<section id="HCF0882DA6C004F9C9E966ECA34321035" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>45Q Repeal Act of 2025</short-title></quote>. </text></section> <section id="HC13A674E87564EB9A823F12296518C00"><enum>2.</enum><header>Repeal of carbon oxide sequestration credit</header> <subsection id="H59C67E5C47B64746B514CF8AFE6A2B67"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by repealing section 45Q and by striking the item relating to such section from the table of sections for such subpart.</text></subsection> 
<subsection id="H72DCFBF597EB4649B20B86186CC9C539"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H193C39CA094147A98433405FE14874D8"><enum>(1)</enum><text>Section 38(b) is amended by striking paragraph (29).</text></paragraph> <paragraph id="H24790B5D00994AAC98A7F89BA6324567"><enum>(2)</enum><text>Section 45V(d) is amended by striking paragraph (2).</text></paragraph> 
<paragraph id="HE8CC678EBE3649438D6A31C69BD9E659"><enum>(3)</enum><text>Section 48(a)(15) is amended—</text> <subparagraph id="HDA6F83B271994BD89A34E50611F5E145"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>or section 45Q</quote>, and</text></subparagraph> 
<subparagraph id="H19D554E724264517A4FF2C12F0A85709"><enum>(B)</enum><text>in subparagraph (C)(ii)(I), by striking <quote>or 45Q</quote>. </text></subparagraph></paragraph> <paragraph id="H48E8D608BBAC46A3B75B1182648BD3CA"><enum>(4)</enum><text display-inline="yes-display-inline">Section 45Y(b)(1)(D) is amended by striking <quote>45Q,</quote>.</text></paragraph> 
<paragraph id="HCE21F740AF7141F692BA2093DD047E45"><enum>(5)</enum><text>Section 45Y(b)(2)(D) is amended to read as follows:</text> <quoted-block style="OLC" id="H8F8EE529A7C644CCB089CFAF5338D7A8" display-inline="no-display-inline"> <subparagraph id="HF09D6D2F25C949B2BC39BC6E7CF4F230"><enum>(D)</enum><header>Carbon capture and sequestration equipment</header> <clause id="HD0B258D707BC4E39AE0256A760E2EB73"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this subsection, the amount of greenhouse gases emitted into the atmosphere by a facility in the production of electricity shall not include any qualified carbon dioxide that is captured by the taxpayer and—</text> 
<subclause id="H0BE055D9EEAA487A88671FDD925BB75E"><enum>(I)</enum><text>pursuant to any regulations established under clause (ii), disposed of by the taxpayer in secure geological storage, or </text></subclause> <subclause id="H0EDED425328D4E7E945AEE50BCA5AB4B"><enum>(II)</enum><text>utilized by the taxpayer in a manner described in paragraph (5) of such section.</text></subclause></clause> 
<clause id="HE2B09B586B9F45E1B4F7178CD2C63113"><enum>(ii)</enum><header>Regulations</header> 
<subclause id="H6F1E112D6B154749844EA29C053AF8ED"><enum>(I)</enum><header>In general</header><text>The Secretary, in consultation with the Administrator of the Environmental Protection Agency, the Secretary of Energy, and the Secretary of the Interior, shall establish regulations for determining adequate security measures for the geological storage of qualified carbon oxide under clause (i) such that the qualified carbon oxide does not escape into the atmosphere. Such term shall include storage at deep saline formations, oil and gas reservoirs, and unminable coal seams under such conditions as the Secretary may determine under such regulations.</text></subclause> <subclause id="HF148006F12DC41E4B9E8D18D40D1A314"><enum>(II)</enum><header>Qualified carbon oxide</header><text>For purposes of this clause, the term <quote>qualified carbon oxide</quote> has the meaning given such term in section 45Q(c) as such section was in effect on the day before the date of the enactment of the <short-title>45Q Repeal Act of 2025</short-title>.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7EF4CC42112C468D9DE2842A5AEB65B6"><enum>(6)</enum><text display-inline="yes-display-inline">Section 45Z(d)(4)(B) is amended by striking clause (iii).</text></paragraph> <paragraph id="H3CF39A9BB8E54E56B95F223EAD919048"><enum>(7)</enum><text>Section 48C(f) is amended by striking <quote>45Q,</quote>.</text></paragraph>
<paragraph id="H272F7A5A6AAF435588FB86CBD96BBBC6"><enum>(8)</enum><text>Section 48E(b)(3)(C) is amended by striking clause (iii).</text></paragraph> <paragraph id="H806E8898A4A84A2796EC6389B63A5E0F"><enum>(9)</enum><text display-inline="yes-display-inline">Section 142(o)(1)(B) is amended by inserting <quote>, as such section was in effect on the day before the date of the enactment of the <short-title>45Q Repeal Act of 2025</short-title></quote> after <quote>45Q(e)(3)</quote>. </text></paragraph>
<paragraph id="H8A641FAF08B443B88BB268F69C160F43"><enum>(10)</enum><text>Section 6417 is amended—</text> <subparagraph id="HDF929A5FFDE44956959ADC6837DB181C"><enum>(A)</enum><text>in subsection (b) by striking paragraph (3), and</text></subparagraph> 
<subparagraph id="H4E6A1C27C0CF4F72BF7F81A343B5A292"><enum>(B)</enum><text>in subsection (d)—</text> <clause id="HE5CD88F1C508491DAD42CC49FD12A045"><enum>(i)</enum><text>in paragraph (1)(C), by inserting <quote>, as such section was in effect on the day before the date of the enactment of the <short-title>45Q Repeal Act of 2025</short-title></quote> after <quote>45Q(d)</quote>, and</text></clause> 
<clause id="HD95DA5610AF2480181798FFDE9023335"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (3)(C)(i)(II)(bb), by striking <quote>period described in paragraph (3)(A) or (4)(A) of section 45Q(a) with respect to such equipment</quote> and inserting <quote>12-year period beginning on the date the equipment was originally placed in service</quote>.</text></clause></subparagraph></paragraph> <paragraph id="H9CF9B725B50E4F979E5904C73E679B6F"><enum>(11)</enum><text>Section 6418(f)(1)(A) is amended by striking clause (iii).</text></paragraph></subsection> 
<subsection id="H484FB93B7D7A4AD2B6C4F0095653FDA3"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to taxable years beginning after December 31, 2025.</text></subsection></section> </legis-body></bill>
