which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act with respect to aliens who carried out, participated in, planned, financed, supported, or otherwise facilitated the attacks against Israel.</official-title></form><legis-body id="HB2AAEA1A82C64FEB9CD7225D33AA0A91" style="OLC"><section id="H1FE0E5B65C05446199B410E33C4CC6B8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Immigration Benefits for Hamas Terrorists Act</short-title></quote>. </text></section><section id="HD65BE9D5B8F04009B3A746A04BA386D2" section-type="subsequent-section"><enum>2.</enum><header>Aliens who carried out, participated in, planned, financed, supported, or otherwise facilitated attacks against Israel</header><subsection id="HE0088657D6344D8B846EA90054F44893"><enum>(a)</enum><header>Participants in Hamas Terrorism against Israel</header><text display-inline="yes-display-inline">Section 212(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)</external-xref>) is amended—</text><paragraph id="H8C10443A87504DF8BEA4061FA7456668"><enum>(1)</enum><text>in subparagraph (B)(i), in the matter following subclause (IX)—</text><subparagraph id="H5870130350564C00BFF6B97BE2D0B9A4"><enum>(A)</enum><text>by inserting <quote>Palestinian Islamic Jihad, or Hamas</quote> after <quote>Palestine Liberation Organization</quote>; and </text></subparagraph><subparagraph id="H5DDAB74636314D2491C17CA959896C19"><enum>(B)</enum><text>by inserting <quote>member, </quote> after <quote>representative,</quote>; and </text></subparagraph></paragraph><paragraph id="HAF93FBD8912F40138DF79270D1F96BCB"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HB219B5EB9BB64E2E953779B3B48CD789" display-inline="no-display-inline"><subparagraph id="HDFD90D35F8DA4694A62592FE4A76B13E"><enum>(H)</enum><header>Participants in Hamas Terrorism against Israel</header><text display-inline="yes-display-inline">Any alien who carried out, participated in, planned, financed, afforded material support to, or otherwise facilitated any of the attacks against Israel initiated by Hamas beginning on October 7, 2023, is inadmissible.</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9ADD17F905734231BB9190B9AD979B83"><enum>(b)</enum><header>Ineligibility for relief</header><text display-inline="yes-display-inline">Section 241(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H878FDE21BA20443C8FD7C394C4C5C212" display-inline="no-display-inline"><subparagraph id="H962FE0396D22495C96F6F8D6C83E1F9B"><enum>(D)</enum><header>Ineligibility for relief</header><text display-inline="yes-display-inline">Any alien who carried out, participated in, planned, financed, afforded material support to, or otherwise facilitated any of the attacks against Israel initiated by Hamas beginning on October 7, 2023, shall be ineligible for any relief under the immigration laws, including under this section, section 208, and section 2242 of the Omnibus Consolidated and Emergency Supplemental Appropriations Act, 1999 (and any regulations issued pursuant to such section).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF80BA66A099B443C9A91C0E48AC0AD42"><enum>(c)</enum><header>Conforming amendment</header><text>Section 237(a)(4)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)(B)</external-xref>) is amended by striking <quote>subparagraph (B) or (F)</quote> and inserting <quote>subparagraph (B), (F), or (H)</quote>. </text></subsection><subsection id="HE59F72F116234B23AAAFA463BDA2A322"><enum>(d)</enum><header>Report required on participants in Hamas terrorism against Israel</header><text display-inline="yes-display-inline">Beginning not later than one year after the date of the enactment of this Act, and each year thereafter, the Secretary of Homeland Security shall submit a report to Congress, including the number of aliens who were—</text><paragraph id="H19A3A9C85EF94463A2C12487B2C5A680"><enum>(1)</enum><text>found to be inadmissible under section 212(a)(3)(H) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(H)</external-xref>); and</text></paragraph><paragraph id="H3170234973EE45A3AD0466ED4383B6FF"><enum>(2)</enum><text display-inline="yes-display-inline">described in section 212(a)(3)(H) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(H)</external-xref>) and found to be removable pursuant to section 237(a)(4)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)(B)</external-xref>). </text></paragraph></subsection></section></legis-body></bill>
