<official-title display="yes">To amend title 28, United States Code, to clarify the removability of certain actions against current and former Presidents and other senior Executive officials, and for other purposes.<pagebreak/></official-title>

<section id="HAE93F0A50C1242E6936C12CD30360920" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promptly Ending Political Prosecutions and Executive Retaliation Act of 2025</short-title></quote>. </text></section> <section id="H48DC1EA1F4AD490E9FBC26D3C5B32C38"><enum>2.</enum><header>Removal of certain actions</header> <subsection id="H25DD65015ED3484B989747D546175A67"><enum>(a)</enum><header>In general</header><text>Section 1442 of title 28, United States Code, is amended—</text> 
<paragraph id="H2A331B61F8AC44C6917294C10684BE9A"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H6596008FC8C34805BF00AC7DF228342E"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by inserting <quote>, upon a prima facie showing by the removing party that the standards for removal are met,</quote> after <quote>removed by them</quote>; and </text></subparagraph> 
<subparagraph id="H794A061325F9489DB74D190AD868DBC0"><enum>(B)</enum><text>in paragraph (1)—</text> <clause id="H5C2B6004109B4B09B09408ECF4B6278B" commented="no"><enum>(i)</enum><text>by striking <quote>or any officer (or any person acting under that officer) of the United States or of any agency thereof,</quote> and inserting <quote>or any person who, at the time of removal, is an officer of the United States (or any person acting under that officer) or of any agency thereof, or was previously such an officer,</quote>; and </text></clause> 
<clause id="H0822BAE469A448ACAECE03931E394605" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>(including a discretionary exercise of any authority of such office)</quote> after <quote>color of such office</quote>; and </text></clause></subparagraph></paragraph> <paragraph id="H9878FB7E70E6468C94A3BEE5A04124B2"><enum>(2)</enum><text>by adding at the end of subsection (a) the following:</text> 
<quoted-block style="USC" id="HAFBFB5BDF487410F8B1530428868936C" display-inline="no-display-inline"> 
<paragraph id="HE74215263EEB46C7A487C1C013BE871E"><enum>(5)</enum><text display-inline="yes-display-inline">The President or Vice President for or relating to any act while in office or where the State court’s consideration of the claim or charge may interfere with, hinder, burden, or delay the execution of the duties of the President or the Vice President.</text></paragraph> <paragraph id="HB7C72A185D9F427ABE2E5854A3B7CB90"><enum>(6)</enum><text display-inline="yes-display-inline">A former President or Vice President for or relating to any act while in office. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3C6F231AEB1349E19E94C2295E0C8CFE"><enum>(b)</enum><header>Application</header><text>The amendments made by subsection (a) shall apply to a civil action or criminal prosecution pending on the date of enactment of this Act or commenced on or after such date.</text></subsection></section> <section id="HDF7337606A51484EAC1EB4F334F6A76A"><enum>3.</enum><header>Procedure for removal of criminal cases</header> <subsection id="HD94DF3246BF2451C94819509FBAC2B56"><enum>(a)</enum><header>In general</header><text>Section 1455(b) of title 28, United States Code, is amended—</text> 
<paragraph id="H41A257C038744F8E86A9AADC34F149E2"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text> <subparagraph id="HD864C74B169644DEB9AB9D4461C216EF"><enum>(A)</enum><text>by striking <quote>shall not</quote> and inserting <quote>shall</quote>; and</text></subparagraph> 
<subparagraph id="HAB7CC7126D004BF7BBDAFD1424F04210"><enum>(B)</enum><text>by striking <quote>except that a judgment of conviction shall not be entered unless the prosecution is first remanded</quote> and inserting <quote>and no judgment of conviction shall be entered unless the prosecution is remanded</quote>;</text></subparagraph></paragraph> <paragraph id="HE04FE834A7AD41D6851A29DBECCD3F4F"><enum>(2)</enum><text>in paragraph (4), by striking <quote>promptly. If</quote> and inserting <quote>promptly and where a prima facie showing demonstrating the basis for removal is made, the matter shall be removed. Only if</quote>; and </text></paragraph> 
<paragraph id="HCD53CCF70361452984C4B6A1C86AD226"><enum>(3)</enum><text>in paragraph (5)—</text> <subparagraph id="HE14D6B76359F47E4A0CFB8766F4664C4"><enum>(A)</enum><text>by inserting <quote>summary dismissal or the</quote> after <quote>does not order the</quote>;</text></subparagraph> 
<subparagraph id="HE5AEEAC4443345C1A8FC2CF43C2DC142"><enum>(B)</enum><text>by striking <quote>an evidentiary hearing</quote> and inserting <quote>a hearing</quote>; </text></subparagraph> <subparagraph id="H11085288A07B401CB58B05093429579C"><enum>(C)</enum><text>by inserting <quote>including dismissal under section 1456</quote> after <quote>require</quote>; and</text></subparagraph> 
<subparagraph id="H43B210F82C944F40BE9C536C6331E9C0"><enum>(D)</enum><text>by inserting <quote>or dismissal ordered</quote> after <quote>permitted</quote>. </text> </subparagraph></paragraph></subsection> <subsection id="H7F09A7CC051447E8B9ACAC70B63416B7"><enum>(b)</enum><header>Application</header><text>The amendments made by subsection (a) shall apply to criminal prosecutions pending on the date of enactment of this Act or commenced on or after such date.</text></subsection></section> 
<section id="HA47384C8AB814A01B67521506E6A2C70"><enum>4.</enum><header>Official immunity</header> 
<subsection id="HC0ED96B13E61481387CF6C45CD703F38"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/89">Chapter 89</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H03B1D3D2E749469C87E0F2FAC213F432" display-inline="no-display-inline"> <section id="H692CE650C6F94A4997404CEC4C6C5694"><enum>1456.</enum><header>Official Immunity</header> <subsection id="H0A26457192554641B8F6FFCB31A91093"><enum>(a)</enum><header>Immunity</header><text display-inline="yes-display-inline">In any case that is subject to removal under section 1442(a), a Federal official shall be presumed to have immunity under article VI, clause 2 of the Constitution of the United States from any charge or claim made by or under authority of State law which may only be rebutted by clear and convincing evidence that the official was not acting under the color of such office or on account of any right, title or authority claimed under any Act of Congress for the apprehension or punishment of criminals or the collection of the revenue. </text></subsection> 
<subsection id="HE691AC9087CC47F3946AD87E9828DEE0"><enum>(b)</enum><header>Determination of immunity</header><text>For purposes of making a determination of immunity under subsection (a), the following may not be admitted into evidence: </text> <paragraph id="HFD839547EF16473D9A7F49613F97577C"><enum>(1)</enum><text display-inline="yes-display-inline">The nature, elements or any other aspect of the charge or claim made by or under authority of State law. </text></paragraph> 
<paragraph id="H888DF22D5EAE460B9F50A29C9128859C"><enum>(2)</enum><text display-inline="yes-display-inline">An act alleged to be official that is not the subject of the charge or claim made by or under authority of State law. </text></paragraph></subsection> <subsection id="HE5D0A1B450F04F358EF09F2BA83752FC"><enum>(c)</enum><header>Representation</header><text display-inline="yes-display-inline">In any case that is subject to removal under section 1442(a) that names a Federal official as a party, the Attorney General may—</text> 
<paragraph id="H32D9AF8300474306B937CF18550A1B09"><enum>(1)</enum><text display-inline="yes-display-inline">represent such Federal official for any charge or claim made by or under authority of State law; or</text></paragraph> <paragraph id="HFD797FBAE3524B60AA8DE479A1A289C5"><enum>(2)</enum><text display-inline="yes-display-inline">compensate private counsel retained by such official at a reasonable prevailing rate for any such charge or claim. </text></paragraph></subsection> 
<subsection id="HA77E8BB51EDF4B12880B8E00488764AD"><enum>(d)</enum><header>Prohibition on limitation of scope</header><text display-inline="yes-display-inline">No court may define or limit the scope of the duties of an official of the Executive Office of the President.</text></subsection> <subsection id="H329F5AB21D6142BD90B16DA46323EC7E" commented="no"><enum>(e)</enum><header>Dismissal</header><text>In any action subject to removal under paragraph (5) or (6) of section 1442(a), such case shall be dismissed unless rebutted by clear and convincing evidence establishing that the continued pendency of the State claim or charge would not in any way interfere, hinder, burden, or delay the execution of the duties of the President or Vice President.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB4B9198C44A44ED4B68F26FBB56B205A"><enum>(b)</enum><header>Table of sections</header><text display-inline="yes-display-inline">The table of sections for such chapter is amended by adding at the end the following:</text> <quoted-block id="H21C8CDF65CAE47BDBE3F14092B7EA4EA" style="USC"> <toc regeneration="no-regeneration"> <toc-entry level="section">1456. Official immunity.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H7B597A41F85241A6810CB888B3AC74CB"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to civil actions or criminal prosecutions pending on the date of enactment of this Act or commenced on or after such date.</text></subsection></section>
