At the request of the labor organization, the Board shall direct that the election be conducted through mail, electronically, at the work location, or at a location other than one owned or controlled by the employer. No employer shall have standing as a party or to intervene in any representation proceeding under this section.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="HA188405D09444D2BA7A6769F56C138D7"><enum>(B)</enum><text>in paragraph (3), by striking <quote>an economic strike who are not entitled to reinstatement</quote> and inserting <quote>a strike</quote>;</text></subparagraph><subparagraph id="HD2CD2DFDD2E0443BA68E9DF3FEF82B5E"><enum>(C)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (6) and (7), respectively;</text></subparagraph><subparagraph id="H8D29A8168FE342A581564B2D698F2A8E"><enum>(D)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H15BFD9EE654F47348B71F527FBC495A9"><paragraph id="H67A3A51DACB643A4A94460B72B807BBF" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">If the Board finds that, in an election under paragraph (1), a majority of the valid votes cast in a unit appropriate for purposes of collective bargaining have been cast in favor of representation by the labor organization, the Board shall certify the labor organization as the representative of the employees in such unit and shall issue an order requiring the employer of such employees to collectively bargain with the labor organization in accordance with section 8(d). This order shall be deemed an order under section 10(c) of this Act, without need for a determination of an unfair labor practice.</text></paragraph><paragraph id="HD08350EC1F704F5A822AE5340F26D68D" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H82185D0A80AF47E4AC69F8DF9C3683AE"><enum>(A)</enum><text>If the Board finds that, in an election under paragraph (1), a majority of the valid votes cast in a unit appropriate for purposes of collective bargaining have not been cast in favor of representation by the labor organization, the Board shall certify the results of the election, subject to subparagraphs (B) and (C).</text></subparagraph><subparagraph id="HB4A88677D3BE4CCC9169D2BEBF29F435" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In any case in which a majority of the valid votes cast in a unit appropriate for purposes of collective bargaining have not been cast in favor of representation by the labor organization and the Board determines, following a post-election hearing, that the employer has committed a violation of this Act or otherwise interfered with a fair election, and the employer has not demonstrated that the violation or other interference is unlikely to have affected the outcome of the election, the Board shall, without ordering a new election, set aside the election and certify the labor organization as the representative of the employees in such unit and issue an order requiring the employer to bargain with the labor organization in accordance with section 8(d) if, at any time during the period beginning 1 year preceding the date of the commencement of the election and ending on the date upon which the Board makes the determination of a violation or other interference, a majority of the employees in the bargaining unit have signed authorizations designating the labor organization as their collective bargaining representative.</text></subparagraph><subparagraph id="H1C0CA457713E4B439938AF1E96B39BAA" indent="up1"><enum>(C)</enum><text>In any case where the Board determines that an election under this paragraph should be set aside, the Board shall direct a new election with appropriate additional safeguards necessary to ensure a fair election process, except in cases where the Board issues a bargaining order under subparagraph (B).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H5047861C42474835B43FDCB6F4AE5063"><enum>(E)</enum><text>by inserting after paragraph (7), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF3F4F2A7C566489A8EBD1911BBB8B9C6"><paragraph id="H279AC00D3E2C45D09B13A2D41865DD2D" indent="up1"><enum>(8)</enum><text>Except under extraordinary circumstances—</text><subparagraph id="H4A06A3697BB7470A889F58CB594C2518"><enum>(A)</enum><text>a pre-election hearing under this subsection shall begin not later than 8 days after a notice of such hearing is served on the labor organization and shall continue from day to day until completed;</text></subparagraph><subparagraph display-inline="no-display-inline" id="H2649BC9EBE2843F48B75CEADD7D41E96"><enum>(B)</enum><text display-inline="yes-display-inline">a regional director shall transmit the notice of election at the same time as the direction of election, and shall transmit such notice and such direction electronically (including transmission by email or facsimile) or by overnight mail if electronic transmission is unavailable;</text></subparagraph><subparagraph display-inline="no-display-inline" id="H16E1517106394D98BCA562ABB5F5BDDB"><enum>(C)</enum><text display-inline="yes-display-inline">not later than 2 days after the service of the notice of hearing, the employer shall—</text><clause id="HFBADD3024EDE47009147FA64677B58C5"><enum>(i)</enum><text>post the Notice of Petition for Election in conspicuous places, including all places where notices to employees are customarily posted;</text></clause><clause id="H1C5F23C2CD644D84A03A5CED4CB476EC"><enum>(ii)</enum><text display-inline="yes-display-inline">if the employer customarily communicates with employees electronically, distribute such Notice electronically; and</text></clause><clause id="H4A97612CE9AD4176ACC9D28FAC2C95C1"><enum>(iii)</enum><text>maintain such posting until the petition is dismissed or withdrawn or the Notice of Petition for Election is replaced by the Notice of Election;</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="HD39139FB91C4431583BBD6F771BFAB03"><enum>(D)</enum><text display-inline="yes-display-inline">regional directors shall schedule elections for the earliest date practicable, but not later than the 20th business day after the direction of election; and</text></subparagraph><subparagraph id="H7F2F094B5AF94C62B2D1E8A5ADED2A03"><enum>(E)</enum><text>a post-election hearing under this subsection shall begin not later than 14 days after the filing of objections, if any.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB790BA3F63C44A339D49872563646D1E"><enum>(2)</enum><text>in subsection (d), by striking <quote>(e) or</quote> and inserting <quote>(d) or</quote>; and</text></paragraph><paragraph id="H8EBC12B8FA334F6DBB0EB483B7323178"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8A3B5C1D049241128CAE27271AE60189"><subsection id="HAADA44D0EB0A45F5B2BD8A5338019A83"><enum>(f)</enum><text display-inline="yes-display-inline">The Board shall dismiss any petition for an election with respect to a bargaining unit or any subdivision if, during the 12-month period ending on the date on which the petition is filed—</text><paragraph id="HCFCAF5C35A97400887E31E339CC58217"><enum>(1)</enum><text>the employer has recognized a labor organization without an election and in accordance with this Act;</text></paragraph><paragraph id="H43F4DE3F9CB94AADB272F7D2A5B28482"><enum>(2)</enum><text display-inline="yes-display-inline">the labor organization and employer engaged in their first bargaining session following the issuance of a bargaining order by the Board; or</text></paragraph><paragraph id="H87DE41190ED64B65BBBD80DD61F71B15"><enum>(3)</enum><text display-inline="yes-display-inline">the labor organization and successor employer engaged in their first bargaining session following a succession.</text></paragraph></subsection><subsection id="H0088B649B54649618B3D4803C2D53673"><enum>(g)</enum><text display-inline="yes-display-inline">The Board shall dismiss any petition for an election with respect to a bargaining unit or any subdivision if there is in effect a lawful written collective bargaining agreement between the employer and an exclusive representative covering any employees in the unit specified in the petition, unless the petition is filed—</text><paragraph id="HEFA3199C300D4C2AB71D07AF83F3DFF5"><enum>(1)</enum><text>on or after the date that is 3 years after the date on which the collective bargaining agreement took effect; or</text></paragraph><paragraph id="HDA23338181574290898F6324BAB22FFF"><enum>(2)</enum><text display-inline="yes-display-inline">during the 30-day period beginning on the date that is 90 days before the date that is 3 years after the date on which the collective bargaining agreement took effect.</text></paragraph></subsection><subsection id="H4C6B18F9148E42A9BEB8208330497C31"><enum>(h)</enum><text display-inline="yes-display-inline">The Board shall suspend the processing of any petition for an election with respect to a bargaining unit or any subdivision if a labor organization files an unfair labor practice charge alleging a violation of section 8(a) and requesting the suspension of a pending petition until the unlawful conduct, if any, is remedied or the charge is dismissed unless the Board determines that employees can, under the circumstances, exercise free choice in an election despite the unlawful conduct alleged in the charge.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H022A428828AC453BBB46843EBD0CDC10"><enum>106.</enum><header>Damages for unfair labor practices</header><text display-inline="no-display-inline">Section 10(c) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/160">29 U.S.C. 160(c)</external-xref>) is amended by striking <quote>suffered by him</quote> and inserting <quote>suffered by such employee: <italic>Provided further,</italic> That if the Board finds that an employer has discriminated against an employee in violation of paragraph (3) or (4) of section 8(a) or has committed a violation of section 8(a) that results in the discharge of an employee or other serious economic harm to an employee, the Board shall award the employee back pay without any reduction (including any reduction based on the employee’s interim earnings or failure to earn interim earnings), front pay (when appropriate), full compensation for all direct or foreseeable pecuniary harms suffered as a result of the respondent’s unfair labor practice, and an additional amount as liquidated damages equal to two times the amount of damages awarded: <italic>Provided further,</italic> no relief under this subsection shall be denied on the basis that the employee is, or was during the time of relevant employment or during the back pay period, an unauthorized alien as defined in section 274A(h)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(h)(3)</external-xref>) or any other provision of Federal law relating to the unlawful employment of aliens</quote>.</text></section><section id="H7CF2619CEADB48C7BF92E0969F56C437"><enum>107.</enum><header>Enforcing compliance with orders of the board</header><subsection id="HF7C9DFD577A94592B17C7DD5A1E942C4"><enum>(a)</enum><header>In general</header><text>Section 10 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/160">29 U.S.C. 160</external-xref>) is further amended—</text><paragraph id="H85415D6E5E134235B73FF95993EC9298"><enum>(1)</enum><text>by striking subsection (e);</text></paragraph><paragraph id="H90250284FD1B4D54BFC37AD9FE02A5C1"><enum>(2)</enum><text>by redesignating subsection (d) as subsection (e);</text></paragraph><paragraph id="HCF3B60616657412DB3E3CF2938A48BC0"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9A05AC66F8804C7C8588D5D7A0A9C29B"><subsection id="H5D44725897E747C9B63A071C5C8403B4"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HAFDA357C9BF645178B8574E409815557"><enum>(1)</enum><text>Each order of the Board shall be self-enforcing upon issuance of such order, unless otherwise directed by the Board, and shall remain self-enforcing unless modified by the Board or unless a court of competent jurisdiction issues a superseding order.</text></paragraph><paragraph id="H4E639FD945DF4C8999BE6E92F91CAF11" indent="up1"><enum>(2)</enum><text>Any person who fails or neglects to obey an order of the Board shall forfeit and pay to the Board a civil penalty of not more than $10,000 for each violation, which shall accrue to the United States and may be recovered in a civil action brought by the Board to the district court of the United States in which the unfair labor practice or other subject of the order occurred, or in which such person or entity resides or transacts business. No action by the Board under this paragraph may be made until 30 days following the issuance of an order. Each separate violation of such an order shall be a separate offense, except that, in the case of a violation in which a person fails to obey or neglects to obey a final order of the Board, each day such failure or neglect continues shall be deemed a separate offense.</text></paragraph><paragraph id="HBD8FD11A08D64AF29200161B9F25595E" indent="up1"><enum>(3)</enum><text>If, after having provided a person or entity with notice and an opportunity to be heard regarding a civil action under paragraph (2) for the enforcement of an order, the court determines that the order was regularly made and duly served, and that the person or entity is in disobedience of the same, the court shall enforce obedience to such order by an injunction or other proper process, mandatory or otherwise, to—</text><subparagraph commented="no" id="H02480867EAD04736AF9623D48FA688A3"><enum>(A)</enum><text>restrain such person or entity or the officers, agents, or representatives of such person or entity, from further disobedience to such order; or</text></subparagraph><subparagraph commented="no" id="H0DA04F73050B46E59865D3D1E55A9A7E"><enum>(B)</enum><text>enjoin such person or entity, officers, agents, or representatives to obedience to the same.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HC571852D8B264A59ABC6E92439DB3B17"><enum>(4)</enum><text>in subsection (f)—</text><subparagraph id="HE5F5A7239F3E44B9934CDBFD2D72D032"><enum>(A)</enum><text>by striking <quote>proceed in the same manner as in the case of an application by the Board under subsection (e) of this section,</quote> and inserting <quote>proceed as provided under paragraph (2) of this subsection</quote>;</text></subparagraph><subparagraph id="H9045F95B596E459BB79253EFCD36292A"><enum>(B)</enum><text>by striking <quote>Any</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H64C0A0B6F465488783335BA18015C3F4"><paragraph id="H3BB8FC2B009A47FE92D867F9BBC60ED9"><enum>(1)</enum><text>Within 30 days of the issuance of an order, any</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H2DBD3C4EDCFE45309D6BBC676E809391"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3B309DA493C84D8BACF5AF141203AB53"><paragraph id="HD0526EFDD8424B9EA966F08CEE6BC716" indent="up1"><enum>(2)</enum><text>No objection that has not been urged before the Board, its member, agent, or agency shall be considered by a court, unless the failure or neglect to urge such objection shall be excused because of extraordinary circumstances. The findings of the Board with respect to questions of fact if supported by substantial evidence on the record considered as a whole shall be conclusive. If either party shall apply to the court for leave to adduce additional evidence and shall show to the satisfaction of the court that such additional evidence is material and that there were reasonable grounds for the failure to adduce such evidence in the hearing before the Board, its member, agent, or agency, the court may order such additional evidence to be taken before the Board, its member, agent, or agency, and to be made a part of the record. The Board may modify its findings as to the facts, or make new findings, by reason of additional evidence so taken and filed, and it shall file such modified or new findings, which findings with respect to questions of fact if supported by substantial evidence on the record considered as a whole shall be conclusive, and shall file its recommendations, if any, for the modification or setting aside of its original order. Upon the filing of the record with it the jurisdiction of the court shall be exclusive and its judgment and decree shall be final, except that the same shall be subject to review by the appropriate United States court of appeals if application was made to the district court, and by the Supreme Court of the United States upon writ of certiorari or certification as provided in section 1254 of title 28, United States Code.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H93CDE3021D1244DB8C8171F6AFDE623B"><enum>(5)</enum><text>in subsection (g), by striking <quote>subsection (e) or (f) of this section</quote> and inserting <quote>subsection (d) or (f)</quote>.</text></paragraph></subsection><subsection id="H990632F7F02F402D8DC31B15B7A47BF0"><enum>(b)</enum><header>Conforming amendment</header><text>Section 18 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/168">29 U.S.C. 168</external-xref>) is amended by striking <quote>section 10(e) or (f)</quote> and inserting <quote>subsection (d) or (f) of section 10</quote>.</text></subsection></section><section id="H07EF5ED8EFC74F1AA3F0B66B8207B7B2"><enum>108.</enum><header>Injunctions against unfair labor practices involving discharge or other serious economic harm</header><text display-inline="no-display-inline">Section 10 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/160">29 U.S.C. 160</external-xref>) is amended—</text><paragraph id="H9514720B8FC94BC8A735399ADF075EB0"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (j)—</text><subparagraph id="HA5314D852DB54BAF9363FD8C3A18112F"><enum>(A)</enum><text>by striking <quote>The Board</quote> and inserting <quote>(1) The Board</quote>; and</text></subparagraph><subparagraph id="H1E22AA3E413D4BBD8D231AA3EFD6E170"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8B75F80428954763AA9EE4147BE848D8"><paragraph id="H27A144D25B234F308B8F33AC4A2D7B29" indent="up1"><enum>(2)</enum><text>Notwithstanding subsection (m), whenever it is charged that an employer has engaged in an unfair labor practice within the meaning of paragraph (1), (3), or (4) of section 8(a) that significantly interferes with, restrains, or coerces employees in the exercise of the rights guaranteed under section 7, or involves discharge or other serious economic harm to an employee, the preliminary investigation of such charge shall be made forthwith and given priority over all other cases except cases of like character in the office where it is filed or to which it is referred. If, after such investigation, the officer or regional attorney to whom the matter may be referred has reasonable cause to believe such charge is true and that a complaint should issue, such officer or attorney shall bring a petition for appropriate temporary relief or restraining order as set forth in paragraph (1). The district court shall grant the relief requested unless the court concludes that there is no reasonable likelihood that the Board will succeed on the merits of the Board’s claim.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="H7251DA4E2A0A4E7B9288A9C8152BF3D0"><enum>(2)</enum><text display-inline="yes-display-inline">by repealing subsections (k) and (l).</text></paragraph></section><section id="HAFD17C44988B49E7937D2FE3C664CF75"><enum>109.</enum><header>Penalties</header><subsection id="H710A1E9AD8964958832340CDAAAEEB9D"><enum>(a)</enum><header>In general</header><text>Section 12 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/162">29 U.S.C. 162</external-xref>) is amended—</text><paragraph commented="no" id="H3DF42611C27E4778AA3F8A9FE0B68212"><enum>(1)</enum><text>by striking <quote><header-in-text level="subsection" style="traditional">Sec. 12.</header-in-text> Any person</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF941158145D947A6881A327AEF759C03"><section id="H0335188ED50A425DB526CB7DA52E82D3"><enum>12.</enum><header>Penalties</header><subsection id="H09B07C59D36446C8A511DAE902C04A79"><enum>(a)</enum><header>Violations for interference with board</header><text>Any person</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H28402AF2DABC40F4B649C333441DBC74"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBC13DF98B4F44743AA1C0E72AC4B196D"><subsection id="H11ADD027121A4AF0AF20BCE868B323C3"><enum>(b)</enum><header>Violations for posting requirements and voter list</header><text>If the Board, or any agent or agency designated by the Board for such purposes, determines that an employer has violated section 8(h) or regulations issued thereunder, the Board shall—</text><paragraph id="H85CD10E264714A789C0D51CB6A49A3DD"><enum>(1)</enum><text>state the findings of fact supporting such determination;</text></paragraph><paragraph id="H63E4627289D144BE809D3BA6A6653617"><enum>(2)</enum><text>issue and cause to be served on such employer an order requiring that such employer comply with section 8(h) or regulations issued thereunder; and</text></paragraph><paragraph id="HC5BF1D5D11A54DDD9E72F05965137171"><enum>(3)</enum><text>impose a civil penalty in an amount determined appropriate by the Board, except that in no case shall the amount of such penalty exceed $500 for each such violation.</text></paragraph></subsection><subsection id="HAF8A57A7ADF84F20B4B7023086C41611"><enum>(c)</enum><header>Civil penalties for violations</header><paragraph id="H03C47DC22EBA4FBF8BB8BDA15F803503"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any employer who commits an unfair labor practice within the meaning of section 8(a) shall, in addition to any remedy ordered by the Board, be subject to a civil penalty in an amount not to exceed $50,000 for each violation, except that, with respect to an unfair labor practice within the meaning of paragraph (3) or (4) of section 8(a) or a violation of section 8(a) that results in the discharge of an employee or other serious economic harm to an employee, the Board shall double the amount of such penalty, to an amount not to exceed $100,000, in any case where the employer has within the preceding 5 years committed another such violation.</text></paragraph><paragraph id="H7F56663408824863AAC117D6FBC8DE67"><enum>(2)</enum><header>Considerations</header><text>In determining the amount of any civil penalty under this subsection, the Board shall consider—</text><subparagraph id="HB93A61D118F141E1806B95C02A0A0223"><enum>(A)</enum><text>the gravity of the unfair labor practice;</text></subparagraph><subparagraph id="H8BB1C70875F349959685FE19819536EF"><enum>(B)</enum><text>the impact of the unfair labor practice on the charging party, on other persons seeking to exercise rights guaranteed by this Act, and on the public interest; and</text></subparagraph><subparagraph id="H88FFFEDD13ED4D83AA3A6894C0EC4652"><enum>(C)</enum><text>the gross income of the employer.</text></subparagraph></paragraph><paragraph id="H8B7B9E52CF994D61960DBED4A7FAC122"><enum>(3)</enum><header>Director and officer liability</header><text>If the Board determines, based on the particular facts and circumstances presented, that a director or officer’s personal liability is warranted, a civil penalty for a violation described in this subsection may also be assessed against any director or officer of the employer who directed or committed the violation, had established a policy that led to such a violation, or had actual or constructive knowledge of and the authority to prevent the violation and failed to prevent the violation.</text></paragraph></subsection><subsection id="H1D37C33F98DA48ECA90F013D4A8BEFDB"><enum>(d)</enum><header>Right to civil action</header><paragraph id="H3E4F40EDCD964D55864F4E56F3A24CCD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any person who is injured by reason of a violation of paragraph (1), (3), or (4) of section 8(a) may, after 60 days following the filing of a charge with the Board alleging an unfair labor practice, bring a civil action in the appropriate district court of the United States against the employer within 90 days after the expiration of the 60-day period or the date the Board notifies the person that no complaint shall issue, whichever occurs earlier, provided that the Board has not filed a petition under section 10(j) of this Act prior to the expiration of the 60-day period. No relief under this subsection shall be denied on the basis that the employee is, or was during the time of relevant employment or during the back pay period, an unauthorized alien as defined in section 274A(h)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(h)(3)</external-xref>) or any other provision of Federal law relating to the unlawful employment of aliens.</text></paragraph><paragraph id="HD44A61331FB74F35B425E8A60E72C1FC"><enum>(2)</enum><header>Available relief</header><text>Relief granted in an action under paragraph (1) may include—</text><subparagraph id="H4DE5E0B400D347D996920C043E9B2C0D"><enum>(A)</enum><text>back pay without any reduction, including any reduction based on the employee’s interim earnings or failure to earn interim earnings;</text></subparagraph><subparagraph id="H8116E3B62FCB4A1E9E0C2F2C1D9AA2F8"><enum>(B)</enum><text>front pay (when appropriate);</text></subparagraph><subparagraph id="HB21A52AA5F8447988A659EAD2836747D"><enum>(C)</enum><text display-inline="yes-display-inline">all direct or foreseeable pecuniary harms suffered as a result of the unfair labor practice;</text></subparagraph><subparagraph id="H66BDA396F5B84B5DB4C90AD2BE03B75F"><enum>(D)</enum><text>an additional amount as liquidated damages equal to two times the cumulative amount of damages awarded under subparagraphs (A) through (C);</text></subparagraph><subparagraph id="H64A2D2977CD04F6EAEE51AB90D1C37F4"><enum>(E)</enum><text>in appropriate cases, punitive damages in accordance with paragraph (4); and</text></subparagraph><subparagraph id="H539FCE69AF6C49D1A0BA88CF4B6B31F2"><enum>(F)</enum><text>any other relief authorized by section 706(g) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-5">42 U.S.C. 2000e–5(g)</external-xref>) or by section 1977A(b) of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a(b)</external-xref>).</text></subparagraph></paragraph><paragraph id="H0604D2833BFC4CACADD29017F1E664B9"><enum>(3)</enum><header>Attorney’s fees</header><text>In any civil action under this subsection, the court may allow the prevailing party a reasonable attorney’s fee (including expert fees) and other reasonable costs associated with maintaining the action.</text></paragraph><paragraph id="H560D927CF5C3451183822E88DD6D6C24"><enum>(4)</enum><header>Punitive damages</header><text>In awarding punitive damages under paragraph (2)(E), the court shall consider—</text><subparagraph id="H582570D1153744E2814C1B2CB14EF0C4"><enum>(A)</enum><text>the gravity of the unfair labor practice;</text></subparagraph><subparagraph id="HC570BCE1FF7049A69062C4605E8F36D8"><enum>(B)</enum><text>the impact of the unfair labor practice on the charging party, on other persons seeking to exercise rights guaranteed by this Act, and on the public interest; and</text></subparagraph><subparagraph id="H8F71F78F3C7A4026A36841FDEE2FBDB1"><enum>(C)</enum><text>the gross income of the employer.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H87A8D17A3D86435DA69C773C3F8B3BBC"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 10(b) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/160">29 U.S.C. 160(b)</external-xref>) is amended—</text><paragraph id="HB9A7D14199564285A32558FA9258490E"><enum>(1)</enum><text>by striking <quote>six months</quote> and inserting <quote>180 days</quote>; and</text></paragraph><paragraph id="H09D40CC8D5CF42DCB51A7C31D4B7AA49"><enum>(2)</enum><text>by striking <quote>the six-month period</quote> and inserting <quote>the 180-day period</quote>.</text></paragraph></subsection></section><section id="H243EECDEC60A4513B636E77BF4F09EE7"><enum>110.</enum><header>Limitations on the right to strike</header><text display-inline="no-display-inline">Section 13 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/163">29 U.S.C. 163</external-xref>) is amended by striking the period at the end and inserting the following: <quote>: <italic>Provided,</italic> That the duration, scope, frequency, or intermittence of any strike or strikes shall not render such strike or strikes unprotected or prohibited.</quote>.</text></section><section id="HAB5CD78F812340499AB81A60E0415FC3"><enum>111.</enum><header>Fair share agreements permitted</header><text display-inline="no-display-inline">Section 14(b) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/164">29 U.S.C. 164(b)</external-xref>) is amended by striking the period at the end and inserting the following: <quote>: <italic>Provided,</italic> That collective bargaining agreements providing that all employees in a bargaining unit shall contribute fees to a labor organization for the cost of representation, collective bargaining, contract enforcement, and related expenditures as a condition of employment shall be valid and enforceable notwithstanding any State or Territorial law.</quote>.</text></section></title><title id="HE739C52FD0EB4E02A7C76D2DEA9DE066"><enum>II</enum><header>Amendments to the Labor Management Relations Act, 1947, and the Labor-Management Reporting and Disclosure Act of 1959</header><section id="H4F81FBE7F2904C5192AA9AF8B3CC2A27"><enum>201.</enum><header>Conforming amendments to the Labor Management Relations Act, 1947</header><text display-inline="no-display-inline">The Labor Management Relations Act, 1947, is amended—</text><paragraph id="HA01B3F0B7E534E908004547DE200EFF8"><enum>(1)</enum><text>in section 213(a) (<external-xref legal-doc="usc" parsable-cite="usc/29/183">29 U.S.C. 183(a)</external-xref>), by striking <quote>clause (A) of the last sentence of section 8(d) (which is required by clause (3) of such section 8(d)), or within 10 days after the notice under clause (B)</quote> and inserting <quote>section 8(d)(2)(A) of the National Labor Relations Act (which is required by section 8(d)(1)(C) of such Act), or within 10 days after the notice under section 8(d)(2)(B) of such Act</quote>; and</text></paragraph><paragraph id="HAA107ACF00B9415BABA5C6227154CFA6"><enum>(2)</enum><text>by repealing section 303 (<external-xref legal-doc="usc" parsable-cite="usc/29/187">29 U.S.C. 187</external-xref>).</text></paragraph></section><section id="H53AE2C83CA204F29BCC1EF48E5E72F3F"><enum>202.</enum><header>Amendments to the Labor-Management Reporting and Disclosure Act of 1959</header><subsection id="H8D6066AF756A48E7A09053D67F102DCF"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 203(c) of the Labor-Management Reporting and Disclosure Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/29/433">29 U.S.C. 433(c)</external-xref>) is amended by striking the period at the end and inserting the following <quote>: <italic>Provided,</italic> That this subsection shall not exempt from the requirements of this section any arrangement or part of an arrangement in which a party agrees, for an object described in subsection (b)(1), to plan or conduct employee meetings; train supervisors or employer representatives to conduct meetings; coordinate or direct activities of supervisors or employer representatives; establish or facilitate employee committees; identify employees for disciplinary action, reward, or other targeting; or draft or revise employer personnel policies, speeches, presentations, or other written, recorded, or electronic communications to be delivered or disseminated to employees.</quote>.</text></subsection><subsection id="H567C0D0179B74AD49BED88F0932B628F"><enum>(b)</enum><header>Whistleblower protections</header><text>The Labor-Management Reporting and Disclosure Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/29/401">29 U.S.C. 401 et seq.</external-xref>) is further amended—</text><paragraph id="H2C883305106A497EA69374775B5FAE80"><enum>(1)</enum><text>by redesignating section 611 (<external-xref legal-doc="usc" parsable-cite="usc/29/531">29 U.S.C. 531</external-xref>) as section 612; and</text></paragraph><paragraph id="H1625473D9C1A4798AD77E7AC1E9F219A"><enum>(2)</enum><text>by inserting after section 610 (<external-xref legal-doc="usc" parsable-cite="usc/29/530">29 U.S.C. 530</external-xref>), the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE50D5E7BA1DC48CB8935AF9C0E2DF3DE"><section id="H4BF4120569EF46DABD6F0BC2D76F166B"><enum>611.</enum><header>Whistleblower Protections</header><subsection display-inline="no-display-inline" id="H7015C49286124BE2A7065D65F6ADE353"><enum>(a)</enum><header>In general</header><text>No employer or labor organization shall terminate or in any other way discriminate against, or cause to be terminated or discriminated against, any applicant, covered employee, or former covered employee, of the employer or the labor organization by reason of the fact that such applicant, covered employee, or former covered employee does, or the employer or labor organization perceives the employee to do, any of the following:</text><paragraph id="H73A52E4F0C9143E58E6A1E5CC46D11FF"><enum>(1)</enum><text> Provide, cause to be provided, or is about to provide or cause to be provided, information to the labor organization, the employer, the Department of Labor, or any other State, local, or Federal Government authority or law enforcement agency relating to any violation of, or any act or omission that such employee reasonably believes to be a violation of, any provision of this Act. </text></paragraph><paragraph id="H509AF47F7EA54D63AF5C260009E65548"><enum>(2)</enum><text display-inline="yes-display-inline">Testify or plan to testify or otherwise participate in any proceeding resulting from the administration or enforcement of any provision of this Act. </text></paragraph><paragraph id="H7DD26ABE11EA4E17A5A414B49506FDA4"><enum>(3)</enum><text>File, institute, or cause to be filed or instituted, any proceeding under this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD0F4F936E4834AE28C0A6A811165372E"><enum>(4)</enum><text display-inline="yes-display-inline">Assist in any activity described in paragraphs (1) through (3). </text></paragraph><paragraph id="H2694D5BB6AF74CDBB3862DA18E07BC82"><enum>(5)</enum><text display-inline="yes-display-inline">Object to, or refuse to participate in, any activity, policy, practice, or assigned task that such covered employee reasonably believes to be in violation of any provision of this Act.</text></paragraph></subsection><subsection id="HCFED5175BCBD4C0D9177A23573C60B6B"><enum>(b)</enum><header>Definition of covered employee</header><text display-inline="yes-display-inline">For the purposes of this section, the term <term>covered employee</term> means any employee or agent of an employer or labor organization, including any person with management responsibilities on behalf of the employer or labor organization.</text></subsection><subsection id="H4D84B77256394F1083445A78BDB5ACFF"><enum>(c)</enum><header>Procedures and timetables</header><paragraph id="H49C41E17EDA040BDB31166EA6CACD1E2"><enum>(1)</enum><header>Complaint</header><subparagraph id="H2512EE4A1A7148A8A8A9EAA6DA60049A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An applicant, covered employee, or former covered employee who believes that he or she has been terminated or in any other way discriminated against by any person in violation of subsection (a) may file (or have any person file on his or her behalf) a complaint with the Secretary of Labor alleging such violation. Such a complaint must be filed not later than either—</text><clause id="H17659D30BE8141BF968CB78E0F0D38C0"><enum>(i)</enum><text>180 days after the date on which such alleged violation occurs; or</text></clause><clause id="H6AE135D3D23E4E04A974C1E18895A6CF"><enum>(ii)</enum><text display-inline="yes-display-inline">180 days after the date upon which the employee knows or should reasonably have known that such alleged violation in subsection (a) occurred.</text></clause></subparagraph><subparagraph id="HCE34C6B2F40A479D93203887F0BC540F"><enum>(B)</enum><header>Actions of Secretary of Labor</header><text>Upon receipt of such a complaint, the Secretary of Labor shall notify, in writing, the person named in the complaint who is alleged to have committed the violation, of—</text><clause id="H8FA6F16459E249FEA6F81750317FC62C"><enum>(i)</enum><text>the filing of the complaint;</text></clause><clause id="H2159FC3A74264CA3B93B0D330E24B65A"><enum>(ii)</enum><text>the allegations contained in the complaint;</text></clause><clause id="H51AB994CBDFA418295F380B0F1669975"><enum>(iii)</enum><text>the substance of evidence supporting the complaint; and</text></clause><clause id="HC4B0251D02624EB79412312B64994F8F"><enum>(iv)</enum><text>opportunities that will be afforded to such person under paragraph (2).</text></clause></subparagraph></paragraph><paragraph id="H6F75DD6140F046788D060AE567075F1D"><enum>(2)</enum><header>Investigation by Secretary of Labor</header><subparagraph id="H14335A28515B4FD4B6F5D069C1EF7C54"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the date of receipt of a complaint filed under paragraph (1), and after affording the complainant and the person named in the complaint who is alleged to have committed the violation that is the basis for the complaint an opportunity to submit to the Secretary of Labor a written response to the complaint and an opportunity to meet with a representative of the Secretary of Labor to present statements from witnesses, the Secretary of Labor shall—</text><clause id="H186E1E5333C6448389787809A2B6AD7A"><enum>(i)</enum><text>initiate an investigation and determine whether there is reasonable cause to believe that the complaint has merit; and</text></clause><clause id="H0FA1CBDF11354DF98254641FF916677D"><enum>(ii)</enum><text>notify the complainant and the person alleged to have committed the violation of subsection (a), in writing, of such determination.</text></clause></subparagraph><subparagraph commented="no" id="H258A79C224FB4ED783A59456736C5FC6"><enum>(B)</enum><header>Grounds for determination of complaints</header><text>The Secretary of Labor shall dismiss a complaint filed under this subsection, and shall not conduct an investigation otherwise required under subparagraph (A), unless the complainant makes a prima facie showing that any behavior described in paragraphs (1) through (5) of subsection (a) was a contributing factor in the unfavorable personnel action alleged in the complaint.</text></subparagraph></paragraph><paragraph commented="no" id="H4128F8CA3DD54C64A02BC34DE96F3BC6"><enum>(3)</enum><header>Burdens of proof</header><subparagraph commented="no" id="H4BF297B660D54FAEB63ABEDA18089D8E"><enum>(A)</enum><header>Criteria for determination</header><text>In making a determination or adjudicating a complaint pursuant to this subsection, the Secretary, an administrative law judge, or a court may determine that a violation of subsection (a) has occurred only if the complainant demonstrates that any conduct described in subsection (a) with respect to the complainant was a contributing factor in the adverse action alleged in the complaint.</text></subparagraph><subparagraph commented="no" id="H37D11EE9AD5C411390AA920322B9C003"><enum>(B)</enum><header>Prohibition</header><text>Notwithstanding subparagraph (A), a decision or order that is favorable to the complainant shall not be issued in any administrative or judicial action pursuant to this subsection if the respondent demonstrates by clear and convincing evidence that the respondent would have taken the same adverse action in the absence of such conduct.</text></subparagraph><subparagraph commented="no" id="H204E2062E7904DB2AA114A274BD20B63"><enum>(C)</enum><header>Notice of relief available</header><text>If the Secretary of Labor concludes that there is reasonable cause to believe that a violation of subsection (a) has occurred, the Secretary of Labor shall, together with the notice under paragraph (2)(A)(ii), issue a preliminary order providing the relief prescribed by paragraph (4)(B).</text></subparagraph><subparagraph commented="no" id="H424F3381BB3E47318FF9268340296B6C"><enum>(D)</enum><header>Request for hearing</header><text>Not later than 30 days after the date of receipt of notification of a determination of the Secretary of Labor under this paragraph, either the person alleged to have committed the violation or the complainant may file objections to the findings or preliminary order, or both, and request a hearing on the record. The filing of such objections shall not operate to stay any reinstatement remedy contained in the preliminary order. Any such hearing shall be conducted expeditiously, and if a hearing is not requested in such 30-day period, the preliminary order shall be deemed a final order that is not subject to judicial review.</text></subparagraph><subparagraph commented="no" id="HDA1142BC85A94EEE9C3BB1394C19F594"><enum>(E)</enum><header>Procedures</header><clause commented="no" id="H0FFA0089E62D40F0B545E7D041AFE7D4"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">A hearing requested under this paragraph shall be conducted expeditiously and in accordance with rules established by the Secretary for hearings conducted by administrative law judges.</text></clause><clause commented="no" id="H1FE66EFA2A8E4903B1E6AA3EAA1EC84C"><enum>(ii)</enum><header>Subpoenas; production of evidence</header><text> In conducting any such hearing, the administrative law judge may issue subpoenas. The respondent or complainant may request the issuance of subpoenas that require the deposition of, or the attendance and testimony of, witnesses and the production of any evidence (including any books, papers, documents, or recordings) relating to the matter under consideration.</text></clause></subparagraph></paragraph><paragraph id="HC9727794FC5447CD84132619AF33D850"><enum>(4)</enum><header>Issuance of final orders; review procedures</header><subparagraph id="H8FCF8BD6CD8948BDB6B1379266C9729B"><enum>(A)</enum><header>Timing</header><text>Not later than 120 days after the date of conclusion of any hearing under paragraph (2), the Secretary of Labor shall issue a final order providing the relief prescribed by this paragraph or denying the complaint. At any time before issuance of a final order, a proceeding under this subsection may be terminated on the basis of a settlement agreement entered into by the Secretary of Labor, the complainant, and the person alleged to have committed the violation.</text></subparagraph><subparagraph id="HC40A8F9BC692455CBEADE1DDF33C2F40"><enum>(B)</enum><header>Available relief</header><clause id="HA685DE4AB560435D90FA566B0C2E5334"><enum>(i)</enum><header>Order of Secretary of Labor</header><text>If, in response to a complaint filed under paragraph (1), the Secretary of Labor determines that a violation of subsection (a) has occurred, the Secretary of Labor shall order the person who committed such violation—</text><subclause id="HD2B164D930F648EAA120415D15A794E8"><enum>(I)</enum><text>to take affirmative action to abate the violation;</text></subclause><subclause id="H422555A2E2DA407ABDC320D8598EA06F"><enum>(II)</enum><text>to reinstate the complainant to his or her former position, together with compensation (including back pay with interest) and restore the terms, conditions, and privileges associated with his or her employment; </text></subclause><subclause id="H4FDAECE797A6452EBC27DCCB08B4BB30"><enum>(III)</enum><text>to provide compensatory damages to the complainant; and</text></subclause><subclause id="H936DDD78A2F746D28C8FFD78083031F3"><enum>(IV)</enum><text display-inline="yes-display-inline">expungement of all warnings, reprimands, or derogatory references that have been placed in paper or electronic records or databases of any type relating to the actions by the complainant that gave rise to the unfavorable personnel action, and, at the complainant's direction, transmission of a copy of the decision on the complaint to any person whom the complainant reasonably believes may have received such unfavorable information.</text></subclause></clause><clause id="HCF546E5BF4E84F9F853682ADFF4F0EC0"><enum>(ii)</enum><header>Costs and expenses</header><text>If an order is issued under clause (i), the Secretary of Labor, at the request of the complainant, shall assess against the person against whom the order is issued, a sum equal to the aggregate amount of all costs and expenses (including attorney fees and expert witness fees) reasonably incurred, as determined by the Secretary of Labor, by the complainant for, or in connection with, the bringing of the complaint upon which the order was issued.</text></clause></subparagraph><subparagraph id="H69CCCA11E3924F7F8A4C8C61A1A9DC14"><enum>(C)</enum><header>Frivolous claims</header><text>If the Secretary of Labor finds that a complaint under paragraph (1) is frivolous or has been brought in bad faith, the Secretary of Labor may award to the prevailing employer or labor organization a reasonable attorney fee, not exceeding $1,000, to be paid by the complainant.</text></subparagraph><subparagraph id="H09305536EA3B4229A3FA6C6870080BF6"><enum>(D)</enum><header>De novo review</header><clause id="H7B1F97537A054EB0A6B6EA3992ACBE86"><enum>(i)</enum><header>Failure of the secretary to act</header><text>If the Secretary of Labor has not issued a final order within 270 days after the date of filing of a complaint under this subsection, or within 90 days after the date of receipt of a written determination, the complainant may bring an action at law or equity for de novo review in the appropriate district court of the United States having jurisdiction, which shall have jurisdiction over such an action without regard to the amount in controversy, and which action shall, at the request of either party to such action, be tried by the court with a jury.</text></clause><clause id="H68ADBB040A16440BA084985654FB2363"><enum>(ii)</enum><header>Procedures</header><text>A proceeding under clause (i) shall be governed by the same legal burdens of proof specified in paragraph (3). The court shall have jurisdiction to grant all relief necessary to make the employee whole, including injunctive relief and compensatory damages, including—</text><subclause id="H56B151A1CC944A2DB7AC6E16C2679C8C"><enum>(I)</enum><text>reinstatement with the same seniority status that the employee would have had, but for the discharge or discrimination;</text></subclause><subclause id="HBFCA77F0FA38414DA5E026B70177B753"><enum>(II)</enum><text>the amount of back pay, with interest; </text></subclause><subclause id="HBA9AF8A0A8CD49A482E510A3CA7A8C5A"><enum>(III)</enum><text display-inline="yes-display-inline">compensation for any special damages sustained as a result of the discharge or discrimination, including litigation costs, expert witness fees, and reasonable attorney fees; and</text></subclause><subclause id="HCCE17B87652C43D28CA78B79A14B8433"><enum>(IV)</enum><text display-inline="yes-display-inline">expungement of all warnings, reprimands, or derogatory references that have been placed in paper or electronic records or databases of any type relating to the actions by the complainant that gave rise to the unfavorable personnel action, and, at the complainant's direction, transmission of a copy of the decision on the complaint to any person whom the complainant reasonably believes may have received such unfavorable information.</text></subclause></clause></subparagraph><subparagraph id="H24B288D886E844ACAD5CC672A2F7C81E"><enum>(E)</enum><header>Other appeals</header><text>Unless the complainant brings an action under subparagraph (D), any person adversely affected or aggrieved by a final order issued under subparagraph (A) may file a petition for review of the order in the United States Court of Appeals for the circuit in which the violation with respect to which the order was issued, allegedly occurred or the circuit in which the complainant resided on the date of such violation, not later than 60 days after the date of the issuance of the final order of the Secretary of Labor under subparagraph (A). Review shall conform to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code. The commencement of proceedings under this subparagraph shall not, unless ordered by the court, operate as a stay of the order. An order of the Secretary of Labor with respect to which review could have been obtained under this subparagraph shall not be subject to judicial review in any criminal or other civil proceeding.</text></subparagraph></paragraph><paragraph id="H630D271C1A724717B0E8B488D346100E"><enum>(5)</enum><header>Failure to comply with order</header><subparagraph id="HFB67C21711544825A1C52691895A4184"><enum>(A)</enum><header>Actions by the Secretary</header><text>If any person has failed to comply with a final order issued under paragraph (4), the Secretary of Labor may file a civil action in the United States district court for the district in which the violation was found to have occurred, or in the United States district court for the District of Columbia, to enforce such order. In actions brought under this paragraph, the district courts shall have jurisdiction to grant all appropriate relief including injunctive relief, compensatory and punitive damages.</text></subparagraph><subparagraph id="H37B91B176FC54CD0A28B932D853E46A1"><enum>(B)</enum><header>Civil actions to compel compliance</header><text>A person on whose behalf an order was issued under paragraph (4) may commence a civil action against the person to whom such order was issued to require compliance with such order. The appropriate United States district court shall have jurisdiction, without regard to the amount in controversy or the citizenship of the parties, to enforce such order.</text></subparagraph><subparagraph id="H39D37B860AB1401FA8D116C8298E0112"><enum>(C)</enum><header>Award of costs authorized</header><text>The court, in issuing any final order under this paragraph, may award costs of litigation (including reasonable attorney and expert witness fees) to any party, whenever the court determines such award is appropriate.</text></subparagraph><subparagraph id="HE93FD939D4DE42A2A35B07228154389A"><enum>(D)</enum><header>Mandamus proceedings</header><text>Any nondiscretionary duty imposed by this section shall be enforceable in a mandamus proceeding brought under section 1361 of title 28, United States Code.</text></subparagraph></paragraph></subsection><subsection id="H49CD79256F554B88952385CAA025DABC"><enum>(d)</enum><header>Unenforceability of certain agreements</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the rights and remedies provided for in this section may not be waived by any agreement, policy, form, or condition of employment, including by any predispute arbitration agreement.</text></subsection><subsection id="H8CC7692918DE4BB1BB69A1DDDF3250F2"><enum>(e)</enum><header>Savings</header><text>Nothing in this section shall be construed to diminish the rights, privileges, or remedies of any employee who exercises rights under any Federal or State law or common law, or under any collective bargaining agreement.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA479CF83135D4D2991066F1DB41343B4"><enum>(c)</enum><header>Public availability of information</header><text display-inline="yes-display-inline">Section 203(b) of the Labor-Management Reporting and Disclosure Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/29/433">29 U.S.C. 433(b)</external-xref>) is amended in the matter following paragraph (2) by striking the period at the end and inserting <quote>and shall make such information available to the public in a readily accessible and searchable electronic format, and through a secure software application for use on an electronic device.</quote>.</text></subsection></section></title><title id="H001F41DADA8244E1847AA8B4F8A2591D"><enum>III</enum><header>Other matters</header><section id="H259E85F217CA4D2EA0D85D39473290DE"><enum>301.</enum><header>Electronic voting in Union elections</header><subsection id="HCD9F5BCFF7664A7EB802F375D2EB27E9"><enum>(a)</enum><header>In general</header><paragraph id="H50CACAACA87245D0A751BA226C6CF9E8"><enum>(1)</enum><header>Electronic voting system</header><text>Notwithstanding any other provision of law, subject to the provisions of this section, not later than 1 year after the date of the enactment of this Act, the National Labor Relations Board shall implement a system and procedures to conduct representation elections remotely using an electronic voting system. </text></paragraph><paragraph id="HF2B3A62A90FC43599BB02FA71E86D8F1"><enum>(2)</enum><header>Procedures</header><text>The procedures under paragraph (1) shall ensure that each employee voting in a representation election may choose to cast a vote using either an internet voting system or a telephone voting system.</text></paragraph></subsection><subsection id="HA46228F5CA174BCCB209993B339B33BC"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, and in each subsequent report under section 3(c) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/153">29 U.S.C. 153(c)</external-xref>), the Board shall submit to Congress a report containing a description of the following:</text><paragraph id="HFA664CA991524A2F9E854D63752E5394"><enum>(1)</enum><text>For each representation petition under section 9 of the National Labor Relations Act filed—</text><subparagraph id="H1B7C53DF3F75431A9B00F37661417E81"><enum>(A)</enum><text>the case name and case number;</text></subparagraph><subparagraph id="H4CB8A2E56A51410E9CC1B6FDFA81A80D"><enum>(B)</enum><text>the number of days between the petition and the election;</text></subparagraph><subparagraph id="HF216F36372A34B9999037C605DA9A8D4"><enum>(C)</enum><text>the number of days between the stipulation or direction of election and the election;</text></subparagraph><subparagraph id="HA6F7FF90FCD74ADD9C5A7252E5EEA680"><enum>(D)</enum><text>the method of the election;</text></subparagraph><subparagraph id="HB9DB273D5A854A04A69FCBFB99C4E06F"><enum>(E)</enum><text>the results of the election; and </text></subparagraph><subparagraph id="HCAAB648F9DDD413894E0ED326A674932"><enum>(F)</enum><text>the number of eligible voters, the number of voters participating in the election, and the method by which each of the voters submitted their vote.</text></subparagraph></paragraph><paragraph id="H86AF0BA4C6444F8BA2FBD0CEFEC215F1"><enum>(2)</enum><text>The total cost of conducting all elections the Board conducted through the system and procedures required by subsection (a).</text></paragraph></subsection><subsection display-inline="no-display-inline" id="H80B50E741DF74E4EA48EC596D5CE4F8E"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1A93D0383E5C486BAAFFAA46ACE81B3B"><enum>(1)</enum><header>Electronic voting system</header><text>The term <term>electronic voting system</term>—</text><subparagraph id="HAFFF2B775D614C0D8FFA928AF04A9FF8"><enum>(A)</enum><text>includes an internet voting system and a telephone voting system; and</text></subparagraph><subparagraph id="H7E8297C7D4D649E0B976DEF7ABFB8310"><enum>(B)</enum><text>does not include machines used for casting votes at a polling site or an electronic tabulation system where votes are cast non-electronically but counted electronically (such as a punch card or optical scanning system). </text></subparagraph></paragraph><paragraph id="HDB6EB0A24AD7489689A9CE387FD6F6BD"><enum>(2)</enum><header>Internet voting system</header><text>The term <term>internet voting system</term> means an internet-based voting system that allows a participant to cast a ballot remotely using a personal computer or other mobile electronic device that is connected to the internet. </text></paragraph><paragraph id="HC69DE05520894F5B919FF8FEACD96ED6"><enum>(3)</enum><header>Telephone voting system</header><text>The term <term>telephone voting system</term> means a voting system in which participants may cast a vote remotely using a telephone. </text></paragraph><paragraph id="H91714EABE9DC44D5B41DB5A17AF94700"><enum>(4)</enum><header>Remotely</header><text display-inline="yes-display-inline">The term <term>remotely</term>, used with respect to voting in a representation election, means a vote may be cast at any site chosen by a participant in such election. </text></paragraph><paragraph id="HC2606A6F6F424D3BB0F92EA4B218D30D"><enum>(5)</enum><header>Representation election</header><text display-inline="yes-display-inline">The term <term>representation election</term> means a representation election under section 9 of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159</external-xref>). </text></paragraph></subsection></section><section id="H8BB6DDCA64734E9691E62D0925227382"><enum>302.</enum><header>GAO report on sectoral bargaining</header><subsection id="H8041791312024A1C9F8219A9826BD4EC"><enum>(a)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Comptroller General shall conduct a review of collective bargaining at the sectoral level in a geographically diverse set of countries where sectoral bargaining is facilitated and prepare and submit to Congress a report with respect to such countries that—</text><paragraph id="H92D993B2C902434C95E6F499D92336CA"><enum>(1)</enum><text>identifies, analyzes, and compares—</text><subparagraph id="HFF86B270064E45D99A61CC834E3EBB4D"><enum>(A)</enum><text display-inline="yes-display-inline">the laws and policies governing or related to collective bargaining at the sectoral level;</text></subparagraph><subparagraph id="H0D3A44F751E64A988BF551677F6FFAE3"><enum>(B)</enum><text>the administrative systems facilitating such bargaining; and</text></subparagraph><subparagraph id="HD1856177741343F393CB2544B5C9B384"><enum>(C)</enum><text>the procedures involved in sectoral bargaining;</text></subparagraph></paragraph><paragraph id="HA86607BE367B488ABC2DAB697EF4F81C"><enum>(2)</enum><text>to the extent practicable, consider reported effects of the policies and procedures described in paragraph (1) on—</text><subparagraph id="H923EE060E7524A6EB768AE0F1222415B"><enum>(A)</enum><text>the wages and compensation of employees;</text></subparagraph><subparagraph id="HBC45A6D0E26F46CEAA79950B311DDD76"><enum>(B)</enum><text>the number of full-time and part-time employees;</text></subparagraph><subparagraph id="HBF15334F7B69488A9E93C85B1EA8653A"><enum>(C)</enum><text>prices, sales, and revenues;</text></subparagraph><subparagraph id="HD6DC2CE6D3C4427684D3CB17598FB120"><enum>(D)</enum><text>employee turnover and retention;</text></subparagraph><subparagraph id="H4EB26A94BC45464F8BFA71AD609D0AF5"><enum>(E)</enum><text>hiring and training costs;</text></subparagraph><subparagraph id="HA493B0A43AB44098BD00F0B590F27D66"><enum>(F)</enum><text>productivity and absenteeism; and</text></subparagraph><subparagraph id="HF88069F4B52544609C7DFC01D6BFB892"><enum>(G)</enum><text>the development of emerging industries, including those that engage their workforces through technology; and</text></subparagraph></paragraph><paragraph id="H6CF1F97DFEE24E1B8E784E58AECBE0D2"><enum>(3)</enum><text>describes the methodology used to generate the information in the report.</text></paragraph></subsection></section><section id="HEE1A510E94CF49759DADA79DC0141F4B"><enum>303.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the application thereof to any person or circumstance is held invalid, the remainder of this Act, or the application of that provision to persons or circumstances other than those as to which it is held invalid, is not affected thereby.</text></section><section id="H68D7AC5E61F140FEAE871938F734256E"><enum>304.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out the provisions of this Act and the amendments made by this Act.</text></section><section id="HFEC4EBA83133418391E1E739647FCF3A"><enum>305.</enum><header>Rule of Construction</header><text display-inline="no-display-inline">The amendments made under this Act shall not be construed to amend section 274A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref>). </text></section><section id="H503D3C2BD2E849D2840F9A115EE628F0"><enum>306.</enum><header>Rule of Construction</header><text display-inline="no-display-inline">The amendments made by this Act shall not be construed to affect the jurisdictional standards of the National Labor Relations Board, including any standards that measure the size of a business with respect to revenues, that are used to determine whether an industry is affecting commerce for purposes of determining coverage under the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>).</text></section><section id="HFB49554667BE4BD9A02323CBEFCE47B3"><enum>307.</enum><header>Rule of Construction</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to affect the privacy of employees with respect to voter lists provided to labor organizations by employers pursuant to elections directed by the Board. </text></section><section id="H5E02F229FBBD4DEC9E2D5F701A234982"><enum>308.</enum><header>Rule of Construction</header><text display-inline="no-display-inline"> The amendments made under this Act shall not be construed to affect the definitions of <quote>employer</quote> or <quote>employee</quote> under the laws of any State that govern the wages, work hours, workers’ compensation, or unemployment insurance of employees. </text></section><section id="HA883A81813CF4CB8A381F9D4E161AFF0"><enum>309.</enum><header>GAO Report</header><subsection id="HC6389C5A87344A11A138246E36C0C0C8"><enum>(a)</enum><header>In General</header><text>The Comptroller General of the United States shall one year after the date of enactment of this Act commence a study on the impact of section 101(a) and section 101(b) of this Act regarding—</text><paragraph id="HF8EF319147934BDFA8C4DC9BF33843EE"><enum>(1)</enum><text>the effect on coverage of employees under of the National Labor Relations Act, and the impact from such change in coverage, on their capacity in various sectors to form unions and collectively bargain as a means to improve wages, benefits, workplace safety, and other working conditions; and</text></paragraph><paragraph id="H58A6DDC1C71441DEBD371F5376B1A604"><enum>(2)</enum><text>the effect on employers and other enterprises regarding the right of employees to organize and collectively bargain over wages, benefits, workplace safety, and other working conditions in such sectors.</text></paragraph></subsection><subsection id="H34CBA01413B149C489E6CC78D4974EA2"><enum>(b)</enum><header>Factors</header><text>Such study shall identify, compare, and analyze impacts from changes implicated by section 101(a) and section 101(b) on—</text><paragraph id="H1794CCE6DDA743449F624E5623E39FF8"><enum>(1)</enum><text>flexibility for employees with respect to hours, shifts, assignments and working arrangements;</text></paragraph><paragraph id="H810F51EB15484180BE81D364E94744F9"><enum>(2)</enum><text>rates of compensation, health care, and employee benefits;</text></paragraph><paragraph id="H18CE9499B8E2422DA0596ED3E7C26462"><enum>(3)</enum><text>resolution of grievances and disputes, including employers’ ability to terminate and employees’ right to due process;</text></paragraph><paragraph id="HC72C06CEE6EE4652AF90F09B3D3615D5"><enum>(4)</enum><text>use of technology or algorithms, including the adoption of new technology and algorithms; and</text></paragraph><paragraph id="HA686671C6DFB4AECA881CD3D720D5AED"><enum>(5)</enum><text>workplace safety and health.</text></paragraph></subsection><subsection id="H45666BA0C8A14F719090EB1EA4CCC5E5"><enum>(c)</enum><header>Stakeholder input</header><text>In preparing the report, the Comptroller General of the United States shall gather information from impacted stakeholders, including various business enterprises and labor organizations. In developing a list of stakeholders, the Comptroller General of the United States shall consult with the House Committee on Education and Workforce and the Senate Committee on Health, Education, Labor, and Pensions.</text></subsection><subsection id="H870008E8CEB44BB39202EDFBFEFD5615"><enum>(d)</enum><header>Congressional report</header><text>Six months after the commencement of the study, the Comptroller General of the United States shall transmit the findings and report to the Committee on Education and Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate, and consistent with the policies of the Comptroller General of the United States, make the findings and report available to the public.</text></subsection><subsection id="HBC1797BB9C034A0F9630841880B38AE0"><enum>(e)</enum><header>Presidential consideration</header><text>The President, in consultation with the Department of Labor and other agencies as the President deems appropriate, shall, subsequent to the issuance of such report, consider such findings, and within 60 days may recommend that the House of Representatives and the Senate modify section 101(a) or section 101(b), or both or make no recommendations.</text></subsection><subsection id="H06EE33B123FA4C6B8CEDAB8B9AA90321"><enum>(f)</enum><header>Sense of Congress</header><text>It is the sense of Congress that Congress shall consider whether to accept, reject, or modify any recommendations received under (e), as it deems appropriate.</text></subsection></section></title></legis-body></bill>
