R. 2057</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250311">March 11, 2025</action-date><action-desc><sponsor name-id="H001093">Mrs. Houchin</sponsor> (for herself, <cosponsor name-id="O000086">Mr. Owens</cosponsor>, and <cosponsor name-id="B001314">Mr. Bean of Florida</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To affirm and protect the First Amendment rights of students and student organizations at public institutions of higher education.</official-title></form><legis-body id="H808281B16824456D9A128925C5DCDED8" style="OLC"><section id="H384A3C0F53444C4AA80DA3DC2E47D681" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Students Bill of Rights Act of 2025</short-title></quote>.</text></section><section id="HBB1022F7B821474490221574050CC298"><enum>2.</enum><header>Students Bill of Rights</header><text display-inline="no-display-inline">The Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>) is amended by inserting after section 112 the following new section:</text><quoted-block style="OLC" id="H91E74200DBC549FA874F144882DB59A6" display-inline="no-display-inline"><section id="HFBF4CBE76D8A4A848DC17854E4A210D9"><enum>112A.</enum><header>Students Bill of Rights to further protect speech and association</header><subsection id="HBB834AE6D93849988F0C331B60DEB0CF"><enum>(a)</enum><header>Protected rights</header><text display-inline="yes-display-inline">A covered public institution that receives funds under this Act, including through participation in a program authorized under title IV, shall comply with the following requirements:</text><paragraph id="H28E39AB5D20B40588C3ABB4EEECC2A76"><enum>(1)</enum><header>Recognized student organizations</header><text display-inline="yes-display-inline">A covered public institution that has recognized student organizations shall comply with the following requirements:</text><subparagraph id="H2D57F0A5A9E44681940F6189F198127D"><enum>(A)</enum><header>Faculty advisors</header><text display-inline="yes-display-inline">A covered public institution may not deny recognition to a student organization solely because the organization is unable to obtain a faculty advisor or sponsor, provided that the organization meets each of the other institutional requirements for such recognition. The institution shall ensure that any policy or practice related to the recognition of a student organization—</text><clause id="HAB9B3C864E7D4205AF33205882701F45"><enum>(i)</enum><text>does not require a faculty or staff member of the institution to serve as faculty advisor or to otherwise participate in, support, or sponsor the organization; or</text></clause><clause id="HBA54C50CC93842CDBF8E2875B3929051"><enum>(ii)</enum><text display-inline="yes-display-inline">if the institution does have a requirement that a faculty or staff member serve as described in <internal-xref idref="HAB9B3C864E7D4205AF33205882701F45" legis-path="112A.(a)(1)(A)(i)">clause (i)</internal-xref> as a condition for recognition of the student organization, and an organization that meets each of the other institutional requirements for such recognition is unable to secure such a faculty or staff member, provides for an alternative to such requirement, which may include waiver of such requirement or the institution assigning a faculty or staff member to such organization.</text></clause></subparagraph><subparagraph id="HFE4A1CF6E33F4899A982E4DE8090E64D" commented="no"><enum>(B)</enum><header>Affiliation</header><text display-inline="yes-display-inline">A covered public institution may not deny recognition to a student organization solely because of the organization’s affiliation with, or status as a chapter of, a national or other organization.</text></subparagraph><subparagraph id="H8F9A28BAF82F430C8A40B28DF2E5EDC5" commented="no"><enum>(C)</enum><header>Appeal options for recognition</header><text display-inline="yes-display-inline">A covered public institution shall provide an appeals process by which a student organization that has been denied recognition by the institution may appeal to an institutional appellate entity for reconsideration. The institution shall ensure that such appellate entity did not participate in any prior proceeding related to the denial of recognition to such organization.</text></subparagraph></paragraph><paragraph id="H1590C36569824687B1A010FED621F500"><enum>(2)</enum><header>Distribution of funds to student organizations</header><text display-inline="yes-display-inline">A covered public institution that collects a mandatory fee from students for the costs of student activities and events and provides funds generated from such student fees to one or more recognized student organizations of the institution shall—</text><subparagraph id="HCCDC5078828E491D8CCC278DFE0E1650"><enum>(A)</enum><text>establish and make publicly available clear, objective, content- and viewpoint-neutral, and exhaustive standards to be used by the institution to determine—</text><clause id="HD9266C7B188346C29FAC9F3A440F22A1"><enum>(i)</enum><text>the total amount of funds made available for allocations to the recognized student organizations; and</text></clause><clause id="H62929D93CB834186B6E1784F35D1729C"><enum>(ii)</enum><text>the allocations of such total amount to individual recognized student organizations; </text></clause></subparagraph><subparagraph id="HF03A622D50934FD6A19E109143B4422E"><enum>(B)</enum><text>ensure that allocations are made to the recognized student organizations in accordance with the standards established pursuant to <internal-xref idref="HCCDC5078828E491D8CCC278DFE0E1650" legis-path="112A.(a)(2)(A)">subparagraph (A)</internal-xref>;</text></subparagraph><subparagraph id="H2CF263C94C3D4C629B820F876FE491EC" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">upon the request of a recognized student organization that has been denied all or a portion of an allocation described in <internal-xref idref="HF03A622D50934FD6A19E109143B4422E" legis-path="112A.(a)(2)(B)">subparagraph (B)</internal-xref>, provide to the organization, in writing (which may include electronic communication) and in a timely manner, the specific reasons for such denial and information of the appeals process described in <internal-xref idref="H786661DB0C0E42D1B04C54B4BC346CF1" legis-path="112A.(a)(2)(D)">subparagraph (D)</internal-xref>; </text></subparagraph><subparagraph id="H786661DB0C0E42D1B04C54B4BC346CF1" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">provide an appeals process by which a recognized student organization that has been denied all or a portion of an allocation described in <internal-xref idref="HF03A622D50934FD6A19E109143B4422E" legis-path="112A.(a)(2)(B)">subparagraph (B)</internal-xref> may appeal to an institutional appellate entity for reconsideration, and the institution shall ensure that such appellate entity did not participate in any prior proceeding related to such allocation; and</text></subparagraph><subparagraph id="H2C56D6BA3FAB4258B647D9C66D57C455"><enum>(E)</enum><text>have in place policies and procedures to disqualify an individual or entity from participating in a determination described in <internal-xref idref="HCCDC5078828E491D8CCC278DFE0E1650" legis-path="112A.(a)(2)(A)">subparagraph (A)</internal-xref> or (B), or an appeal described in <internal-xref idref="H786661DB0C0E42D1B04C54B4BC346CF1" legis-path="112A.(a)(2)(D)">subparagraph (D)</internal-xref>, if such individual or entity has failed to apply the standards for determinations established by the institution pursuant to this paragraph.</text></subparagraph></paragraph><paragraph id="H2480CB66F8604AADBBA8E53A25AEA9BE"><enum>(3)</enum><header>Assessment of security fees for events</header><text display-inline="yes-display-inline">A covered public institution shall establish and make publicly available clear, objective, content- and viewpoint-neutral, and exhaustive standards to be used by the institution to—</text><subparagraph id="H711B0EDAA24E4BF790F0D003015D0C3C"><enum>(A)</enum><text display-inline="yes-display-inline">determine the amount of any security fee for an event or activity organized by a student or student organization; and</text></subparagraph><subparagraph id="H17C7854B42B74629BD5D3D1CF10C80A5"><enum>(B)</enum><text>ensure that a determination of such an amount may not be based, in whole or in part, on—</text><clause id="H61D213AF2DE14F3085675243CDEAB293"><enum>(i)</enum><text display-inline="yes-display-inline">the content of expression or viewpoint of the student or student organization;</text></clause><clause id="H19950FD55BE74138A87E1BAC0C8D3966"><enum>(ii)</enum><text>the purpose or content of expression of the event or activity organized by the student or student organization;</text></clause><clause id="HC26FF84F9C954E7081CD68BB8CF809EE"><enum>(iii)</enum><text>the content of expression or viewpoint of an invited guest of the student or student organization; or</text></clause><clause id="H46A08F8DF1224658A52F4F14A95D5E83"><enum>(iv)</enum><text>an anticipated reaction by students or the public to the event or activity due to the purpose, content of expression, or viewpoint expressed at the event or activity by the student, student organization, or an invited guest. </text></clause></subparagraph></paragraph><paragraph id="H7F75D2420E9746718D42ABCECA658F00"><enum>(4)</enum><header>Protections for invited guests and speakers</header><text display-inline="yes-display-inline">A covered public institution shall establish and make publicly available clear, objective, content- and viewpoint-neutral, and exhaustive standards to be used by the institution related to the safety and protection of speakers and guests who are invited to the institution by a student or student organization.</text></paragraph></subsection><subsection id="H47B30A3140544C4282BBF1BF1F1C5290"><enum>(b)</enum><header>Enforcement</header><paragraph id="H2FAD71195CD24D34854781B77A335600"><enum>(1)</enum><header>Cause of action</header><subparagraph id="H877EAC2DDE77401E92A32100B511BBF8"><enum>(A)</enum><header>Civil action</header><text>Whoever is harmed by a covered public institution by the maintenance of a policy or practice of the institution that is in violation of a requirement described in <internal-xref idref="HBB834AE6D93849988F0C331B60DEB0CF" legis-path="112A.(a)">subsection (a)</internal-xref> may bring a civil action in a Federal court for appropriate relief. </text></subparagraph><subparagraph id="H50EDF55E6AD44246B76BED234660CD2A"><enum>(B)</enum><header>Appropriate relief</header><text>For the purposes of this paragraph, appropriate relief includes—</text><clause id="H84F5AFA769CA427B8D945EA46D6F4615" commented="no"><enum>(i)</enum><text>a temporary or permanent injunction; and</text></clause><clause id="HF0D34C30E3FF4238ADF379B35AA365D2"><enum>(ii)</enum><text>awarding a prevailing plaintiff—</text><subclause id="H3289573592404A6F96B5672BEE17473F"><enum>(I)</enum><text>compensatory damages; </text></subclause><subclause id="H89990E9E6AB9406991C56E7CE22C4B77"><enum>(II)</enum><text>reasonable court costs; and</text></subclause><subclause id="HC6DB70EA0E484C16B9C4BCF050036332"><enum>(III)</enum><text>reasonable attorney fees.</text></subclause></clause></subparagraph><subparagraph id="H9145FD6D0C4240FAB891B1F0973B63D8"><enum>(C)</enum><header>Statute of limitations</header><text display-inline="yes-display-inline">A civil action under this paragraph may not be commenced later than 2 years after the cause of action accrues. </text></subparagraph></paragraph><paragraph id="HC18F787866E142DC80BD19B3909118BE" commented="no"><enum>(2)</enum><header>In general</header><text>In the case of a court’s non-default, final judgment in a civil action brought under <internal-xref idref="H2FAD71195CD24D34854781B77A335600" legis-path="112A.(b)(1)">paragraph (1) </internal-xref>that a covered public institution is in violation of a requirement described in <internal-xref idref="HBB834AE6D93849988F0C331B60DEB0CF" legis-path="112A.(a)">subsection (a)</internal-xref>, such covered public institution shall—</text><subparagraph id="H58089F98BB324D8A94880A220D3D420A" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 7 days after the date on which the court makes such a non-default, final judgment, notify the Secretary of such judgment and submit to the Secretary a copy of the non-default, final judgment; and </text></subparagraph><subparagraph id="H6E21BE04857449ECA16F919C6A1EAAC7" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 30 days after the date on which the court makes such a non-default, final judgment, submit to the Secretary a report that—</text><clause id="H87BF6B31353A4AF09C62FEBF6DFFC070" commented="no"><enum>(i)</enum><text>certifies that the standard, policy, practice, or procedure that is in violation of the requirement described in <internal-xref idref="HBB834AE6D93849988F0C331B60DEB0CF" legis-path="112A.(a)">subsection (a)</internal-xref> is no longer in use; and</text></clause><clause id="H9842A397E8994E8EB7439F4C1D43D428" commented="no"><enum>(ii)</enum><text>provides evidence to support such certification.</text></clause></subparagraph></paragraph><paragraph id="H7DC3CB9D53114E4C943311941DCC1F4C"><enum>(3)</enum><header>Revocation of eligibility</header><text display-inline="yes-display-inline">In the case of a covered public institution that does not notify the Secretary as required under <internal-xref idref="H58089F98BB324D8A94880A220D3D420A" legis-path="112A.(b)(2)(A)">paragraph (2)(A)</internal-xref> or submit the report required under <internal-xref idref="H6E21BE04857449ECA16F919C6A1EAAC7" legis-path="112A.(b)(2)(B)">paragraph (2)(B)</internal-xref>, the Secretary shall revoke the eligibility of such institution to receive funds under this Act, including through participation in a program authorized under title IV, for each award year following the conclusion of the award year in which a court made a non-default, final judgment in a civil action brought under <internal-xref idref="H2FAD71195CD24D34854781B77A335600" legis-path="112A.(b)(1)">paragraph (1)</internal-xref> that the institution is in violation of a requirement described in <internal-xref idref="HBB834AE6D93849988F0C331B60DEB0CF" legis-path="112A.(a)">subsection (a)</internal-xref>. </text></paragraph><paragraph id="H50A4381625634596B070DEB440B384BD"><enum>(4)</enum><header>Restoration of eligibility</header><subparagraph id="HA0BAF1E02DDC4FC18E948053AB601F94"><enum>(A)</enum><header>In general</header><text>A covered public institution that loses eligibility under <internal-xref idref="H7DC3CB9D53114E4C943311941DCC1F4C" legis-path="112A.(b)(3)">paragraph (3)</internal-xref> to receive funds under this Act may seek to restore such eligibility by submitting to the Secretary the report described in <internal-xref idref="H6E21BE04857449ECA16F919C6A1EAAC7" legis-path="112A.(b)(2)(B)">paragraph (2)(B)</internal-xref>.</text></subparagraph><subparagraph id="H707D83373C504B088A652262C8B71F50"><enum>(B)</enum><header>Determination by the Secretary</header><text>Not later than 90 days after a covered public institution submits a report under <internal-xref idref="HA0BAF1E02DDC4FC18E948053AB601F94" legis-path="112A.(b)(4)(A)">subparagraph (A)</internal-xref>, the Secretary shall review such report and make a determination with respect to whether such report contained sufficient evidence to demonstrate that such institution is no longer in violation of a requirement described in <internal-xref idref="HBB834AE6D93849988F0C331B60DEB0CF" legis-path="112A.(a)">subsection (a)</internal-xref>.</text></subparagraph><subparagraph id="H15FB1E97B6014969A2A4E9719ABB7BD7"><enum>(C)</enum><header>Restoration</header><text>If the Secretary makes a determination under <internal-xref idref="H707D83373C504B088A652262C8B71F50" legis-path="112A.(b)(4)(B)">subparagraph (B)</internal-xref> that the covered public institution is no longer in violation of a requirement described in <internal-xref idref="HBB834AE6D93849988F0C331B60DEB0CF" legis-path="112A.(a)">subsection (a)</internal-xref>, the Secretary shall restore the eligibility of such institution to receive funds under this Act, including through participation in a program authorized under title IV, for each award year following the conclusion of the award year in which such determination is made.</text></subparagraph></paragraph></subsection><subsection id="H3B4636DDA1DB4A48A23240FD09F5CB2D"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to infringe upon or otherwise impact the protections of an institution of higher education under title VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>) and title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>).</text></subsection><subsection id="H830E498F05BA4020A8AC56E0CAEF6D78"><enum>(d)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of the enactment of the <short-title>Students Bill of Rights Act of 2025</short-title> and on an annual basis thereafter, the Secretary shall submit to the Committee on Education and the Workforce of the House of Representatives and the Senate Committee on Health, Education, Labor, and Pensions a report that includes—</text><paragraph id="H910A144EEB3248CAA5C54ED0E3948685"><enum>(1)</enum><text>a compilation of—</text><subparagraph id="H1CFF97D4BA9D4663875CFC069618A726"><enum>(A)</enum><text>the notifications of violation received by the Secretary under subsection (b)(2)(A) in the year for which such report is being submitted; and</text></subparagraph><subparagraph id="H2EEFA5576BAC40018E07AB0AFCBA2A4B"><enum>(B)</enum><text>the reports submitted to the Secretary under subsection (b)(2)(B) for such year; and</text></subparagraph></paragraph><paragraph id="H58FE8170E19A4A519DDA4B7D94A8D810"><enum>(2)</enum><text>any action taken by the Secretary to revoke or restore eligibility under paragraphs (3) and (4) of subsection (b) for such year.</text></paragraph></subsection><subsection id="HFC5BAA5D8E884CA4AD3D3AEEEF6CEFE3" commented="no"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H000F47CBC9CD4DEC9D4BE8864713B82E" commented="no"><enum>(1)</enum><header>Covered public institution</header><text>The term <term>covered public institution</term> means an institution of higher education, as defined in section 101, that is a public institution.</text></paragraph><paragraph id="H037D7E29FDCD4CECBB32CF6977FDBB3D" commented="no"><enum>(2)</enum><header>Content- and viewpoint-neutral</header><text display-inline="yes-display-inline">The term <term>content- and viewpoint-neutral</term>, when used with respect to a policy, practice, determination, fee assessment, or allocation applied to a student organization, means a policy, practice, determination, fee assessment, or allocation that does not take into consideration any purpose of, or viewpoints held or expressed by, such organization.</text></paragraph><paragraph id="H62859E6646E845CF89351E2418C6B434" commented="no"><enum>(3)</enum><header>Non-default, final judgment</header><text display-inline="yes-display-inline">The term <term>non-default, final judgment</term> means a final judgment by a court for a civil action brought under <internal-xref idref="H2FAD71195CD24D34854781B77A335600" legis-path="112A.(b)(1)">paragraph (1) </internal-xref>that a covered public institution is in violation of a requirement described in <internal-xref idref="HBB834AE6D93849988F0C331B60DEB0CF" legis-path="112A.(a)">subsection (a)</internal-xref> that the covered public institution chooses not to appeal or that is not subject to further appeal.</text></paragraph><paragraph id="HB0E899AC32AA47A6861A66DD38673980" commented="no"><enum>(4)</enum><header>Recognized student organization</header><text display-inline="yes-display-inline">The term <term>recognized student organization</term> means a student organization that has been determined by a covered public institution to meet institutional requirements to qualify for certain privileges granted by the institution, such as use of institutional venues, resources, and funding. </text></paragraph><paragraph id="H87E05A18F40D4502BD27101D76EDA56E" commented="no"><enum>(5)</enum><header>Security fee</header><text display-inline="yes-display-inline">The term <term>security fee</term> means a fee charged to a student or student organization for an event or activity organized by the student or student organization on the campus of the institution that is intended to cover the costs incurred by the institution for additional security measures needed to ensure the security of the institution, students, faculty, staff, or surrounding community as a result of such event or activity. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HDC223CEF0560450594C963A5F8FB6D40"><enum>3.</enum><header>Program Participation Agreement</header><text display-inline="no-display-inline">Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following: <quote>(30) In the case of an institution that is a covered public institution under section 112A, the institution will comply with the requirements of such section.</quote>.</text></section></legis-body></bill>
