<section id="H8C2DD7B0B1C44838A1EAB7D221896A7D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children’s Health Insurance Program Permanency Act</short-title></quote> or the <quote><short-title>CHIPP Act</short-title></quote>.</text></section> <section id="H3461BCCFD2BD48DE9FF088E03AB07B44"><enum>2.</enum><header>Permanent extension of children’s health insurance program</header> <subsection id="HE19E16EAF7764E4BB1E7F669495C0F8D"><enum>(a)</enum><header>In general</header><text>Section 2104(a)(28) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397dd">42 U.S.C. 1397dd(a)(28)</external-xref>) is amended to read as follows:</text>

<paragraph id="HF50BE8CBBDFF4A6CA2C130FEBD129EE1"><enum>(28)</enum><text>for fiscal year 2029 and each subsequent year, such sums as are necessary to fund allotments to States under subsections (c) and (m).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H0C6D59B6C3A3444C86CF4D4101D89DD8"><enum>(b)</enum><header>Allotments</header> <paragraph id="HC3C230083E744B5C8A8D0A97E77D1D45"><enum>(1)</enum><header>In general</header><text>Section 2104(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397dd">42 U.S.C. 1397dd(m)</external-xref>) is amended—</text> 
<subparagraph id="H3A6C6C6081EF40338A79FB3EEF3BCC3F"><enum>(A)</enum><text>in paragraph (2)(B)(i), by striking <quote>, 2023, and 2029</quote> and inserting <quote>and 2023</quote>;</text></subparagraph> <subparagraph id="H803CE35533164386BB1FEF7B945C4413"><enum>(B)</enum><text>in paragraph (5)—</text> 
<clause id="HEA9C08BB46A34D38A8C5BE6E0C4FB561"><enum>(i)</enum><text>by striking <quote>for a fiscal year</quote> and inserting <quote>for a fiscal year before 2029</quote>; and</text></clause> <clause id="HAADCC06A978A48898263227576D3FD0F"><enum>(ii)</enum><text>by striking <quote>2023, or 2029</quote> and inserting <quote>or 2023</quote>;</text></clause></subparagraph> 
<subparagraph id="H8455545C1ACF4E668D81A1D24CCA1DCC"><enum>(C)</enum><text>in paragraph (7)—</text> <clause id="HB8492829349F4509B9991397B2EBF2E5"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>and ending with fiscal year 2029,</quote>; and</text></clause> 
<clause id="H1FB4BDD3306D40EA9D326EF245E6AF6C"><enum>(ii)</enum><text>in the flush left matter at the end, by striking <quote>or fiscal year 2028</quote> and inserting <quote>fiscal year 2028, or a subsequent even-numbered fiscal year</quote>;</text></clause></subparagraph> <subparagraph id="H7E81A8B6F9BC4524B413A34F5D39D153"><enum>(D)</enum><text>in paragraph (9)—</text>

<subparagraph id="H7AA03291546C4EBFA5EF2032BA621E04"><enum>(E)</enum><text>by striking paragraph (11).</text></subparagraph></paragraph> <paragraph id="HBD7CC7F8FBC84B95955DC582B97BB0DD"><enum>(2)</enum><header>Conforming amendment</header><text>Section 50101(b)(2) of the Bipartisan Budget Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/123">Public Law 115–123</external-xref>) is repealed.</text></paragraph></subsection></section> 
<section id="HE7D50F1DE3D84B8AB51EB5D3E1C090DF"><enum>3.</enum><header>Permanent extensions of other programs and demonstration projects</header> 
<subsection id="HE64597DE72A94D07B3B4224AF707095D"><enum>(a)</enum><header>Pediatric quality measures program</header><text>Section 1139A(i)(1) of the Social Security Act (42 U.S.C. 1320b–9a(i)(1)) is amended—</text> <paragraph id="HE7F58322E4E6429EB4AA88E660C71062"><enum>(1)</enum><text>in subparagraph (D), by striking at the end <quote>and</quote>;</text></paragraph> 
<paragraph id="H24E25BB1A5614D7F9CAA737E8343BA25"><enum>(2)</enum><text>in subparagraph (E), by striking the period at the end and insert a semicolon; and</text></paragraph> <paragraph id="H7D08DF5ED1AB466684CE85FCF67E1A06"><enum>(3)</enum><text>by adding at the end the following new subparagraphs:</text> 
<quoted-block id="H49533141F61E40F7AA11C5C506963E3D" style="OLC"> 
<subparagraph id="HB2A82E6C304343EBBB02197EEE8E3D19"><enum>(E)</enum><text>for fiscal year 2030, $15,000,000 for the purpose of carrying out this section (other than subsections (e), (f), and (g)); and</text></subparagraph> <subparagraph id="HBBCC6A7CBE0A45DFA84793EC231D628B"><enum>(F)</enum><text>for a subsequent fiscal year, the amount appropriated under this paragraph for the previous fiscal year, increased by the percentage increase in the consumer price index for all urban consumers (all items; United States city average) over such previous fiscal year, for the purpose of carrying out this section (other than subsections (e), (f), and (g)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HABC17A871A754A1ABC8B22A616756AC5"><enum>(b)</enum><header>Express lane eligibility option</header><text>Section 1902(e)(13) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(13)</external-xref>) is amended by striking subparagraph (I).</text></subsection> <subsection id="H5249489FB057407B9C78046D5618F658"><enum>(c)</enum><header>Assurance of affordability standard for children and families</header> <paragraph id="HE7324B883BEC46518CB827A576E988B9"><enum>(1)</enum><header>In general</header><text>Section 2105(d)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ee">42 U.S.C. 1397ee(d)(3)</external-xref>) is amended—</text> 
<subparagraph id="H6E0033BFDABC4AC2B2B9254361F928FF"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">through September 30, 2029</header-in-text></quote>; and</text></subparagraph> <subparagraph id="H91719487CA594DBEA779BDCB17139823"><enum>(B)</enum><text>in subparagraph (A), in the matter preceding clause (i)—</text> 
<clause id="HD3F035FD4CC245B3A1EF021F6B362705"><enum>(i)</enum><text>by striking <quote>During the period that begins on the date of enactment of the Patient Protection and Affordable Care Act and ends on September 30, 2029</quote> and inserting <quote>Beginning on the date of the enactment of the Patient Protection and Affordable Care Act</quote>;</text></clause> <clause id="H45EAA8F74C1D4B13B0E4073BA60FEB90"><enum>(ii)</enum><text>by striking <quote>During the period that begins on October 1, 2019, and ends on September 30, 2029</quote> and inserting <quote>Beginning on October 1, 2019</quote>; and</text></clause> 
<clause id="H713360E838804596960D36D6377F295A"><enum>(iii)</enum><text>by striking <quote>The preceding sentences shall not be construed as preventing a State during any such periods from</quote> and inserting <quote>The preceding sentences shall not be construed as preventing a State from</quote>.</text></clause></subparagraph></paragraph> <paragraph id="HBCA7A81A4E3649F592A663C647717B00"><enum>(2)</enum><header>Conforming amendments</header><text>Section 1902(gg)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(gg)(2)</external-xref>) is amended—</text> 
<subparagraph id="H5C530FC315DF42A38649E0F995BCE7AB"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">through September 30, 2029</header-in-text></quote>; and</text></subparagraph> <subparagraph id="HABC9D9FF9FBC4AB995AC88B785B359DE"><enum>(B)</enum><text>by striking <quote>through September 30</quote> and all that follows through <quote>ends on September 30, 2029</quote> and inserting <quote>(but beginning on October 1, 2019,)</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HBDA3FB87C4934682BEF5C83C998EEE3A"><enum>(d)</enum><header>Qualifying States option</header><text>Section 2105(g)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ee">42 U.S.C. 1397ee(g)(4)</external-xref>) is amended—</text> <paragraph id="HE9CA3890E95443A59B6FA786150F3500"><enum>(1)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">for fiscal years 2009 through 2029</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">after fiscal year 2008</header-in-text></quote>; and</text></paragraph> 
<paragraph id="H413785AA1D5C47B58B3670D64E7142B7"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>for any of fiscal years 2009 through 2029</quote> and inserting <quote>for any fiscal year after fiscal year 2008</quote>.</text></paragraph></subsection> <subsection id="HD49981682D8E44C58BA0DB01A9EF4401"><enum>(e)</enum><header>Outreach and enrollment program</header><text>Section 2113 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397mm">42 U.S.C. 1397mm</external-xref>) is amended—</text> 
<paragraph id="HB72B2FC1895D4195B4E93272758C73AF"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="HD11907215C59474683F426DF578A762A"><enum>(A)</enum><text>in paragraph (1), by striking <quote>during the period of fiscal years 2009 through 2029</quote> and inserting <quote>, beginning with fiscal year 2009,</quote>;</text></subparagraph> 
<subparagraph id="H3ED514D82BCA4D98935289A2CE9D69B5"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="H0B57F95DFF06418680FA5A9771D0CFD8"><enum>(i)</enum><text>by striking <quote>10 percent of such amounts</quote> and inserting <quote>10 percent of such amounts for the period or the fiscal year for which such amounts are appropriated</quote>; and</text></clause> 
<clause id="HCACA7A2605DB4548A597F70E00B5A7E8"><enum>(ii)</enum><text>by striking <quote>during such period</quote> and inserting <quote>, during such period or such fiscal year,</quote>; and</text></clause></subparagraph> <subparagraph id="H40D82ED4F0484F51B7A3B2E1F2A61EDF"><enum>(C)</enum><text>in paragraph (3), by striking <quote>For the period of fiscal years 2024 through 2029, an amount equal to 10 percent of such amounts</quote> and inserting <quote>Beginning with fiscal year 2024, an amount equal to 10 percent of such amounts for the period or the fiscal year for which such amounts are appropriated</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HD90EF8CA003D4968AFC932B9A800E724"><enum>(2)</enum><text>in subsection (g)—</text> <subparagraph id="H7B9DAB651C5C43958C7F2ABFCE4C34E7"><enum>(A)</enum><text>by striking <quote>and $40,000,000</quote> and inserting <quote>$40,000,000</quote>; and</text></subparagraph> 
<subparagraph id="H05533B0CE7CF483FA6EA6DD78E29D12C"><enum>(B)</enum><text>by inserting after <quote>and 2029</quote> the following: <quote>, $12,000,000 for fiscal year 2030, and, for each fiscal year after fiscal year 2030, the amount appropriated under this subsection for the previous fiscal year, increased by the percentage increase in the consumer price index for all urban consumers (all items; United States city average) over such previous fiscal year</quote>.</text></subparagraph></paragraph></subsection> <subsection id="H0B4A842968FD4905972A4CB070A88DF5"><enum>(f)</enum><header>Child enrollment contingency fund</header><text>Section 2104(n) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397dd">42 U.S.C. 1397dd(n)</external-xref>) is amended—</text> 
<paragraph id="H785D5289B3D545C0B6EB7733EBE66B3F"><enum>(1)</enum><text>in paragraph (2)—</text> <subparagraph id="H6A2EA40E0DE3487A9EEA253879B6B912"><enum>(A)</enum><text>in subparagraph (A)(ii)—</text> 
<clause id="HFC84F724DDFB4F42ACF65663F25AC87A"><enum>(i)</enum><text>by striking <quote>and 2024 through 2028</quote> and inserting <quote>beginning with fiscal year 2024</quote>; and</text></clause> <clause id="HFF4B73A99D97496A85E5B7B1EECF67B3"><enum>(ii)</enum><text>by striking <quote>2023, and 2029</quote> and inserting <quote>, and 2023</quote>; and</text></clause></subparagraph> 
<subparagraph id="HDAE7451780514F329AA9C60F11B42041"><enum>(B)</enum><text>in subparagraph (B)—</text> <clause id="H4C40BD599FA0493DBDA17250CAE79F2C"><enum>(i)</enum><text>by striking <quote>2024 through 2028</quote> and inserting <quote>beginning with fiscal year 2024</quote>; and</text></clause> 
<clause id="H46EFDA6E115E41F5BB547BDFBEA97F86"><enum>(ii)</enum><text>by striking <quote>2023, and 2029</quote> and inserting <quote>, and 2023</quote>; and</text></clause></subparagraph></paragraph> <paragraph id="HA5C9CD5F6F7E4069AFA2759467F59ADC"><enum>(2)</enum><text>in paragraph (3)(A)—</text> 
<subparagraph id="H285035BD089842F799CF33DA626B6053"><enum>(A)</enum><text>by striking <quote>fiscal years 2024 through 2028</quote> and inserting <quote>fiscal year 2024 or any subsequent fiscal year</quote>; and</text></subparagraph> <subparagraph id="H11E2C7FCBDC6494893C96F8401779ACF"><enum>(B)</enum><text>by striking <quote>2023, or 2029</quote> and inserting <quote>, or 2023</quote>.</text></subparagraph></paragraph></subsection></section> 
<section id="HB5BE958FA00B4F9087200308F64928F0"><enum>4.</enum><header>State option to increase children’s eligibility for medicaid and chip</header><text display-inline="no-display-inline">Section 2110(b)(1)(B)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397jj">42 U.S.C. 1397jj(b)(1)(B)(ii)</external-xref>) is amended—</text> <paragraph id="HD823F122B82E4FBCBB8375463A97309A"><enum>(1)</enum><text>in subclause (II), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H717400CEF01644C8893E53A99B5E3F89"><enum>(2)</enum><text>in subclause (III), by striking <quote>and</quote> at the end and inserting <quote>or</quote>; and</text></paragraph> <paragraph id="HE7A3FF612C45450D9463CCFD5021A10E"><enum>(3)</enum><text>by inserting after subclause (III) the following new subclause:</text>
