<section id="HB1FA6F55BF4B4C85BBFEC5E8B2B4E40A" changed="not-changed" section-type="section-one"> <enum>1.</enum> <header>Short title</header> <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildland Firefighter Paycheck Protection Act of 2025</short-title></quote>.</text> </section> <section id="H8A8F6D539E14465BB0C4CB5F6B932BB5" changed="not-changed" commented="no" display-inline="no-display-inline"> <enum>2.</enum> <header>Special base rates of pay for wildland firefighters</header> <subsection id="H35F90645C16A41598E507B8377BADB3D" changed="not-changed" commented="no" display-inline="no-display-inline"> <enum>(a)</enum> <header>In general</header> <text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/5332">section 5332</external-xref> the following:</text>

<section commented="no" display-inline="no-display-inline" id="HBB18F0333E1649EA8CCE0B45D1275F71" changed="not-changed"> <enum>5332a.</enum> <header>Special base rates of pay for wildland firefighters</header> 
<subsection commented="no" display-inline="no-display-inline" id="H23BD0528F3744A94AC34A6558F025D50" changed="not-changed"> <enum>(a)</enum> <header>Definitions</header> <text>In this section—</text> <paragraph id="HB74A79DDEA4142C1AD40EB8F1840C6B5" changed="not-changed"> <enum>(1)</enum> <text>the term <term>firefighter</term> means an employee who—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H88DAE8AF914241E4822E414B2A95D7CE" changed="not-changed"> <enum>(A)</enum> <text>is a firefighter within the meaning of section 8331(21) or section 8401(14);</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H78C1C2D34F6D45ED9FE5E80E38591BB4" changed="not-changed"> <enum>(B)</enum> <text>in the case of an employee who holds a supervisory or administrative position and is subject to subchapter III of chapter 83, but who does not qualify to be considered a firefighter within the meaning of section 8331(21), would otherwise qualify if the employee had transferred directly to that position after serving as a firefighter within the meaning of that section;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC0B204A287A14ED6B801009283407477" changed="not-changed"> <enum>(C)</enum> <text>in the case of an employee who holds a supervisory or administrative position and is subject to chapter 84, but who does not qualify to be considered a firefighter within the meaning of section 8401(14), would otherwise qualify if the employee had transferred directly to that position after performing duties described in section 8401(14)(A) for at least 3 years; or</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H205CAE8C9F2440E2A169FF15CD36BF77" changed="not-changed"> <enum>(D)</enum> <text>in the case of an employee who is not subject to subchapter III of chapter 83 or chapter 84, holds a position that the Office of Personnel Management determines would satisfy subparagraph (A), (B), or (C) if the employee were subject to subchapter III of chapter 83 or chapter 84; </text> </subparagraph> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H0C819729DDB444DEBF3EF43860E2EFC6" changed="not-changed"> <enum>(2)</enum> <text>the term <term>General Schedule base rate</term> means an annual rate of basic pay established under section 5332 before any additions, such as a locality-based comparability payment under section 5304 or 5304a or a special rate supplement under section 5305;</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HC1682DD4369F45D1B4EE8EFC96197A4A" changed="not-changed"> <enum>(3)</enum> <text>the term <term>special base rate</term> means an annual rate of basic pay payable to a wildland firefighter, before any additions or reductions, that replaces the General Schedule base rate otherwise applicable to the wildland firefighter and that is administered in the same manner as a General Schedule base rate; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H91C449A6D3BF4D89BF533A4D656E5E36" changed="not-changed"> <enum>(4)</enum> <text>the term <term>wildland firefighter</term> means a firefighter— </text> <subparagraph commented="no" display-inline="no-display-inline" id="H78BAA4B7127F4DA7A4BDC473635BF9CD" changed="not-changed"> <enum>(A)</enum> <text display-inline="yes-display-inline">who is employed by the Forest Service or the Department of the Interior; and </text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB046A63C0BD44C97B35C738BA1A23C41" changed="not-changed"> <enum>(B)</enum> <text display-inline="yes-display-inline">the duties of the position of whom relate primarily to wildland fires, as opposed to structure fires. </text> </subparagraph> </paragraph> </subsection> <subsection commented="no" display-inline="no-display-inline" id="H89F96CE056A646A48348AA5D52BAF468" changed="not-changed"> <enum>(b)</enum> <header>Special base rates of pay</header> <paragraph commented="no" display-inline="no-display-inline" id="HFE15958B854B4E859414B1DDAEE95376" changed="not-changed"> <enum>(1)</enum> <header display-inline="yes-display-inline">Entitlement to special rate</header> <text>Notwithstanding section 5332, a wildland firefighter is entitled to a special base rate at grades 1 through 15, which shall— </text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H54170EE706394442B522F488774C92CF" changed="not-changed"> <enum>(A)</enum> <text display-inline="yes-display-inline">replace the otherwise applicable General Schedule base rate for the wildland firefighter; </text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HDA5DD7CC6E074D20BF5DFAA310B0C9DA" changed="not-changed"> <enum>(B)</enum> <text display-inline="yes-display-inline">be basic pay for all purposes, including the purpose of computing a locality-based comparability payment under section 5304 or 5304a; and </text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB0DCA55291BB48F6B1452318B813D0ED" changed="not-changed"> <enum>(C)</enum> <text display-inline="yes-display-inline">be computed as described in paragraph (2) and adjusted at the time of adjustments in the General Schedule. </text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF045023A2C634639A6678ED93A45172A" changed="not-changed"> <enum>(2)</enum> <header>Computation</header> <subparagraph commented="no" display-inline="no-display-inline" id="H242AADC62E864F6EADC386A903085BE2" changed="not-changed"> <enum>(A)</enum> <header display-inline="yes-display-inline">In general</header> <text>The special base rate for a wildland firefighter shall be derived by increasing the otherwise applicable General Schedule base rate for the wildland firefighter by the following applicable percentage for the grade of the wildland firefighter and rounding the result to the nearest whole dollar:</text>

<clause commented="no" display-inline="no-display-inline" id="H5942E36B5FDD492EB0533B9845DDF711" changed="not-changed"> <enum>(iii)</enum> <text>For GS–3, 36 percent. </text> </clause> <clause commented="no" display-inline="no-display-inline" id="HBE1BB0726523420C989DC4E9355AA44B" changed="not-changed"> <enum>(iv)</enum> <text>For GS–4, 33 percent.</text> </clause>

<clause commented="no" display-inline="no-display-inline" id="H79DA7A6773AE4956A52A65B92612234A" changed="not-changed"> <enum>(xv)</enum> <text>For GS–15, 1.5 percent.</text> </clause> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H1661EC8FEFD1452F98BFDFE46275AC2C" changed="not-changed"> <enum>(B)</enum> <header>Hourly, daily, weekly, or biweekly rates</header> <text>When the special base rate with respect to a wildland firefighter is expressed as an hourly, daily, weekly, or biweekly rate, the special base rate shall be computed from the appropriate annual rate of basic pay derived under subparagraph (A) in accordance with the rules under section 5504(b).</text> </subparagraph> </paragraph> </subsection> </section> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> 
<subsection id="HA997E6C89A454AF2A48EC6D37F088A93" changed="not-changed" commented="no" display-inline="no-display-inline"> <enum>(b)</enum> <header>Clerical amendment</header> <text>The table of sections for subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/5332">section 5332</external-xref> the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HACC0AEEE661C4C9FBCEE7F96A91AFA8A" changed="not-changed"> <toc changed="not-changed"> <toc-entry bold="off" level="section" changed="not-changed">5332a. Special base rates of pay for wildland firefighters.</toc-entry> </toc> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> <subsection id="H112AB21961744E99B5EDEFD5CF1DEDAE" changed="not-changed" commented="no" display-inline="no-display-inline"> <enum>(c)</enum> <header>Prevailing rate employees</header> <text>Section 5343 of title 5, United States Code, is amended by adding at the end the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="H54B5B827FB1644DDA95C18E34874EB5A" changed="not-changed"> <enum>(g)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H4455B9E76C3142589198ACA854D9C0F3" changed="not-changed"> <enum>(1)</enum> <text>For a prevailing rate employee described in section 5342(a)(2)(A) who is a wildland firefighter, as defined in section 5332a(a), the Secretary of Agriculture or the Secretary of the Interior (as applicable) shall increase the wage rates of that employee by an amount (determined at the sole and exclusive discretion of the applicable Secretary after consultation with the other Secretary) that is generally consistent with the percentage increases given to wildland firefighters in the General Schedule under section 5332a. </text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" indent="up1" id="HEEFE9C5FBD59461DB36665542CC1DB7D" changed="not-changed"> <enum>(2)</enum> <text display-inline="yes-display-inline">An increased wage rate under paragraph (1) shall be basic pay for the same purposes as the wage rate otherwise established under this section. </text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" indent="up1" id="HFF2689F6B85E4C1E89C01FC69D50D73B" changed="not-changed"> <enum>(3)</enum> <text display-inline="yes-display-inline">An increase under this subsection may not cause the wage rate of an employee to increase to a rate that would produce an annualized rate in excess of the annual rate for level IV of the Executive Schedule.</text> </paragraph> </subsection> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> <subsection id="H2DE9231110C94D4FA4F4064718D145AD" changed="not-changed" commented="no" display-inline="no-display-inline"> <enum>(d)</enum> <header>Effective date</header> <text>The amendments made by this section shall take effect on the first day of the first applicable pay period beginning after the last day of the last pay period for which Federal wildland firefighter temporary salary increases were in effect, as originally authorized under section 40803(d)(4)(B) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(d)(4)(B)</external-xref>) and as extended under the Consolidated Appropriations Act, 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/42">Public Law 118–42</external-xref>; 138 Stat. 25), the Continuing Appropriations Act, 2025 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/118/83">Public Law 118–83</external-xref>; 138 Stat. 1524), and the Further Continuing Appropriations Act, 2025 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/118/158">Public Law 118–158</external-xref>).</text> </subsection> </section>

<subsection id="H1AA75B1D86F34817B309496D08BA1675" changed="not-changed" commented="no" display-inline="no-display-inline"> <enum>(a)</enum> <header>In general</header> <text>Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United Sates Code, is amended by inserting after section 5545b the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="HB49ED72340A04421AED87194C9E5550E" changed="not-changed"> <section commented="no" display-inline="no-display-inline" id="H311A7B5CB13C4C56A75BF556C54AB887" changed="not-changed"> <enum>5545c.</enum> <header>Incident response premium pay for employees engaged in wildland firefighting</header> <subsection commented="no" display-inline="no-display-inline" id="HC19626D42D724189B73A9C698323C019" changed="not-changed"> <enum>(a)</enum> <header>Definitions</header> <text>In this section—</text>

<subparagraph commented="no" display-inline="no-display-inline" id="H5C1F8439590749F9AF506CDA5FD8ACFD" changed="not-changed"> <enum>(F)</enum> <text>the Committee on Agriculture of the House of Representatives;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE54B3D3CE60B435ABDBE9602BCAB86DA" changed="not-changed"> <enum>(G)</enum> <text>the Committee on Natural Resources of the House of Representatives; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE8DE64A8B1C64E7AA1875B10D9D4AD6D" changed="not-changed"> <enum>(H)</enum> <text>the Committee on Appropriations of the House of Representatives;</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H144AED3503424E1C90D2C807F196AA13" changed="not-changed"> <enum>(2)</enum> <text>the term <term>covered employee</term> means an employee of the Forest Service or the Department of the Interior who is—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3681869EAFC14D06AF44625503E308E3" changed="not-changed"> <enum>(A)</enum> <text>a wildland firefighter, as defined in section 5332a(a); or</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC7F08A4FF4CF453D93D5F1EFC095881C" changed="not-changed"> <enum>(B)</enum> <text>certified by the applicable agency to perform wildland fire incident-related duties during the period that employee is deployed to respond to a qualifying incident;</text> </subparagraph> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC8A3BA243C0146FDA89CE49096E0ED6C" changed="not-changed"> <enum>(3)</enum> <text>the term <term>incident response premium pay</term> means pay to which a covered employee is entitled under subsection (c);</text> </paragraph> <paragraph id="HC2092B36F21D480F98B0D65713656A16" changed="not-changed"> <enum>(4)</enum> <text>the term <term>prescribed fire incident</term> means a wildland fire originating from a planned ignition in accordance with applicable laws, policies, and regulations to meet specific objectives;</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H810DCB5C9FEC4701AC9EE72DD0D965F7" changed="not-changed"> <enum>(5)</enum> <text>the term <term>qualifying incident</term>— </text> <subparagraph commented="no" display-inline="no-display-inline" id="H5FA58FE162974293A530FB598B95C144" changed="not-changed"> <enum>(A)</enum> <text display-inline="yes-display-inline">means— </text> 
<clause commented="no" display-inline="no-display-inline" id="H2621C0BF2E964C41A0BF4A9289128E02" changed="not-changed"> <enum>(i)</enum> <text display-inline="yes-display-inline">a wildfire incident, a prescribed fire incident, or a severity incident; or</text> </clause> <clause commented="no" display-inline="no-display-inline" id="HE3607869FC4A466D9E87561A60D6C29D" changed="not-changed"> <enum>(ii)</enum> <text display-inline="yes-display-inline">an incident that the Secretary of Agriculture or the Secretary of the Interior determines is similar in nature to an incident described in clause (i); and</text> </clause> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9E686FDF4DA749B0B8F2FE7001FF9DFE" changed="not-changed"> <enum>(B)</enum> <text display-inline="yes-display-inline">does not include an initial response (including an initial attack fire) in which a wildfire is contained within 36 hours; and</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H6B9F85B74211449A902EDDEE87DE3B3E" changed="not-changed"> <enum>(6)</enum> <text display-inline="yes-display-inline">the term <term>severity incident</term> means an incident in which a covered employee is pre-positioned in an area in which conditions indicate there is a high risk of wildfires.</text> </paragraph> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HF284918B5AF84260B80A621EE46AFB05" changed="not-changed"> <enum>(b)</enum> <header>Eligibility</header> <text display-inline="yes-display-inline">A covered employee is eligible for incident response premium pay under this section if— </text> <paragraph commented="no" display-inline="no-display-inline" id="H43A689D72DAE4BFD9C0E71DB00FF134E" changed="not-changed"> <enum>(1)</enum> <text display-inline="yes-display-inline">the covered employee is deployed to respond to a qualifying incident; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H86B6F80048D14BE8BD38DA8BA9CA994C" changed="not-changed"> <enum>(2)</enum> <text>the deployment described in paragraph (1) is—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H063D2EA8013F44998C2A4EC64E668277" changed="not-changed"> <enum>(A)</enum> <text display-inline="yes-display-inline">outside of the official duty station of the covered employee; or</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H22F49D798A9A4A389FF31B267AA30CEC" changed="not-changed"> <enum>(B)</enum> <text>within the official duty station of the covered employee and the covered employee is assigned to an incident-adjacent fire camp or other designated field location.</text> </subparagraph> </paragraph> </subsection> <subsection commented="no" display-inline="no-display-inline" id="H5E71D6263002469A94DCBD654FED10A7" changed="not-changed"> <enum>(c)</enum> <header>Entitlement to incident response premium pay</header> <paragraph commented="no" display-inline="no-display-inline" id="H41363AD2AD74479A8ACBC8EF7A617EF0" changed="not-changed"> <enum>(1)</enum> <header display-inline="yes-display-inline">In general</header> <text>A covered employee who satisfies the conditions under subsection (b) is entitled to premium pay for the period in which the covered employee is deployed to respond to the applicable qualifying incident. </text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H058F238ABCB74BFDB8FFA96AB5E825DD" changed="not-changed"> <enum>(2)</enum> <header>Computation</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H37EC9C73CED54988B05D273E49214637" changed="not-changed"> <enum>(A)</enum> <header display-inline="yes-display-inline">Formula</header> <text display-inline="yes-display-inline">Subject to subparagraphs (B) and (C), premium pay under paragraph (1) shall be paid to a covered employee at a daily rate of 450 percent of the hourly rate of basic pay of the covered employee for each day that the covered employee satisfies the requirements under subsection (b), rounded to the nearest whole cent. </text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6BFE6146FA444AAE9E7A1C25CD0EC486" changed="not-changed"> <enum>(B)</enum> <header>Limitation</header> <text>Premium pay under this subsection—</text> 
<clause commented="no" display-inline="no-display-inline" id="H55E270BF861746A9A70B7F35BD28072E" changed="not-changed"> <enum>(i)</enum> <text display-inline="yes-display-inline">with respect to a covered employee for whom the annual rate of basic pay is greater than that for step 10 of GS–10, shall be paid at the daily rate established under subparagraph (A) for the applicable rate for step 10 of GS–10 (where the applicable rate is the rate in effect in the same locality that is the basis for a locality-based comparability payment payable to the covered employee under section 5304); and</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H90D26D10FBAF41F88F5720FBF7798419" changed="not-changed"> <enum>(ii)</enum> <text>may not be paid to a covered employee in a total amount that exceeds $9,000 in any calendar year.</text> </clause> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2C9633A680E14E38BC7776367171167B" changed="not-changed"> <enum>(C)</enum> <header>Adjustments</header> 
<clause commented="no" display-inline="no-display-inline" id="H4CE32BE2E1964072A7D1305901FB3504" changed="not-changed"> <enum>(i)</enum> <header>Assessment</header> <text>The Secretary of Agriculture and the Secretary of the Interior shall assess the difference between the average total amount of compensation that was paid to covered employees, by grade, in fiscal years 2023 and 2024.</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H90536F5316A04C70AB88A93A21F21C78" changed="not-changed"> <enum>(ii)</enum> <header>Report</header> <text>Not later than 180 days after the date that is 1 year after the effective date of this section, the Secretary of Agriculture and the Secretary of the Interior shall jointly publish a report on the results of the assessment conducted under clause (i).</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H3C1850A71DD04613A0CFCF449A24D272" changed="not-changed"> <enum>(iii)</enum> <header>Administrative actions</header> <text>After publishing the report required under clause (ii), the Secretary of Agriculture and the Secretary of the Interior, in consultation with the Director of the Office of Personnel Management, may, in the sole and exclusive discretion of the Secretaries acting jointly, administratively adjust the amount of premium pay paid under this subsection (or take other administrative action) to ensure that the average annual amount of total compensation paid to covered employees, by grade, is more consistent with such amount that was paid to those employees in fiscal year 2023.</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H9BD1A04F2CAC462A8E43F5A05B61FA3D" changed="not-changed"> <enum>(iv)</enum> <header>Congressional notification</header> <text>Not later than 3 days after an adjustment made, or other administrative action taken, under clause (iii) becomes final, the Secretary of Agriculture and the Secretary of the Interior shall jointly submit to the appropriate committees of Congress a notification regarding that adjustment or other administrative action, as applicable.</text> </clause> </subparagraph> </paragraph> </subsection> 
<subsection id="HB31B00CE60AE40E488AF4A6AEE2222FB" changed="not-changed"> <enum>(d)</enum> <header>Treatment of incident response premium pay</header> <text>Incident response premium pay under this section—</text> <paragraph id="H541BD8E2AF574DF38757B0F10E89F630" changed="not-changed"> <enum>(1)</enum> <text>is not considered part of the basic pay of a covered employee for any purpose;</text> </paragraph> 
<paragraph id="H1835F811AA054281B6F48F91B70B05FA" changed="not-changed"> <enum>(2)</enum> <text>may not be considered in determining the lump-sum payment of a covered employee for accumulated and accrued annual leave under section 5551 or section 5552;</text> </paragraph> <paragraph id="H93A77A2628294BE688A469751BA81C6C" changed="not-changed"> <enum>(3)</enum> <text>may not be used in determining pay under section 8114;</text> </paragraph> 
<paragraph id="H9A6D7A41602D49D8965DC82A1ACBADA9" changed="not-changed"> <enum>(4)</enum> <text>may not be considered in determining pay for hours of paid leave or other paid time off during which the premium pay is not payable; and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE328BE7811684096B8A7B65579B0F648" changed="not-changed"> <enum>(5)</enum> <text display-inline="yes-display-inline">shall be disregarded in determining the minimum wage and overtime pay to which a covered employee is entitled under the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>).</text> </paragraph> </subsection> </section> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> 
<subsection id="HD54C8B3B44E540A99CDB3A37192B3F0E" changed="not-changed"> <enum>(b)</enum> <header>Additional premium pay amendments</header> <text>Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended—</text> <paragraph id="H807360466D6A4EC0B61B002ADD9D2A1C" changed="not-changed"> <enum>(1)</enum> <text>in section 5544—</text>

<subparagraph commented="no" display-inline="yes-display-inline" id="H7C8A2911AA514D71AAD2D222DD3FE686" changed="not-changed"> <enum>(A)</enum> <text>is a wildland firefighter, as defined in section 5332a(a); or</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="H900B9B86460041429A2FE34BD128E090" changed="not-changed"> <enum>(B)</enum> <text>is certified by the applicable agency to perform wildland fire incident-related duties during the period the employee is deployed to respond to a qualifying incident (as defined in section 5545c(a)).</text> </subparagraph> </paragraph> </subsection> <after-quoted-block>; and</after-quoted-block> </quoted-block> </subparagraph> </paragraph>

<subsection id="HC15BA0D89FD647A3A8B394E465F861ED" changed="not-changed"> <enum>(a)</enum> <header>Definitions</header> <text>In this section—</text> <paragraph id="HAE2E95DA871F4BC9BB24409DF6D6EA68" changed="not-changed"> <enum>(1)</enum> <text>the term <term>applicable Secretary</term> means the Secretary of Agriculture or the Secretary of the Interior, as applicable to a covered employee;</text> </paragraph> 
<paragraph id="HB650466968CB49E889686FC6C76F0AA3" changed="not-changed"> <enum>(2)</enum> <text>the term <term>covered employee</term> means an employee of the Forest Service or the Department of the Interior who—</text> <subparagraph id="H720504E9FA56491FACC2F1BFBA44F51E" changed="not-changed"> <enum>(A)</enum> <text>qualifies as a wildland firefighter based on the definitions of the terms <quote>firefighter</quote> and <quote>wildland firefighter</quote> in section 5332a(a) (applying the definition of <quote>employee</quote> in section 6301(2) in lieu of the definition of <quote>employee</quote> in section 5331(a)); or</text> </subparagraph> 
<subparagraph id="H3B86ADCF86584C0D88FA8C25594776CB" changed="not-changed"> <enum>(B)</enum> <text>is certified by the applicable Secretary to perform wildland fire incident-related duties during the period the employee is deployed to respond to a qualifying incident; and</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H7EC463F7040446ECBC0AF7D2ED326C34" changed="not-changed"> <enum>(3)</enum> <text>the term <term>qualifying incident</term> has the meaning given the term in section 5545c(a).</text> </paragraph> </subsection> 
<subsection id="H764B8AEADE7C41AF9E0FD6B73BFE938E" changed="not-changed"> <enum>(b)</enum> <header>Rest and recuperation leave</header> 
<paragraph id="H3191EEE945C640D38F044C22D4B90A8A" changed="not-changed"> <enum>(1)</enum> <header>In general</header> <text>A covered employee may receive paid rest and recuperation leave following the completion of service in which the covered employee is deployed to respond to a qualifying incident, subject to the policies prescribed under this subsection.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H83E5DD7A6CE54BFBB080C9183EDB3325" changed="not-changed"> <enum>(2)</enum> <header>Prescription of policies</header> <text display-inline="yes-display-inline">The Secretary of Agriculture and the Secretary of the Interior shall, in the sole and exclusive discretion of the Secretaries acting jointly, prescribe uniform policies described in paragraph (1) after consulting with the other applicable Secretary.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6BF3A8865355424E945319AE5FAC294A" changed="not-changed"> <enum>(3)</enum> <header>Content of policies</header> <text>The policies prescribed under paragraph (2) may include—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H1E5CEB7F241F4536A2AF32D93EDEA44C" changed="not-changed"> <enum>(A)</enum> <text display-inline="yes-display-inline">a maximum period of days in which a covered employee is deployed to respond to a qualifying incident, which shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="H238495393BF44BF5AF307AC64D38E79F" changed="not-changed"> <enum>(i)</enum> <text display-inline="yes-display-inline">begin on the date on which the covered employee departs from the official duty station of the covered employee and end on the date on which the covered employee returns to the official duty station of the covered employee; and</text> </clause> <clause commented="no" display-inline="no-display-inline" id="H1EF9E6BE026F42F6AA2B7680CCEA6ABE" changed="not-changed"> <enum>(ii)</enum> <text>be followed by a minimum number of days of rest and recuperation for the covered employee; or</text> </clause> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H403BD4767183444092BD9BBF18F69C3B" changed="not-changed"> <enum>(B)</enum> <text>a requirement that prohibits a covered employee from working more than 16 hours per day on average over a 14-day period during which the covered employee is deployed to respond to a qualifying incident.</text> </subparagraph> </paragraph> </subsection> <subsection id="H507D5BDA172043CBBEDBA6582F92C31C" changed="not-changed"> <enum>(c)</enum> <header>Use of leave</header> <paragraph commented="no" display-inline="no-display-inline" id="H41B9BFF9C1CC43FE8ECF9C6C304C8688" changed="not-changed"> <enum>(1)</enum> <header display-inline="yes-display-inline">In general</header> <text>Rest and recuperation leave granted under this section—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA2CDF7509E5342A5AA60D108705D3255" changed="not-changed"> <enum>(A)</enum> <text display-inline="yes-display-inline">shall be used during scheduled hours within the tour of duty of the applicable covered employee established for leave-charging purposes;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H4B03335A5A9A4D5AAE781B8DF9A66E79" changed="not-changed"> <enum>(B)</enum> <text display-inline="yes-display-inline">shall be paid in the same manner as annual leave;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF04BFF9A464A4A2BBEE507C71AB13D17" changed="not-changed"> <enum>(C)</enum> <text display-inline="yes-display-inline">shall be used immediately after a qualifying incident; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HABC86A914C25464C9A1F7766773CC525" changed="not-changed"> <enum>(D)</enum> <text display-inline="yes-display-inline">may not be set aside for later use.</text> </subparagraph> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB8E1304DC40B488FBF425607EE678C97" changed="not-changed"> <enum>(2)</enum> <header>No payment</header> <text display-inline="yes-display-inline">A covered employee may not receive any payment for unused rest and recuperation leave granted under this section.</text> </paragraph> </subsection> <subsection id="H52A3EB50133E42008AB1FC187C5A7D80" changed="not-changed"> <enum>(d)</enum> <header>Intermittent work schedule</header> <text>A covered employee with an intermittent work schedule—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H09E99584F8534FF5B43EEF9E96740447" changed="not-changed"> <enum>(1)</enum> <text display-inline="yes-display-inline">shall be excused from duty during the same period of time that other covered employees in the same circumstances are entitled to rest and recuperation leave; and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H76E7D5C264C8462FB395A67838B41977" changed="not-changed"> <enum>(2)</enum> <text display-inline="yes-display-inline">shall receive a payment as if the covered employee were entitled to rest and recuperation leave under subsection (b).</text> </paragraph> </subsection> </section> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection>

Rest and recuperation leave for employees engaged in wildland firefighting.</toc-entry> </toc> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> </section> <section id="HA78FB6FFE7E242A58A5928FB072CB493" changed="not-changed" section-type="section-one"> <enum>5.</enum> <header>Transfer authority</header> <text display-inline="no-display-inline">Notwithstanding section 40803(c)(2) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(c)(2)</external-xref>), not more than $5,000,000 of the unobligated balances of amounts made available under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Wildland Fire Management</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">Forest Service</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="OLC">Department of Agriculture</header-in-text></quote> in title VI of division J of that Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 1410) pursuant to section 40803(c)(2)(B) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(c)(2)(B)</external-xref>) may, as necessary to continue uninterrupted the Federal wildland firefighter base salary increase described in section 40803(d)(4)(B) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(d)(4)(B)</external-xref>), be transferred to and merged with the amounts made available under the heading <quote><header-in-text level="appropriations-small" style="OLC">Wildland Fire Management</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">Department-wide programs</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="OLC">Department of the Interior</header-in-text></quote> in title VI of division J of that Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 1393).</text> </section>
