Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc" parsable-cite="usc/26/45Q">section 45Q</external-xref> of the Internal Revenue Code of 1986 to establish the mine methane capture incentive credit.</official-title></form><legis-body id="H1C85AA902D8644FA968FA5DCCB045953" style="OLC"><section id="H88AAC3572F5B46F7887761BA2F2B5182" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Methane Reduction and Economic Growth Act</short-title></quote>.</text></section><section id="HB4AD061320F44AE59A0887C0C7820CB1"><enum>2.</enum><header>Mine methane capture incentive credit</header><subsection id="H8D8A6CA1821B4AD8BCBC4273B964178E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/45Q">Section 45Q(f)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph: </text><quoted-block style="OLC" id="H643CF529F649403F84B0ABC6FAEAB4F1" display-inline="no-display-inline"><paragraph id="H26D1FA5EE2194B3FA4EB5DD8FCFA74B9"><enum>(10)</enum><header>Methane capture</header><subparagraph id="H7FFB5EC9CB9A4D01A112FAF39C2CCDDC"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of qualified methane—</text><clause id="H199C399ADA8D44AC9FB7602CABD99AE5"><enum>(i)</enum><text display-inline="yes-display-inline">paragraph (4) of subsection (a) shall be applied—</text><subclause id="HB57D5C0235DB483398906B4ACE3248CD"><enum>(I)</enum><text>by substituting <quote>per metric ton of CO2e (as defined in section 45Z(d)(2)) of qualified methane</quote> for <quote>per metric ton of qualified carbon oxide</quote>,</text></subclause><subclause id="HB8DBE2F346DD4CD385325343542A11FD"><enum>(II)</enum><text display-inline="yes-display-inline">by substituting <quote>methane capture equipment</quote> for <quote>carbon capture equipment</quote>, and</text></subclause><subclause id="H5B0436E5441245B58AE5256E922875B0"><enum>(III)</enum><text display-inline="yes-display-inline">by applying the following in lieu of subparagraph (B) thereof:</text><quoted-block style="OLC" id="H0AF628EE6B9946459111CE89FAE1C885" display-inline="no-display-inline"><subparagraph id="H6F8784EE5C004D8385A34F23C228071C"><enum>(B)</enum><text display-inline="yes-display-inline">either—</text><clause id="HA68230C3E9CA49E0AD5E1395D850C10D"><enum>(i)</enum><text display-inline="yes-display-inline">injected by the taxpayer for energy use—</text><subclause id="H03C2E1D4E8294CBA9FF27FF87187039B"><enum>(I)</enum><text>in a pipeline which satisfies the pipeline integrity management guidelines of section 192 of title 49, Code of Federal Regulations, and is in compliance with instrumental leak monitoring and other preventive and mitigative measures under section 192.935 of title 49, Code of Federal Regulations, or</text></subclause><subclause id="HA1B20800CA954252AAC18950A9A81A95"><enum>(II)</enum><text>in a gathering system that feeds a pipeline described in subclause (I), or </text></subclause></clause><clause id="HEFD69D3734F540DD845C58099ADA67BE"><enum>(ii)</enum><text>otherwise used for producing heat (for industrial use or to heat a structure) or other energy, in a manner that does not involve more than de-minimis release of methane into the atmosphere' for ‘used by the taxpayer as a tertiary injectant in a qualified enhanced oil or natural gas recovery project and disposed of by the taxpayer in secure geological storage',</text></clause></subparagraph><after-quoted-block>,</after-quoted-block></quoted-block></subclause></clause><clause id="H635DAC744EDE46B2A1F0CEF0298A44A5"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <quote>qualified facility</quote> shall mean any individual source of qualified methane such as borehole, well, or vent shaft constructed at a mining facility—</text><subclause id="HF5DF0C82F12740438ABFAD34B8AC03CF"><enum>(I)</enum><text>the construction of which begins before January 1, 2036,</text></subclause><subclause id="H4D71C13A1AC74D32BD0384BD55DC58D1"><enum>(II)</enum><text>for which construction of methane capture equipment begins before such date, and</text></subclause><subclause id="H6D97ED7209BA474E9B96CB186BF061B9"><enum>(III)</enum><text>which captures not less than 2,500 metric tons of CO2e methane during the taxable year, and</text></subclause></clause><clause id="HBE1E16CA9940461EA73F571A6ECBF25A"><enum>(iii)</enum><text display-inline="yes-display-inline">this section shall be applied by substituting <quote>methane capture</quote> for <quote>carbon capture</quote> and <quote>qualified methane</quote> for <quote>qualified carbon oxide</quote> in subsections (b)(2), (f)(1), (f)(4), (h), and (i)(1).</text></clause></subparagraph><subparagraph id="H0AF5E9FB8F414F38A1938BA732271A72"><enum>(B)</enum><header>Qualified methane defined</header><text>For purposes of this paragraph, the term <quote>qualified methane</quote> means any methane which—</text><clause id="HEA9E5283B144418CB6C9AE1175D31CE0"><enum>(i)</enum><text display-inline="yes-display-inline">is captured from mining activities, including underground mines, abandoned or closed mines, or surface mines, by methane capture equipment, </text></clause><clause id="HAF844CCBECDA4CD28AE39926623016F9"><enum>(ii)</enum><text>would otherwise be released into the atmosphere as industrial emission of greenhouse gas or lead to such release, and </text></clause><clause id="H390BA46907394E31BA6BF9F12A96386B"><enum>(iii)</enum><text>is measured at the source of capture and verified at the point of injection or utilization.</text></clause></subparagraph><subparagraph id="HA7DDF06AF07742908594AD99D5CF1B2F"><enum>(C)</enum><header>Methane capture equipment defined</header><text display-inline="yes-display-inline"> For purposes of this paragraph, the term ‘methane capture equipment’ means equipment built to connect a qualified facility to—</text><clause id="H93C9BD816C744F75A0BB096F1AC89F3A"><enum>(i)</enum><text>a preexisting or new pipeline system, or</text></clause><clause id="HB0EB7747814D42E88C0FFE685B54ADF7"><enum>(ii)</enum><text>to energy generation equipment, to capture qualified methane from such source.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H41D4B39E5677421296C62924B3E8FCBC"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to qualified methane captured after December 31, 2024.</text></subsection></section></legis-body></bill>
