<section id="H9157755ADF2C4E7F927223B135739CC1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Creating Additional Seats to Ease Legally Overburdened Adjudicators’ Dockets Act of 2025</short-title></quote> or the <quote><short-title>CASE LOAD Act of 2025</short-title></quote>.</text></section> <section section-type="subsequent-section" id="H5F144FF3D5BE448BB7AE2BC7F0FE4279"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H6947FABA46974295869083DF104F4B04"><enum>(1)</enum><text display-inline="yes-display-inline">The Federal district court for the eastern district of California is the Federal trial court for 34 counties, including five of the fastest-growing cities in the State of California, serving a population of approximately 8,400,000.</text></paragraph> <paragraph id="HB001BB54CFF3428C983B8AE80F76F303"><enum>(2)</enum><text display-inline="yes-display-inline">The Federal district court for the eastern district of California is one of the largest judicial districts in the country, with approximately 8,400,000 residents and over 87,000 square miles of land. Yet, there are only six permanent judgeships, with one upcoming vacancy pending a nomination elevating a sitting district judge.</text></paragraph> 
<paragraph id="HFBE061754BF8402BB7877BA7472B1F47"><enum>(3)</enum><text>Based on the 2019 U.S. census data, the ratio of authorized district judgeships to population was 1:1,362,552. The central district of California has the next highest ratio in the State, nearly half the size, with 1:694,323.</text></paragraph> <paragraph id="HC470DD68D6D14F6589C504AE80009A9B"><enum>(4)</enum><text>As of June 2022, the total pending cases per judgeship in the Federal district court for the eastern district of California was 1,308, over 2.6 times larger than the average for all districts within the United States Court of Appeals for the Ninth Circuit. Pending caseloads remain high, and if a new vacancy opens upon the elevation of the district judge, caseloads will once again reach this unsustainable level.</text></paragraph></section> 
<section id="H345372433F214B0B8A7EB5B01390BCF4"><enum>3.</enum><header>Additional district judges for the eastern district of California</header> 
<subsection id="HC573E7ED32E3441088E83C0AD4D55F84"><enum>(a)</enum><header>2027</header> 
<paragraph id="H510057595883416CB1C47A928A58E092"><enum>(1)</enum><header>Additional judgeships</header><text display-inline="yes-display-inline">On or after January 21, 2027, the President shall appoint, by and with the advice and consent of the Senate, 2 additional district judges for the eastern district of California.</text></paragraph> <paragraph id="HB4284FF7B9714A18A3B458AE22F7AF25" display-inline="no-display-inline"><enum>(2)</enum><header>Clerical amendment</header><text>The table contained in section 133(a) of title 28, United States Code, is amended by striking the items relating to California and inserting the following:</text>

<paragraph id="HBAE1113701F9453289CC90C7EAD76D4E"><enum>(3)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (2) shall take effect on January 20, 2027.</text></paragraph></subsection> <subsection id="H2AE07D76048C45FF9102EB1289B89F8F"><enum>(b)</enum><header>2029</header> <paragraph id="H4AE3CA950E744DAFBBD6E8DA6C02E698"><enum>(1)</enum><header>Additional judgeships</header><text display-inline="yes-display-inline">On or after January 5, 2029, the President shall appoint, by and with the advice and consent of the Senate, 1 additional district judge for the eastern district of California.</text></paragraph>

<paragraph id="H118C92F0D7B84AF7B80327B66DA191DA"><enum>(3)</enum><header>Effective date</header><text>The amendment made by paragraph (2) shall take effect on January 20, 2031.</text></paragraph></subsection></section> <section id="HCF10566789B742C9BCB4A83705FED9F7"><enum>4.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act and the amendments made by this Act, including such sums as may be necessary to provide appropriate space and facilities for the judicial positions created by this Act or an amendment made by this Act.</text></section>
