R. 1988</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250310">March 10, 2025</action-date><action-desc><sponsor name-id="D000624">Mrs. Dingell</sponsor> (for herself, <cosponsor name-id="D000617">Ms. DelBene</cosponsor>, <cosponsor name-id="T000481">Ms. Tlaib</cosponsor>, <cosponsor name-id="M001229">Mrs. McIver</cosponsor>, <cosponsor name-id="V000081">Ms. Velázquez</cosponsor>, and <cosponsor name-id="S001185">Ms. Sewell</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/85">chapter 85</external-xref> of title 5, United States Code, to clarify that Federal civilian and military personnel excepted from a furlough during a Government shutdown are eligible for unemployment compensation, and for other purposes.</official-title></form><legis-body id="HFAB2F163A4AA4299A89A0229AB281C61" style="OLC"><section id="HA5414ACA2D4E43C6B6E4903084D37159" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pay Federal Workers and Servicemembers Act</short-title></quote>.</text></section><section id="H7474CA1DCCF641F1AAD90265C75DBF24"><enum>2.</enum><header>Eligibility for unemployment compensation for Federal civilian and military personnel excepted from furlough during Government shutdown</header><subsection id="H2F15EFFD814445268BC4F3B5E8876B19"><enum>(a)</enum><header>Federal civilian employees</header><paragraph id="H4CD6C7E5EDB74776861981A6319C3567"><enum>(1)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/85">chapter 85</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1CE7DB0D42074B1197D3364789E3A2F4" style="USC"><section id="H12945BC8E55344AAA28ED00721E04AE2" display-inline="no-display-inline"><enum>8510.</enum><header>Eligibility for unemployment compensation for Federal personnel excepted from furlough during Government shutdown</header><subsection id="HA3F2411E5DBF46E5ADD643612842B688"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to any lapse in appropriations beginning on or after March 14, 2025, each covered employee shall be, solely for the purpose of determining eligibility for unemployment compensation under this subchapter or subchapter II (as the case may be), deemed for the duration of the lapse in appropriations to be—</text><paragraph id="H2DC0498FD6CD40E8A81858A4369675F1"><enum>(1)</enum><text>totally separated from Federal service; and</text></paragraph><paragraph id="H878A96FB33E046BFBC5CDC0CCD38FAE9"><enum>(2)</enum><text>eligible for unemployment compensation benefits under the applicable subchapter with no waiting period for such eligibility to accrue.</text></paragraph></subsection><subsection id="H13B9AE84CA424ABFB19FA63977BCCEF5"><enum>(b)</enum><header>Covered employee defined</header><text display-inline="yes-display-inline">In this section, the term <quote>covered employee</quote> means any of the following Federal personnel who are excepted from furlough and are not being paid due to a lapse in appropriations: </text><paragraph id="H6D8CAFA0AEBD4C4B98763FC69E28AEE7"><enum>(1)</enum><text display-inline="yes-display-inline">Any member of the Armed Forces or the Commissioned Corps of the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="HA8780AD262F14D56A9D092780FCCB83F"><enum>(2)</enum><text>Any Federal civilian employee who is an excepted employee or an employee performing emergency work, as such terms are defined by the Office of Personnel Management.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H0D7FE7392BCD40E1AE4A61F9CA00AD96"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for such subchapter is amended by adding at the end the following:</text><quoted-block style="USC" id="HDEEF52BA93F04D39A2050C882F54FF25" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">8510. Eligibility for unemployment compensation for Federal personnel excepted from furlough during Government shutdown.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H92CF29BCE2D64E0C924B74750C3CFC46"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply to weeks of unemployment beginning on or after March 14, 2025.</text></subsection></section></legis-body></bill>
