R. 1907</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250306">March 6, 2025</action-date><action-desc><sponsor name-id="B001309">Mr. Burchett</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To allow an individual to shoot an unmanned aircraft flying over property owned by the individual under certain circumstances, and for other purposes.</official-title></form><legis-body id="H599893ABE2204B218D34A4BDAFB79C5C" style="OLC"><section id="H992A881BE16B4877B94E51DCEAAE388A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defense Against Drones Act of 2025</short-title></quote>.</text></section><section id="HEF7653C97B3849ECB8EECA0ACC451249"><enum>2.</enum><header>Protection of private property from unmanned aircraft</header><subsection id="H3BF7254AFA54484CBE88CAC254A6CE06"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/448">Chapter 448</external-xref> of title 49, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="HDB8E29DBD1574D38904FE286322BE8B0" display-inline="no-display-inline"><section id="HFDDB5F383B2A4953B2AFBFBD7E072C7D"><enum>44815.</enum><header>Protection of private property from unmanned aircraft</header><subsection id="HA9A00B85F3FA486EB3E34D4E348F48CB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to applicable State law relating to the discharge of a firearm, an individual may shoot an unmanned aircraft using a legally obtained shotgun if the individual reasonably believes that such aircraft is flying not more than 200 feet above property owned by the individual.</text></subsection><subsection id="HD918B300FC994616AB8487DFACD19228"><enum>(b)</enum><header>Return of aircraft</header><text>An individual may, but shall not be required to, return an unmanned aircraft shot down under subsection (a) to the owner of such aircraft upon request by such owner.</text></subsection><subsection id="HE9B56A3CD4BD4C6EA6BCF27CB9BA65DF" commented="no"><enum>(c)</enum><header>Reporting</header><text>Not later than 60 days after an event in which an individual shoots an unmanned aircraft under subsection (a) and is able to identify the registration number of such aircraft, the individual shall report to the Administrator of the Federal Aviation Administration—</text><paragraph id="H217BA1A85F404C9DAC49A70EF1B45724" commented="no"><enum>(1)</enum><text>the address at which such event occurred; and</text></paragraph><paragraph id="H02D672FF30D44CF8B9CA0C180987FBC1" commented="no"><enum>(2)</enum><text>such registration number.</text></paragraph></subsection><subsection id="HD81370D726C2415AA7463E1379B0B084"><enum>(d)</enum><header>Regulations</header><text>The Administrator shall issue such regulations as are necessary to carry out this section. </text></subsection><subsection id="H7DCE6956AB8542098D12DE595D9B3BF4" commented="no"><enum>(e)</enum><header>Definition of shotgun</header><text>In this section, the term <term>shotgun</term> has the meaning given such term in section 921 of title 18, United States Code.</text></subsection><subsection id="HC62180DFEE824613AB50B4F33557B67D"><enum>(f)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to preempt or otherwise have any effect on any State law relating to tort liability or criminal liability for an action taken under subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H285699B5F6204620A41B0C49F946F39C"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/448">chapter 448</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H2E27F04414F2490AA538D8AC2FE057F2" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">44815. Protection of private property from unmanned aircraft.</toc-entry></toc><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section></legis-body></bill>
