<section id="HBB0E2B597B864077B77E0ACCEBC0BCFD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assistance for Rural Community Hospitals Act</short-title></quote> or the <quote><short-title>ARCH Act</short-title></quote>.</text></section> <section id="H0CDA2574BE8F4D8BA755B34CF9CBE16E" section-type="subsequent-section"><enum>2.</enum><header>Extending Medicare-dependent hospital and Medicare low-volume hospital payments</header> <subsection id="HCE8EE0D0DAA842E3B0323AEE74886EDC"><enum>(a)</enum><header>MDH extension</header> <paragraph id="HDB6D62C3EEF348A19EC274DD65701598"><enum>(1)</enum><header>Extension of payment methodology</header><text>Section 1886(d)(5)(G) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(5)(G)</external-xref>) is amended—</text> 
<subparagraph id="HB312BAD755F14EF1947F3FEC50330341"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>April 1, 2025</quote> and inserting <quote>October 1, 2031</quote>; and</text></subparagraph> <subparagraph id="H583A9690B45C495FA4A282C07A1419C8"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (ii)(II), by striking <quote>April 1, 2025</quote> and inserting <quote>October 1, 2031</quote>.</text></subparagraph></paragraph> 
<paragraph id="H6CFF8AAEE204406182B702834DB8BC39"><enum>(2)</enum><header>Conforming amendments</header> 
<subparagraph id="H027EDCE819994D49ADFE5A934BD35052"><enum>(A)</enum><header>Extension of target amount</header><text>Section 1886(b)(3)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(b)(3)(D)</external-xref>) is amended—</text> <clause id="HCFE8ACC08F0740B284912139790535DC"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>April 1, 2025</quote> and inserting <quote>October 1, 2031</quote> ; and</text></clause> 
<clause id="HF98A98A900F24B0B97626C23DF8EFAF6"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (iv), by striking <quote>fiscal year 2024 and the portion of fiscal year 2025 beginning on October 1, 2024, and ending on March 31, 2025</quote> and inserting <quote>fiscal year 2031</quote>.</text></clause></subparagraph> <subparagraph id="H84D812DBD0864CD998A7FC4220DA8E04"><enum>(B)</enum><header>Permitting hospitals to decline reclassification</header><text display-inline="yes-display-inline">Section 13501(e)(2) of the Omnibus Budget Reconciliation Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww</external-xref> note) is amended by striking <quote>fiscal year 2024, or the portion of fiscal year 2025 beginning on October 1, 2024, and ending on March 31, 2025</quote> and inserting <quote>fiscal year 2031</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H90978D9B908B4FF6A51632B16D99B60C" commented="no"><enum>(b)</enum><header>LVH extension</header><text display-inline="yes-display-inline">Section 1886(d)(12) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(12)</external-xref>) is amended—</text> <paragraph id="HF2933C0F8D70412496EA0EF86EA083F3"><enum>(1)</enum><text>in subparagraph (C)(i)—</text> 
<subparagraph id="HDD22C44A130948A9A094DAD9AF19EA76" commented="no"><enum>(A)</enum><text>in the matter preceding subclause (I), by striking <quote>through 2024 and the portion of fiscal year 2025 beginning on October 1, 2024, and ending on March 31, 2025</quote> and inserting <quote>through 2031</quote>;</text></subparagraph> <subparagraph id="HD7D479164768419AAD7831F5A990DD89" commented="no"><enum>(B)</enum><text>in subclause (III), by striking <quote>through 2024 and the portion of fiscal year 2025 beginning on October 1, 2024, and ending on March 31, 2025</quote> and inserting <quote>through 2031</quote>; and </text></subparagraph> 
<subparagraph id="HE40C969A0D2E431D97B7AEC4657008E8" commented="no"><enum>(C)</enum><text>in subclause (IV), by striking <quote>the portion of fiscal year 2025 beginning on April 1, 2025, and ending on September 30, 2025, and fiscal year 2026</quote> and inserting <quote>fiscal year 2032</quote>; and</text></subparagraph></paragraph> <paragraph id="HD8C3C81D652F4CD39CEF672536C0BAA7"><enum>(2)</enum><text>in subparagraph (D)—</text> 
<subparagraph id="H313D22F724FD40CCABCC072DFD6A59D7"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>through 2024 or during the portion of fiscal year 2025 beginning on October 1, 2024, and ending on March 31, 2025</quote> and inserting <quote>through 2031</quote>; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6106197A3CF040A7937A64A15C8840FE"><enum>(B)</enum><text>in clause (ii), by striking <quote>through 2024 and the portion of fiscal year 2025 beginning on October 1, 2024, and ending on March 31, 2025</quote> and inserting <quote>through 2031</quote>.</text></subparagraph></paragraph></subsection></section> 
<section id="H376DFBCC9C4542308ED343D941C10222" commented="no"><enum>3.</enum><header>GAO report on Medicare rural hospital classifications</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on Medicare rural hospital classifications that includes the following information:</text> <paragraph id="HDBC3CD0A5665442B85859E55E16FDF0A" commented="no"><enum>(1)</enum><text>The total number of hospitals that, with respect to any of the 5 fiscal years preceding such date of enactment, had any of the following classifications:</text> 
<subparagraph id="HD02995BE074A44D79E93120225601229" commented="no"><enum>(A)</enum><text>Classification as a critical access hospital (as defined in section 1861(mm)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(mm)(1)</external-xref>)).</text></subparagraph> <subparagraph id="HC01C61F8C6D44F8B93E20529A1B49972" commented="no"><enum>(B)</enum><text>Classification as a rural emergency hospital (as defined in section 1861(kkk)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(kkk)(2)</external-xref>)).</text></subparagraph> 
<subparagraph id="H45ABA5F443F2490CA6BE9265D3512E3D"><enum>(C)</enum><text>Classification as a rural referral center (as described in section 1886(d)(5)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(5)(C)</external-xref>).</text></subparagraph> <subparagraph id="HE21B4DB620664B85975313412423B6C2" commented="no"><enum>(D)</enum><text>Classification as a sole community hospital (as defined in section 1886(d)(5)(D)(iii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(5)(D)(iii)</external-xref>)).</text></subparagraph> 
<subparagraph id="HCCB17F36CCA44E71A184EDD59904863A" commented="no"><enum>(E)</enum><text>Classification as a medicare-dependent, small rural hospital (as defined in section 1886(d)(5)(G)(iv) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(5)(G)(iv)</external-xref>)).</text></subparagraph> <subparagraph id="H75B4311F07F544ACA07EF3B6B2CDB8D6" commented="no"><enum>(F)</enum><text>Classification as a low-volume hospital (as defined in section 1886(d)(12)(C)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(12)(C)(i)</external-xref>)).</text></subparagraph></paragraph> 
<paragraph id="HE890FC90CC7C404F97FFC93CDE769EEE" commented="no"><enum>(2)</enum><text>An analysis of the extent to which there is overlap between the criteria for any two or more of the classifications described in <internal-xref idref="HDBC3CD0A5665442B85859E55E16FDF0A" legis-path="3.(a)(1)">paragraph (1)</internal-xref>.</text></paragraph> <paragraph id="HF94C2B28D1384DEAB8C6FD7F1E67628D" commented="no"><enum>(3)</enum><text>Recommendations for—</text> 
<subparagraph id="H7DB74A1F57424131A99686C97A508413"><enum>(A)</enum><text>simplification with respect to such classifications and any such overlap; and</text></subparagraph> <subparagraph id="H12A2B1C160874A998C43289EB515251E"><enum>(B)</enum><text display-inline="yes-display-inline">changes with respect to the criteria for such classifications that would promote financial sustainability for rural hospitals and improve access to health care for individuals in rural areas.</text></subparagraph></paragraph> 
<paragraph id="H00C635BB40F64420B8527CC146B95B77"><enum>(4)</enum><text display-inline="yes-display-inline">The projected effects of allowing sole community hospitals (as described in <internal-xref idref="HE21B4DB620664B85975313412423B6C2" legis-path="3.(1)(D)">paragraph (1)(D)</internal-xref>) and medicare-dependent, small rural hospitals (as described in <internal-xref idref="HCCB17F36CCA44E71A184EDD59904863A" legis-path="3.(1)(E)">paragraph (1)(E)</internal-xref>) to use a cost reporting period beginning during fiscal year 2021 for the purpose of calculating adjusted payments under section 1886(d)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(5)</external-xref>).</text></paragraph></section> </legis-body></bill>
