<section section-type="section-one" id="H522CD566554848138F844F37FACD7A90"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Farewell to Foam Act of 2025</short-title></quote>.</text></section> <section id="H8AEB3E13B2314FA1A6C2DBA9FC3A039C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H0279DFEE59D94088ADBD02FAA7F837B1"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> <paragraph id="HFA96DFCD6AD644FDBEA2B31A5A6B60BD"><enum>(2)</enum><header>Biological product</header><text>The term <term>biological product</term> has the meaning given the term in section 351(i) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262(i)</external-xref>).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HFA434345CC284A57BE2507CDE9DD8948"><enum>(3)</enum><header>Covered polystyrene foam ware</header><text>The term <term>covered polystyrene foam ware</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H4A5960F3D53F458AB292B18DB2BBF048"><enum>(A)</enum><text display-inline="yes-display-inline">an expanded polystyrene cooler;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H29E008FE3818494EB774E3503C97A164"><enum>(B)</enum><text>an expanded polystyrene food service ware; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE7CB446843D8428AAE11E59C7FD7B2F0"><enum>(C)</enum><text>expanded polystyrene loose fill.</text></subparagraph></paragraph>
<paragraph id="H5FC200A93BA245639629D12C3D45F8CD" commented="no"><enum>(4)</enum><header>Distributor</header><text display-inline="yes-display-inline">The term <term>distributor</term> means any person that distributes covered polystyrene foam ware that is sold or offered for sale in the United States.</text></paragraph> <paragraph id="HE783FC087C944D539EA872CA69A297D9"><enum>(5)</enum><header>Drug</header><text>The term <term>drug</term> has the meaning given the term in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text></paragraph>
<paragraph id="HAAEA13D1D19B4EA18E0A588A24C4E436"><enum>(6)</enum><header>Expanded polystyrene</header><text>The term <term>expanded polystyrene</term> means blown polystyrene and expanded or extruded foams that are thermoplastic petrochemical materials utilizing a styrene monomer and processed by any technique or combination of techniques, including fusion of polymer spheres (expandable bead polystyrene), injection molding, foam molding, and extrusion-blow molding (extruded foam polystyrene).</text></paragraph> <paragraph id="HA4326FEA2EC04910B3798A26CAA12EB2"><enum>(7)</enum><header>Expanded polystyrene cooler</header> <subparagraph commented="no" display-inline="no-display-inline" id="HE83C093E671B42E2A25D2C452D759E7C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>expanded polystyrene cooler</term> means a portable container made entirely or partially of expanded polystyrene that is designed or intended to be used for cold storage.</text></subparagraph>
<subparagraph id="HFF24469DC97C48508115A65FB5886C3B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>expanded polystyrene cooler</term> excludes portable containers intended to be used for drugs, medical devices, or biological products. </text></subparagraph></paragraph> <paragraph id="H57D7B105EC46410E9D76022F119E34B1"><enum>(8)</enum><header>Expanded polystyrene food service ware</header> <subparagraph commented="no" display-inline="no-display-inline" id="HE7E4BD3866704505A1C41DAEC5EE51F0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>expanded polystyrene food service ware</term> means a product made of expanded polystyrene that is—</text>
<clause id="H869497B73B744FFE812E31B6C320293A"><enum>(i)</enum><text>used for selling or providing food or beverages; and</text></clause> <clause id="HCE1C31C7E5E34964BD612DBC7317D654"><enum>(ii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="H65F8B35516404C9EB86ED4913DCE4BC2"><enum>(I)</enum><text>intended by the manufacturer to be used once for eating or drinking; or</text></subclause>
<subclause id="H5B3CE1BF1D2E4D629D35BEC62B7AD704" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">generally recognized by the public as an item to be discarded after 1 use.</text></subclause></clause></subparagraph> <subparagraph id="HA954B0C1632A45498A3D7EE3140CC801"><enum>(B)</enum><header>Inclusions</header><text>The term <term>expanded polystyrene food service ware</term> includes any product described in subparagraph (A) consisting of a bowl, plate, hot or cold beverage cup, lid, clamshell, tray, carton for eggs or other food, or any other item used for serving or containing prepared food, including takeout food and leftovers from partially consumed meals prepared by food vendors.</text></subparagraph></paragraph>
<paragraph id="H2046161D99844D9DBF01814D69276589"><enum>(9)</enum><header>Expanded polystyrene loose fill</header><text>The term <term>expanded polystyrene loose fill</term> means a void-filling packaging product made of expanded polystyrene foam that is used as a packaging fill (commonly referred to as <quote>packing peanuts</quote>).</text></paragraph> <paragraph id="HE14DA7DD52B14F3FB0B9D5815364A3E5"><enum>(10)</enum><header>Food service provider</header><text>The term <term>food service provider</term> means a person engaged in the business of selling or distributing prepared food or beverages for on-premise or off-premise consumption, including any—</text>
<subparagraph id="HF8D0DECBDD6242529F00F7E715F2F49C"><enum>(A)</enum><text>food service establishment, caterer, temporary food service establishment, mobile food service establishment, and pushcart;</text></subparagraph> <subparagraph id="H942446E32A4345E0A7493B45B3D471A3"><enum>(B)</enum><text>retail food store;</text></subparagraph>
<subparagraph id="H594D393FBBFB4B6A8C0D10ABEB20FEA5"><enum>(C)</enum><text>delicatessen;</text></subparagraph> <subparagraph id="H2CBFEA7ABF764453BB7244F3F0CE3889"><enum>(D)</enum><text>grocery store;</text></subparagraph>
<subparagraph id="H763FF26610A74EA6B01CD1D76D79E398"><enum>(E)</enum><text>restaurant;</text></subparagraph> <subparagraph id="H87D61F3476604E698B6B515E6321D887"><enum>(F)</enum><text>cafeteria;</text></subparagraph>
<subparagraph id="HF8124779C58B4FDF87D554A7623B376E"><enum>(G)</enum><text>coffee shop;</text></subparagraph> <subparagraph id="HCA3212EBFFA647BAABC7ACBEAC6869F4"><enum>(H)</enum><text>hospital, adult care facility, and nursing home; and</text></subparagraph>
<subparagraph id="H7FF8E9895E05454AB312D574716CFA0E"><enum>(I)</enum><text>elementary or secondary school, college, and university.</text></subparagraph></paragraph> <paragraph id="H23700F0A57764F06B7C223F85E2A6BB8"><enum>(11)</enum><header>Manufacturer</header><text display-inline="yes-display-inline">The term <term>manufacturer</term> means any person that manufactures or imports covered polystyrene foam ware that is sold, offered for sale, or distributed in the United States.</text></paragraph>
<paragraph id="H9F23B003A1714BE8A7D798B9F66E62E6"><enum>(12)</enum><header>Medical device</header><text display-inline="yes-display-inline">The term <term>medical device</term> has the meaning given the term <term>device</term> in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text></paragraph> <paragraph id="H73C85BB613B749AD92B6DEEA75410D2C"><enum>(13)</enum><header>Prepared food</header> <subparagraph commented="no" display-inline="no-display-inline" id="H3E2BF3E6BCF64303938793CF3E481EA6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>prepared food</term> means food or beverages that—</text>
<clause id="HE4289869948A460696EB1A525482C815"><enum>(i)</enum><text>are cooked, chopped, sliced, mixed, brewed, frozen, heated, squeezed, combined, or otherwise prepared on the premises of a food service provider for immediate consumption; and</text></clause> <clause id="HDA8F6714F6134C08BF5ACD061033AA3B"><enum>(ii)</enum><text>require no further preparation to be consumed.</text></clause></subparagraph>
<subparagraph id="HB0C0502197B2408B9AD46166DA719ED5"><enum>(B)</enum><header>Inclusion</header><text>The term <term>prepared food</term> includes ready-to-eat takeout foods and beverages described in subparagraph (A).</text></subparagraph></paragraph> <paragraph id="H7A178ABA8DED4D66BD0B073DC69238EE" commented="no" display-inline="no-display-inline"><enum>(14)</enum><header>Retailer</header><text display-inline="yes-display-inline">The term <term>retailer</term> means any person that sells, supplies, or offers to consumers covered polystyrene foam ware. </text></paragraph></section>
<section id="HBA5EAD101C01428C9EF88B8AB53C4694"><enum>3.</enum><header>Ban on expanded polystyrene food service ware, loose fill, and coolers</header>
<subsection id="HC100A769AC794160B61261CCF4B78F8E"><enum>(a)</enum><header>Expanded polystyrene food service ware</header><text display-inline="yes-display-inline">Beginning on January 1, 2028, no food service provider, manufacturer, distributor, or retailer shall sell, offer for sale, or distribute expanded polystyrene food service ware.</text></subsection> <subsection id="H6FE14195D02446A88F93299E997EFD84"><enum>(b)</enum><header>Expanded polystyrene loose fill and expanded polystyrene coolers</header><text display-inline="yes-display-inline">Beginning on January 1, 2028, no manufacturer, distributor, or retailer shall sell, offer for sale, or distribute expanded polystyrene loose fill or expanded polystyrene coolers.</text></subsection></section>
<section id="HBFFA22481D0643C2B6EB337C3FCA52E2"><enum>4.</enum><header>Enforcement</header>
<subsection id="HCC97446E9A5042568D7E03CFE919326E"><enum>(a)</enum><header>Written notification for first violation</header><text display-inline="yes-display-inline">If a food service provider, manufacturer, distributor, or retailer violates section 3, the Administrator shall provide that food service provider, manufacturer, distributor, or retailer with written notification regarding the violation.</text></subsection> <subsection id="H14883054FF5A4C1FA206A2AC90D3574A"><enum>(b)</enum><header>Subsequent violations</header> <paragraph id="HA4916F6D655147A7A323F3D3A4F0E780"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If a food service provider, manufacturer, distributor, or retailer, subsequent to receiving a written notification under subsection (a), violates section 3 again, the Administrator shall impose a civil penalty on the food service provider, manufacturer, distributor, or retailer in accordance with this subsection.</text></paragraph>
<paragraph id="H70797E66E68E4CA984468900E57544BE"><enum>(2)</enum><header>Amount of penalty</header><text>For each violation described in paragraph (1), the amount of the civil penalty under that paragraph shall be—</text> <subparagraph id="H21758F8E1AB24A72ACC875AC7E546C8C"><enum>(A)</enum><text>in the case of the second violation, $250;</text></subparagraph>
<subparagraph id="HDC1E3FC1F69B46B0B05888A0FF473674"><enum>(B)</enum><text>in the case of the third violation, $500; and</text></subparagraph> <subparagraph id="HD4A01313DF0642318CB3E670C9D6F67A"><enum>(C)</enum><text>in the case of the fourth, and any subsequent, violation, $1,000.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HCBE997BCE3FF4C2EA468035A94A06CA9"><enum>(3)</enum><header>Limitations</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HD8D87A9355444C5AB050DA3FBB376DA8"><enum>(A)</enum><header>Food service providers; retailers</header><text display-inline="yes-display-inline">In the case of a food service provider or retailer the annual revenue of which is less than $1,000,000, a penalty shall not be imposed under this subsection more than once during any 7-day period.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H5BF43D6EDC444132BDA3E5D6B61195B4"><enum>(B)</enum><header>Manufacturer; distributors</header><text>In the case of a manufacturer or distributor the annual revenue of which is less than $5,000,000, a penalty shall not be imposed under this subsection more than once during any 7-day period.</text></subparagraph></paragraph></subsection>
<subsection id="HED4D1216E1ED4490B67F3A0AF92D24D5"><enum>(c)</enum><header>State enforcement</header><text>The Administrator may permit a State to carry out enforcement under this section if the Administrator determines that the State meets such requirements as the Administrator may establish.</text></subsection></section> <section id="H3833C9C35A8E4DE6AFFD89F7788CD100"><enum>5.</enum><header>Regulations</header><text display-inline="no-display-inline">The Administrator may promulgate such regulations as the Administrator determines necessary to carry out this Act.</text></section>
