R. 1913</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250306">March 6, 2025</action-date><action-desc><sponsor name-id="C001137">Mr. Crank</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23, United States Code, to limit certain Federal funding to States that do not have a process to notify the Secretary of Homeland Security of the release from custody or detainment certain aliens under certain circumstances, and for other purposes.</official-title></form><legis-body id="H61399D6B8E51470788DDA0916395258A" style="OLC"><section id="H5852A5A6E9614046BB615531A7020B7A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blocking Lawless Open Border Cities and States</short-title><short-title> Act of 2025</short-title></quote> or the <quote><short-title>BLOC Act</short-title></quote>.</text></section><section id="H2C7168828CBE4B8882AE64556E743D3A"><enum>2.</enum><header>Ineligibility of sanctuary jurisdictions for certain Federal funds</header><subsection id="HFA9BA7FA72AB42E4BED441B2C7E27F52"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/6">Chapter 6</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H9073045A2C72426CB784453B1B954BA1" display-inline="no-display-inline"><section id="HCAD9B01C38A84F639033663B9429D91F"><enum>612.</enum><header>Ineligibility of sanctuary jurisdictions for certain Federal funds</header><subsection id="H1FA5129E87FA41BDAF498E02118E375E" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation shall not obligate or award funds for any infrastructure project, including for highway construction, to a political subdivision of a State, nor shall any funds obligated or awarded to a State, go to any political subdivision of a State that does not have in effect not later than 1 year after the date of enactment of the BLOC Act a statute, ordinance, policy, or practice requiring an entity or official of such political subdivision to notify the Secretary of Homeland Security (or designee thereof) not later than 48 hours before of the release from custody or detainment of an alien if—</text><paragraph id="HF25AEDC7893142F8BCCC9A6B60437A63" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security (or designee thereof) has determined that such alien is not lawfully present in the United States;</text></paragraph><paragraph id="H26FB2814CC2C43BB83AAC9EEA2306E5A" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 48 hours before such release, the Secretary of Homeland Security (or designee thereof) has notified the sheriff or detaining entity of such State or political subdivision of the legal status of such alien; and</text></paragraph><paragraph id="H70266682EFA0421AA76B861A7AA93CDB" commented="no"><enum>(3)</enum><text>such alien has been in custody or detainment for not less than 48 hours before such release. </text></paragraph></subsection><subsection id="HBC2C9F80E5674C959C48734D78DD05BD"><enum>(b)</enum><header>Definition of infrastructure project</header><text display-inline="yes-display-inline">In this section, the term <term>infrastructure project</term> has the meaning given such term in section 184.3 of title 2, Code of Federal Regulations (as in effect on the date of enactment of the BLOC Act). </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB9BE56BB3A534E8E9796E61BBB79DBE4"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/6">chapter 6</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HEC051702094F47D591533A8871FE0A29" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">612.
