<section id="HB1CA9CCBEDC34193AD15EB86DD24C101" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Move the ICC Out of NYC Act of 2025</short-title></quote>.</text></section> <section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="HEB84F707516E4E01A4D26C56A99432CE"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="H84D029B706784F28888120C3CC5218C7"><enum>(1)</enum><text>The Senate ratified the Charter of the United Nations in 1945, finalizing the accession of the United States to the United Nations.</text></paragraph> <paragraph id="HBA9A09BAD0DA4E31AEDA9D1749A9B400"><enum>(2)</enum><text>Congress enacted the Joint Resolution of August 4, 1947 (61 Stat. 756, chapter 482; <external-xref legal-doc="usc" parsable-cite="usc/22/287">22 U.S.C. 287</external-xref> note) (commonly known as the “United Nations Headquarters Agreement Act”) to authorize the United Nations headquarters in New York, New York.</text></paragraph>
<paragraph id="H54A139DE4D1F4C668FD1DD4C98FB954B"><enum>(3)</enum><text>The Senate has not ratified the Rome Statute of the International Criminal Court.</text></paragraph> <paragraph id="H6A6FD46963084D9FA8C8BC323DA407A8"><enum>(4)</enum><text>The International Criminal Court has no jurisdiction within the United States or over United States persons.</text></paragraph>
<paragraph id="HC64BC6D3F5DD4670B6BEA8709D28D9D7"><enum>(5)</enum><text>The International Criminal Court maintains an office within the United Nations headquarters in New York, New York.</text></paragraph> <paragraph id="HEBA37FC20AB14C668151D2881E8B4CC0"><enum>(6)</enum><text>Since its approval by Congress, the United Nations Headquarters Agreement has been amended through supplemental agreements, with the United States Ambassador to the United Nations serving as representative of the United States.</text></paragraph></section>
<section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="HE099911018D741258EC046D6A6EE93DB"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H9A01A26942E0420091F25E5B329709E0"><enum>(1)</enum><header>International Criminal Court; Rome Statute</header><text>The terms <term>International Criminal Court</term> and <term>Rome Statute</term> have the meaning given those terms in section 2013 of the American Service-Members’ Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/22/7432">22 U.S.C. 7432</external-xref>). </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H0F2B7296FE0D4720A831973BBC60F21C"><enum>(2)</enum><header display-inline="yes-display-inline">United Nations Headquarters Agreement</header><text>The term <term>United Nations Headquarters Agreement</term> means the Agreement regarding the Headquarters of the United Nations, signed at Lake Success on June 26, 1947, and entered into force on November 21, 1947, between the United Nations and the United States.</text></paragraph></section> <section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="H5F35A029B1CC430097FE2CE8CC7CA6C2"><enum>4.</enum><header display-inline="yes-display-inline">Supplement to United Nations headquarters agreement</header><text display-inline="no-display-inline">Not later than 30 days after the opening date of the 80th session of the United Nations General Assembly, the United States Ambassador to the United Nations shall seek to open negotiations at the United Nations for a supplemental agreement to the United Nations Headquarters Agreement to prohibit the United Nations from hosting, leasing, or otherwise allowing use of its facilities within the United States by the International Criminal Court.</text></section>
