<section id="H97DFBA0D7A6D4B93BA9913B34A44BE4B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Access to Care for Seniors in Critical Condition Act of 2025</short-title></quote>.</text></section> <section id="H272A0F5FAF984C5DB3B58B206449A54C"><enum>2.</enum><header>Establishing a new criterion for the nonapplication of site-neutral payments to long-term care hospitals under the Medicare program</header><text display-inline="no-display-inline">Section 1886(m)(6)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(m)(6)(A)</external-xref>) is amended—</text>
<paragraph id="H3AB2EBBA9A9C436CB8096E091D07F728"><enum>(1)</enum><text>in clause (ii)(I), by striking <quote>or the ventilator criterion under clause (iv)</quote> and inserting <quote>, the ventilator criterion under clause (iv), or the high acuity criterion described in clause (v)</quote>; and</text></paragraph> <paragraph id="H0468DD30BD814D7B8C39CD3237930475"><enum>(2)</enum><text>by adding at the end the following new clause:</text>

<clause id="H8708B289FB3B4AEF9893460C01C6D5E0"><enum>(v)</enum><header>High acuity criterion</header><text>The criterion specified in this clause (in this paragraph referred to as the <quote>high acuity criterion</quote>) for a discharge from a long-term care hospital in a fiscal year is that—</text> <subclause id="HA91AB9F6319745C7AF4D6FE9D2CC4524"><enum>(I)</enum><text display-inline="yes-display-inline">the discharge was assigned to a Medicare-Severity-Long-Term-Care-Diagnosis-Related-Group (MS-LTC-DRG) with a relative weight for such fiscal year that was equal to or greater than 0.8; and</text></subclause>
<subclause id="HAD89D1F712A047D2AC64BD1C87E46190"><enum>(II)</enum><text>the discharge occurred on or after October 1, 2026.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
