<section section-type="section-one" id="H563FC2F0055F4A62A08024170C825C64"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Returning SBA to Main Street Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H7725FAA59CF84187BF7596FFF18A3CBF"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H1E52165A70DD437D9ABE9871F9BB7E1C"><enum>(1)</enum><header>Administration; Administrator</header><text>The terms <term>Administration</term> and <term>Administrator</term> mean the Small Business Administration and the Administrator thereof, respectively.</text></paragraph> <paragraph id="H2262F768AF164BE6B8B09E2BAF97A2FF"><enum>(2)</enum><header>Budget justification materials</header><text>The term <term>budget justification materials</term> has the meaning given that term in section 3(b)(2)(A) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note). </text></paragraph> 
<paragraph id="HBC535706D63A4586949C4C298DB31E3A"><enum>(3)</enum><header>Employee</header><text>The term <term>employee</term> has the meaning given that term in section 2105 of title 5, United States Code.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H2B888D74CDB04BA49CE291CB12B47184"><enum>(4)</enum><header>Headquarters employee of the Administration</header><text>The term <term>headquarters employee of the Administration</term> means—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF53E11F45A2542C3B0EE947E983A59DD"><enum>(A)</enum><text display-inline="yes-display-inline">an employee of the Administration whose permanent duty station is at the headquarters of the Administration; or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H5AE16C955A594B7CBDC45DBBD113E323"><enum>(B)</enum><text>an employee of the Administration—</text> 
<clause commented="no" display-inline="no-display-inline" id="H654F10930469469697629DBCA010650D"><enum>(i)</enum><text display-inline="yes-display-inline">who teleworks on a full-time basis; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H4FF25B01A5684636B6833578D640E73E"><enum>(ii)</enum><text>whose rate of pay is calculated based on the Washington metropolitan area rate of pay. </text></clause></subparagraph></paragraph> 
<paragraph id="H85E2CFE7DF444046A70C3CA4AF93ED78"><enum>(5)</enum><header>Headquarters of the Administration</header><text>The term <term>headquarters of the Administration</term> means the building serving as the principal managerial and administrative center of the Administration, in accordance with section 4(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/633">15 U.S.C. 633(a)</external-xref>). </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H8FFFA52AC4D6468790EBB83CAD00A7F3"><enum>(6)</enum><header>Pay locality</header><text>The term <term>pay locality</term> has the meaning given that term in section 5302 of title 5, United States Code. </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H3E94A70563304DDCBB7C7A4C44DDACB5"><enum>(7)</enum><header>Rural</header><text>The term <term>rural</term> means any area that is not designated as an urban area, based on the most recent data available from the Bureau of the Census.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H455E7431ED054093BEF2A09070CE060A"><enum>(8)</enum><header display-inline="yes-display-inline">Telework</header><text display-inline="yes-display-inline">The term <term>telework</term> has the meaning given that term in section 6501 of title 5, United States Code.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H59591FB149E342E18296C8809D604FCE"><enum>(9)</enum><header>Telework on a full-time basis</header><text>The term <term>telework on a full-time basis</term> means that an employee is authorized to telework for 100 percent of the work days of the employee per pay period. </text></paragraph> <paragraph commented="no" id="H5C0134B8AC6B403CB0D1945228A43C03"><enum>(10)</enum><header>Washington metropolitan area</header><text>The term <term>Washington metropolitan area</term> means the geographic area to which the Washington metropolitan area rate of pay applies.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA1A906B545554F10A641B980A63BEFFB"><enum>(11)</enum><header>Washington metropolitan area rate of pay</header><text display-inline="yes-display-inline">The term <term>Washington metropolitan area rate of pay</term> means the rate of pay in effect for the pay locality designated as <quote>Washington-Baltimore-Arlington, DC-MD-VA-WV-PA</quote>.</text></paragraph></section> <section commented="no" display-inline="no-display-inline" id="H8EF29078E38B4EB0883B9A28B0AEC454"><enum>3.</enum><header>Relocation of employee</header> <subsection id="HA9A633FFD354413485CF9845F01A58B4"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provisions of law, and not later than 1 year after the date of enactment of this Act, if the Administrator determines that implementing the requirements under paragraphs (1) and (2) of this subsection will reduce the cost to the Federal Government (which determination the Administrator shall explain in detail in the report required under subsection (d) of this section) the Administrator shall— </text> 
<paragraph commented="no" display-inline="no-display-inline" id="H0226BE29BDFB49158B5EDCB9750D7150"><enum>(1)</enum><text display-inline="yes-display-inline">change the permanent duty station of not less than 30 percent of the headquarters employees of the Administration, as of the date of enactment of this Act, to be at an office of the Administration at a location outside the Washington metropolitan area, which shall be at locations throughout the regions of the Administration; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5F6B6C9A10E1468EB2C67596127C9551"><enum>(2)</enum><text>for each employee of the Administration whose permanent duty station is changed under paragraph (1), ensure that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H5B18ED2971DE4792BD8DEE752050BC1A"><enum>(A)</enum><text display-inline="yes-display-inline">the rate of pay of the employee is calculated based on the pay locality for the permanent duty station of the employee; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HEE3315B0AEF4475F9624F34B558BB356"><enum>(B)</enum><text>the employee is not authorized to telework on a full-time basis.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H3058BF6248DB40059922B686D982C90F"><enum>(b)</enum><header>Determination of new duty stations</header><text display-inline="yes-display-inline">In determining the permanent duty stations of headquarters employees of the Administration under subsection (a)(1), the Administrator shall— </text> <paragraph commented="no" display-inline="no-display-inline" id="H0E41E2DD6BC04B83A05B60108366F32F"><enum>(1)</enum><text display-inline="yes-display-inline">promote geographic diversity, including consideration of rural markets; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H60C0FDA27E6C4FA2A2D73110C75DDB1E"><enum>(2)</enum><text display-inline="yes-display-inline">ensure adequate staffing throughout the regions of the Administration, to promote in-person customer service.</text></paragraph></subsection> <subsection id="H20A32AB624304422B021E77BED83A4D4"><enum>(c)</enum><header>Determination of employees eligible for a change in duty station</header> <paragraph commented="no" display-inline="no-display-inline" id="H90F81BE94BDF4AD5A040601EC6048B73"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Except as provided in paragraph (2), the Administrator shall include each headquarters employee of the Administration as eligible for a change in permanent duty station under subsection (a). </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6C17E9E243704245BC256F2A88EDE0C4"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">A headquarters employee of the Administration who is a qualified individual who receives an accommodation to telework on a full-time basis as a reasonable accommodation under title I of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111 et seq.</external-xref>)— </text> <subparagraph commented="no" display-inline="no-display-inline" id="H79B7F0E2E3BA49499C2464EA18678309"><enum>(A)</enum><text display-inline="yes-display-inline">shall not be determined to be eligible for a change in permanent duty station under subsection (a); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H274854F6F8CE411D96A84E79939E9E89"><enum>(B)</enum><text display-inline="yes-display-inline">shall be counted as a headquarters employee of the Administration for purposes of complying with subsection (a)(1).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE6685E9C4EDC4A4ABDA0192C5DCA7F98"><enum>(3)</enum><header>Notice of determination of eligibility</header><text>Not later than the day before the date on which the Administrator submits the report required under subsection (d), the Administrator shall notify each headquarters employee of the Administration who the Administrator determines is eligible for a change in permanent duty station under subsection (a) of that determination.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H1D04CC85636145E29C18B581ADE0C84A"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report that provides—</text> <paragraph commented="no" display-inline="no-display-inline" id="H57B9442A8DC04964BD1F183DFBF603F5"><enum>(1)</enum><text display-inline="yes-display-inline">the number of headquarters employees of the Administration, as of the date of enactment of this Act; </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB10E62975C2F47A3A19AE48144C58968"><enum>(2)</enum><text>the number of headquarters employees of the Administration identified as eligible for a change in permanent duty station, in accordance with subsection (c); </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H846BA43E2D1B4F628ABF1EA5541F49B2"><enum>(3)</enum><text>the number of headquarters employees of the Administration whose permanent duty station will be changed to be at an office of the Administration at a location outside the Washington metropolitan area under subsection (a); </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H630B1DA9226B45A8B771ECBC03A1E58C"><enum>(4)</enum><text>the number of headquarters employees of the Administration subject to an exception under subsection (c)(2); and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0DA7C0019F74449A9296B6AD9F5B4802"><enum>(5)</enum><text>the plan of the Administrator to implement subsection (a).</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HFFFAE01EADD24E2AAB3F2F15BD9B5DED"><enum>(e)</enum><header>Implementation</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H5C4F9F6C7AE04F6496F5A13F02B0AC37"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not earlier than 60 days, and not later than 90 days, after the date on which the Administrator submits the report required under subsection (d), the Administrator shall notify each headquarters employee of the Administration whose permanent duty station will be changed to be at an office of the Administration located outside the Washington metropolitan area under subsection (a)— </text> <subparagraph commented="no" display-inline="no-display-inline" id="H406AE13454BC498193E1EF48C264C9F6"><enum>(A)</enum><text display-inline="yes-display-inline">that, effective 90 days after the date of the notification—</text> 
<clause commented="no" display-inline="no-display-inline" id="HED687BDE78364494938D6AA81086D1FF"><enum>(i)</enum><text display-inline="yes-display-inline">the permanent duty station of the employee shall be changed; </text></clause> <clause commented="no" display-inline="no-display-inline" id="HDFB033865018402C84E06E4F93BBD30E"><enum>(ii)</enum><text>the rate of pay of the employee shall be calculated based on the pay locality for such permanent duty station; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H1241D9EDA5D04F89A94DEDDC518AC1DE"><enum>(iii)</enum><text>the employee shall not be authorized to telework on a full-time basis; and</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H40AE901F712F42B985B81F03F6EC5A62"><enum>(B)</enum><text>of the location of such permanent duty station.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD96752E0D266471380077A6983A1582F"><enum>(2)</enum><header>Full-time teleworkers remaining in the Washington metropolitan area</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7CB07706C3154AA59CE3E2F15A18F015"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>For any employee described in subparagraph (B), effective on the date that is 180 days after the date on which the Administrator submits the report required under subsection (d), the employee shall not be authorized to telework on a full-time basis.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H2CA26509466D417BADDF29287F49CB29"><enum>(B)</enum><header display-inline="yes-display-inline">Employees covered</header><text>An employee described in this subparagraph is a headquarters employee of the Administration—</text> 
<clause commented="no" display-inline="no-display-inline" id="H665B816F2E394881BBCF26F7E92D7969"><enum>(i)</enum><text display-inline="yes-display-inline">who teleworks on a full-time basis, as of the date of enactment of this Act; </text></clause> <clause commented="no" display-inline="no-display-inline" id="HD66D95894CA740299A39C4034E25EAC1"><enum>(ii)</enum><text>who is not subject to an exception under subsection (c)(2); and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H5CC5F49FD097426D9E4F1120A5728A9A"><enum>(iii)</enum><text>whose permanent duty station is not changed to be an office of the Administration at a location outside the Washington metropolitan area under subsection (a).</text></clause></subparagraph></paragraph> <paragraph id="H50A614F5B7B44F96A44DE7A3A7199A51"><enum>(3)</enum><header>No relocation incentives</header><text display-inline="yes-display-inline">If, pursuant to this Act, the official worksite (as defined in section 531.602 of title 5, Code of Federal Regulations, or any successor regulation) of an employee changes from the residence of the employee to the headquarters of the Administration, notwithstanding any other provision of law, the employee shall not be paid any relocation incentive. </text></paragraph></subsection></section> 
<section id="H1D06196C61534AFF837A27C2A8A6DC2D"><enum>4.</enum><header>Reduction in headquarters office space</header> 
<subsection commented="no" display-inline="no-display-inline" id="H98AD24949FEA4C7AB5EBD696697D5B48"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall reduce the amount of office space for the headquarters of the Administration by not less than 30 percent.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H28F7FD0A982A4F93A3A5673775DC9A63"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Administrator shall—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HF9DEB5748C634447B9C3F271C0E4032C"><enum>(1)</enum><text>begin reducing office space under subsection (a) not later than 180 days after the date of enactment of this Act; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4353874B46364C38898ABAEC2EA9627D"><enum>(2)</enum><text>complete the reduction of office space required under subsection (a) not later than 2 years after the date of enactment of this Act.</text></paragraph></subsection></section> 
<section id="H77D5975C833A47DAB695CAB9288CF529"><enum>5.</enum><header>Information included in budget justification materials provided to Congress</header><text display-inline="no-display-inline">The Administrator shall include in the first budget justification materials of the Administration submitted after the date of enactment of this Act, and the budget justification materials of the Administration for each fiscal year thereafter— </text> <paragraph commented="no" display-inline="no-display-inline" id="H31587BAB14D2430C8CAAF583AD02EE85"><enum>(1)</enum><text display-inline="yes-display-inline">the number of headquarters employees of the Administration; </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HAAB15A9EE47E42299987118A481A3C39"><enum>(2)</enum><text>the number of employees of the Administration assigned to a permanent duty station in—</text> <subparagraph id="HBFBF1864622A467B803E5F1814A828EF"><enum>(A)</enum><text>a field office of the Administration;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H95C0B366C0684DCDB3E56DDE6D17F1ED"><enum>(B)</enum><text>a district office of the Administration; or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE846D6F099CB45FEAF30EA39FA467599"><enum>(C)</enum><text>a regional office of the Administration; </text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2343C759C39D4CF8B82431F345A9D72A"><enum>(3)</enum><text>the number of employees of the Administration who telework on a full-time basis; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H67F8A7DBFE6E49BCACF324654A7C72A2"><enum>(4)</enum><text>the number of employees of the Administration who are a qualified individual who receives an accommodation to telework on a full-time basis as a reasonable accommodation under title I of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111 et seq.</external-xref>). </text></paragraph></section> 
<section id="H61B59EA2DEB445249501E92073F60091"><enum>6.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the application of such provision to any person or circumstance is held to be unconstitutional, the remainder of this Act and the application of the provision to any other person or circumstance shall not be affected thereby.</text></section> <section id="HD802FB697C324AD894D24425A6536C7D"><enum>7.</enum><header>Supersession</header><text display-inline="no-display-inline">This Act shall supersede any other provision of law and any provision of a collective bargaining agreement or master labor agreement.</text></section> 
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H42BEE50FB8604931A6735AA08AB16340"><enum>8.</enum><header>No private cause of action</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to establish a private cause of action, equitable or otherwise, to challenge any selection, change, or decision made, or action taken, under this Act. </text></section> </legis-body></bill>
