<section id="H0649ECB9E9444EEA9622E678B1EAAB68" section-type="section-one"><enum>1.</enum><header>Conclusive presumption for certain activities</header><text display-inline="no-display-inline">Section 307 of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1456">16 U.S.C. 1456</external-xref>) is amended by adding at the end:</text> <quoted-block style="OLC" id="HE98C7D5451D540498F76080089DD6738" display-inline="no-display-inline"> <subsection id="H9E2769BB2F434768B399DA313D3A1D45"><enum>(j)</enum><header>Conclusive presumption for certain activities</header> <paragraph id="H01718C7015EE45BB902519EDCF5AF4FA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), with respect to a covered activity, a coastal state shall be conclusively presumed to concur with—</text> 
<subparagraph id="H76B09020FB3241F5998DE38A5140CB18"><enum>(A)</enum><text>a consistency determination provided to the coastal state by a Federal agency under subsection (c)(1)(C);</text></subparagraph> <subparagraph id="H78DE3F45AA7E4BAD9488709CC97A314F"><enum>(B)</enum><text>a determination or other finding of a Federal agency under subsection (c)(2) that a development project in the coastal zone of the coastal state is consistent with the enforceable policies of the approved state management program of the coastal state;</text></subparagraph> 
<subparagraph id="H8F3A03E4EDCC4CF79724CDDA1A7A44B3"><enum>(C)</enum><text>a certification provided to the coastal state by an applicant under subsection (c)(3)(A) or person under subsection (c)(3)(B); and</text></subparagraph> <subparagraph id="H80655A6A14DF47F6B5175101BE8157AC"><enum>(D)</enum><text>a determination or other finding of a State or local government under subsection (d) that an application for Federal assistance submitted by such State or local government is consistent with the enforceable policies of the approved state management program of the coastal state.</text> </subparagraph> </paragraph> 
<paragraph id="H2A2904E270BD46B9BC16AA002BF57DCD" commented="no"><enum>(2)</enum><header>Limitation on objection</header><text display-inline="yes-display-inline">An objection or other challenge by a coastal state to an activity subject to a conclusive presumption of concurrence under paragraph (1) may not delay or otherwise prevent the activity from proceeding.</text></paragraph> <paragraph id="H7499E12B89AB495AB72EA8A889B4DED8"><enum>(3)</enum><header>Review of presumptive concurrence</header> <subparagraph id="HF37D3B649ADA488C863F7000472E1ECB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the Secretary receives a consistency determination, certification, or other relevant finding under this section, the Secretary may issue a written determination with respect to an activity subject to a conclusive presumption of concurrence under paragraph (1) that nullifies the conclusive presumption of concurrence if the Secretary finds that the activity is not a covered activity. </text></subparagraph> 
<subparagraph id="H8578BF2D43A84578BFD5A1A84B28129F"><enum>(B)</enum><header>Presumption of finality</header><text>If the Secretary does not issue a written determination under subparagraph (A) with respect to an activity subject to a conclusive presumption of concurrence under paragraph (1) within the time period described in that subparagraph, the conclusive presumption of concurrence shall be final and binding.</text></subparagraph></paragraph> <paragraph id="H80C77E53113D4071A407C17F073D797F"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="HC287CB5007934DE98C30CFDC8FF7B571" commented="no"><enum>(A)</enum><header>Activity with a significant national or regional economic impact</header><text display-inline="yes-display-inline">The term <quote>activity with a significant national or regional economic impact</quote> means an activity—</text> <clause id="H66651F4A6175464E915F72F1EA811E30" commented="no"><enum>(i)</enum><text>that is authorized or funded in whole or in part by the Federal Government; and</text></clause> 
<clause id="H798702B099034829A0C2728EDB7829AC" commented="no"><enum>(ii)</enum><text>that is carried out in—</text> <subclause id="H74A7E937A6D04D47860BE4AD465F68ED" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">an area with a low per capita income; or</text></subclause> 
<subclause id="HD9AFAE8A26124DB0952A7B7CD51893F8" commented="no"><enum>(II)</enum><text>an area with a high unemployment rate.</text></subclause></clause></subparagraph> <subparagraph id="H8A67DB3D0A5041469FA17C0FA768738E"><enum>(B)</enum><header>Area with a high unemployment rate</header><text display-inline="yes-display-inline">The term <quote>area with a high unemployment rate</quote> means an area where the unemployment rate, for the most recent 24-month period for which data is available, is at least 1 percentage point higher than the national average unemployment rate for such period, as determined by the Secretary using the most recent data available from—</text> 
<clause id="H0FB82840FA7543A196624B87AD090363" commented="no"><enum>(i)</enum><text>the Bureau of Economic Analysis of the Department of Commerce;</text></clause> <clause id="H233B79ACED314DD1B1F735A7AF36079D"><enum>(ii)</enum><text>the Bureau of Labor Statistics of the Department of Labor;</text></clause> 
<clause id="H17499C4B4310443CB681A4DABCD9C5C9"><enum>(iii)</enum><text>another Federal source the Secretary determines appropriate; or</text></clause> <clause id="HBD6726E6498F40C282AE2406CB59FF54"><enum>(iv)</enum><text>if no recent Federal data is available, data from the State agencies of such area the Secretary determines appropriate.</text></clause></subparagraph> 
<subparagraph id="H3B56A42D86764D5E8E2964ADEA97FA7F"><enum>(C)</enum><header>Area with a low per capita income</header><text display-inline="yes-display-inline">The term <quote>area with low per capita income</quote> means an area where the per capita income is not more than 20 percent less than the national average per capita income, as determined by the Secretary using the most recent data available from—</text> <clause id="H46F74F8204D04CBF8531057FF84195D3"><enum>(i)</enum><text>the Bureau of Economic Analysis of the Department of Commerce; or</text></clause> 
<clause id="HE5B275B3CC6348B195C7A1BC6867901E"><enum>(ii)</enum><text>another Federal source the Secretary determines appropriate.</text></clause></subparagraph> <subparagraph id="H470D25172AB04A9AA130932F011E9150"><enum>(D)</enum><header>Covered activity</header><text>The term <quote>covered activity</quote> means—</text> 
<clause id="H9B505E69293B4F79B6DF023971D10FC1" display-inline="no-display-inline"><enum>(i)</enum><text>a national security activity;</text></clause> <clause id="H9D07FA0EB1A14AEDB72441968F4407A0"><enum>(ii)</enum><text>a critical infrastructure project;</text></clause> 
<clause id="HE190CED0F27B4DF9935A6E4CE01EADBF"><enum>(iii)</enum><text>a disaster recovery or mitigation activity; or</text></clause> <clause id="HA6651EED45F34AE490F7B843ECFAC3C4"><enum>(iv)</enum><text>an activity with a significant national or regional economic impact.</text></clause></subparagraph> 
<subparagraph id="H78B256E57D0743EB96BAFBFA73F6B3DE"><enum>(E)</enum><header>Critical infrastructure</header><text display-inline="yes-display-inline">The term <quote>critical infrastructure</quote> has the meaning given the term in section 1016(e) of the USA PATRIOT Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c(e)</external-xref>).</text> </subparagraph> <subparagraph id="H773049115CD843EA99D090164DD936BE"><enum>(F)</enum><header>Critical infrastructure project</header><text>The term <quote>critical infrastructure project</quote> means any project—</text> 
<clause id="H4F405CAEA31C4A3EB5A6A100483DF781" commented="no"><enum>(i)</enum><text>that is authorized or funded in whole or in part by the Federal Government; and</text></clause> <clause id="HDDEA44E6822343D5ACD9AB385EC2B49D" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">that involves—</text> 
<subclause id="H9A0F1B399A2048E2B3A5EBFA9358E220" commented="no"><enum>(I)</enum><text>the planning, construction, maintenance, or improvement of critical infrastructure; </text></subclause> <subclause id="H8D7EB160A2194266B69243929DFF3770" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">a facility or an activity associated with any critical infrastructure sectors; or</text></subclause> 
<subclause id="H9ED81030E3AD40D2817F02D3BD68CCBC"><enum>(III)</enum><text>a material or asset that is essential to the operation, maintenance, or development of critical infrastructure.</text></subclause></clause></subparagraph> <subparagraph id="H784424680A2A4A34B6042379F32E27AA"><enum>(G)</enum><header>Critical infrastructure sectors</header><text display-inline="yes-display-inline">The term <quote>critical infrastructure sectors</quote> has the meaning given the term in section 2001 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/601">6 U.S.C. 601</external-xref>).</text> </subparagraph> 
<subparagraph id="H8E1535492BE44DB089916A0EB61A4DFB"><enum>(H)</enum><header>Disaster recovery or mitigation activity</header><text>The term <quote>disaster recovery or mitigation activity</quote> means an activity—</text> <clause id="HBFB7156604114CE6B08489C1AB4122D8"><enum>(i)</enum><text>that is authorized or funded in whole or in part by the Federal Government; and</text></clause> 
<clause id="H5958130B36D048A893E02D50581A3632"><enum>(ii)</enum><text>that is carried out to prevent, prepare for, respond to, recover from, or mitigate the effects of—</text> <subclause id="HCD3E1621877C4281BB0EB6C9F399BD61"><enum>(I)</enum><text display-inline="yes-display-inline">an emergency;</text></subclause> 
<subclause id="H403A597E7AD844F09B56B47DFF88743C"><enum>(II)</enum><text>a major disaster; or</text></subclause> <subclause id="H27852CE45BD340F9904A5F911F933712"><enum>(III)</enum><text display-inline="yes-display-inline">any other incident or threat that the Administrator of the Federal Emergency Management Agency determines poses a significant risk to public health, safety, or property.</text></subclause></clause></subparagraph> 
<subparagraph id="H52433CABB5C14484A8BDBF218489B688"><enum>(I)</enum><header>Emergency; major disaster</header><text display-inline="yes-display-inline">The terms <quote>emergency</quote> and <quote>major disaster</quote> have such meanings given such terms in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text></subparagraph> <subparagraph id="H76F6FE6A5C964BEC9029DDD7D6998086"><enum>(J)</enum><header>Intelligence community</header><text display-inline="yes-display-inline">The term <quote>intelligence community</quote> has the meaning given the term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text> </subparagraph> 
<subparagraph id="H22D1390BA73044CA8662CE97B7AD4C3C"><enum>(K)</enum><header>National security activity</header><text display-inline="yes-display-inline">The term <quote>national security activity</quote> means an activity that is carried out by or on behalf of—</text> <clause id="HCF4D97687226471A9AEC8C7AC2EB90D9"><enum>(i)</enum><text>the Department of Defense;</text></clause> 
<clause id="HCC71A2179A7C4F42BBAD2F4E50CD202F"><enum>(ii)</enum><text>the Department of Homeland Security; or</text></clause> <clause id="HF0E9EAD92174403EBEA772A59625F2CA"><enum>(iii)</enum><text display-inline="yes-display-inline">the intelligence community.</text></clause></subparagraph> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
