<section id="HAAD12AD473AF404191C9649C9BDBE604" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sarah Debbink Langenkamp Active Transportation Safety Act</short-title></quote>.</text></section> <section id="H7F23BFA537E148CEAD376CBEAAAE37BC"><enum>2.</enum><header>Highway safety improvement program</header> <subsection id="H0A0E9E3D89BA49C9B227D2BA67377A65"><enum>(a)</enum><header>Highway safety improvement project</header><text>Section 148(a)(4)(B) of title 23, United States Code, is amended—</text> 
<paragraph id="H8E40514E16B846E0950EE769294F86AD"><enum>(1)</enum><text>in clause (xxix), by striking <quote>through (xxviii)</quote> and inserting <quote>through (xxx)</quote>;</text></paragraph> <paragraph id="HECB44142F3BD4F428B7DEF61FE97CA07"><enum>(2)</enum><text>by redesignating clause (xxix) as clause (xxxi); and</text></paragraph> 
<paragraph id="H2361C3D18ABA4548B919F73A2D8F0716"><enum>(3)</enum><text>by inserting after clause (xxviii) the following:</text> <quoted-block style="USC" id="H7D31296E279B4A53AE855D7097500C7A" display-inline="no-display-inline"> <clause id="HC2F7F9865F7B41EBB8D10B1D5F8D5F7A"><enum>(xxix)</enum><text>The connection of 2 or more segments of existing bicyclist or pedestrian infrastructure.</text></clause> 
<clause id="H57166BACD80A400E9CF5487CB1AE53F0"><enum>(xxx)</enum><text>The reduction of safety risks to vulnerable road users through a project or strategy described in a program of projects or strategies developed pursuant to subsection (l)(2)(B).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H2E0D33EEAB6A4698859F01A8B714B4FD"><enum>(b)</enum><header>Federal share of certain highway safety improvement projects</header> <paragraph id="HFD92628434F54EF6AC62374ECEC36878"><enum>(1)</enum><header>In general</header><text>Section 148(j) of title 23, United States Code, is amended—</text> 
<subparagraph id="HCAAE8B130FE7493492A41C4B444E5198"><enum>(A)</enum><text>by striking <quote>Except as provided in sections 120 and 130</quote> and inserting the following:</text> <quoted-block style="USC" id="H9F535E7EDF7448FF9D9A108FC9B369A1" display-inline="no-display-inline"> <paragraph id="H1DC69753A06549D4AAE47C3A800D340C"><enum>(1)</enum><header>In general</header><text>Except as provided in sections 120 and 130 and paragraph (2)</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H89978E04E4AE44BD8E5EBAA07793B40A"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block style="USC" id="H29624F5FF02F4F688FBE2567390D4E28" display-inline="no-display-inline"> <paragraph id="H4B0CA45DDA204B138C8E1CA4287C476B"><enum>(2)</enum><header>Exception</header><text>Notwithstanding any other provision of law, the Federal share of the cost of a highway safety improvement project carried out with funds apportioned to a State under section 104(b)(3) may be up to 100 percent if the project is a project described in clause (xxix) or (xxx) of subsection (a)(4)(B).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H99E9C3EADCAA4112AB6EF80E27241F68"><enum>(2)</enum><header>Flexible financing</header><text>Section 133(h)(7) of title 23, United States Code, is amended—</text> <subparagraph id="H08193E39639642BBAD089A9D87D74409"><enum>(A)</enum><text>by redesignating subparagraph (C) as subparagraph (E); and</text></subparagraph> 
<subparagraph id="H4F6A74146C9B4069BF4F6085C079F38A"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following:</text> <quoted-block style="USC" id="HC38A3537F524454D82EBEA87E7BC1F2B" display-inline="no-display-inline"> <subparagraph id="HEFC2F617E132400FB44AF5E27F7B2B3C"><enum>(B)</enum><header>Flexible financing</header><text>Notwithstanding section 120—</text> 
<clause id="HD9FDAC87E7BA45DDA3E914A6DB8E7A33"><enum>(i)</enum><text>the non-Federal share for a project under this subsection may be calculated on a project, multiple-project, or program basis; and</text></clause> <clause id="H1DFAF5E2F6C949DBBCB1A027D646FA86"><enum>(ii)</enum><text>the Federal share of the cost of an individual project under this subsection may be up to 100 percent.</text></clause></subparagraph> 
<subparagraph id="H01410EE24B6B48EDB25A4FE9B16F5717"><enum>(C)</enum><header>Treatment as non-Federal share</header><text>Notwithstanding any other provision of law, funds made available to carry out section 148 may be credited toward the non-Federal share of the costs of a project under this subsection if—</text> <clause id="H6C0CBA049B2F41D7953BC97B6F7D1178"><enum>(i)</enum><text>the project includes a Proven Safety Countermeasure for bicyclists or pedestrians, as determined by the Federal Highway Administration; </text></clause> 
<clause id="H98FE74B89E204EB487C551E3897E1699"><enum>(ii)</enum><text>the relevant State strategic highway safety plan includes an emphasis area related to vulnerable road users; or</text></clause> <clause id="HC1EC52AA60524C0D8575CC5AE22CAE5E"><enum>(iii)</enum><text>the proposed project—</text> 
<subclause id="H1FB5EEDBFA9D477D9EE2B00D260553F7"><enum>(I)</enum><text>was described in a program of projects or strategies developed pursuant to paragraph section 148 (l); or</text></subclause> <subclause id="H0B610C51622948FD910537A5C5819FE8"><enum>(II)</enum><text>was identified by a local government, metropolitan planning organization, or regional transportation planning organization, including in a safety plan described in subparagraph (B), as addressing 1 or more areas of high risk to vulnerable road users during the consultation process required under paragraph (xx)(B) and through a planning process and data-based analysis.</text> </subclause></clause></subparagraph> 
<subparagraph id="H5FDAEF94CE7C4D988481BAEAD72C4F68" commented="no"><enum>(D)</enum><header>Safety plans described</header><text>A safety plan referred to in subparagraph (A)(ii)(II) is—</text> <clause id="H22CDD004E09E40B5B7B6BD94E136C614" commented="no"><enum>(i)</enum><text>a pedestrian or bicyclist safety plan;</text></clause> 
<clause id="H6BD4465E348B40078E39700744AA5E0B" commented="no"><enum>(ii)</enum><text>a Complete Streets plan;</text></clause> <clause id="HC2732210EF564B65991048314250E1EE" commented="no"><enum>(iii)</enum><text>a local roadway safety plan;</text></clause> 
<clause id="HB133E96E76B4479CA497B294E4A85038" commented="no"><enum>(iv)</enum><text>a Vision Zero Action Plan;</text></clause> <clause id="H7A7507E229514E218C3C92B8DA8EBD47" commented="no"><enum>(v)</enum><text>a transition plan described in section 35.150(d) of title 28, Code of Federal Regulations (or successor regulations) (commonly known as an <quote>ADA Transition Plan</quote>);</text></clause> 
<clause id="H54A99D1431624A5FA2E365B1C43BA8E3" commented="no"><enum>(vi)</enum><text>a Tribal transportation safety plan;</text></clause> <clause id="HE1F2D1B528BA41D08E8E514A6922510B" commented="no"><enum>(vii)</enum><text>a comprehensive safety action plan (as defined in section 24112(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/23/402">23 U.S.C. 402</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>)); or</text></clause> 
<clause id="HE41AA561AD4849D38181F55F09519074" commented="no"><enum>(viii)</enum><text>any other safety plan, as determined by the Secretary.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H3E0B0545F57947D9A43C6436F68E6A9C"><enum>(3)</enum><header>Increased Federal share for proven safety countermeasures</header><text>Section 120(c)(1) of title 23, United States Code, is amended, in the first sentence, by inserting <quote>Proven Safety Countermeasures for bicyclists or pedestrians (as determined by the Federal Highway Administration),</quote> before <quote>breakaway utility poles</quote>.</text></paragraph></subsection></section>
