R. 1737</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250624">June 24, 2025</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To direct the Secretary of Commerce to submit to Congress a report containing an assessment of the value, cost, and feasibility of a trans-Atlantic submarine fiber optic cable connecting the contiguous United States, the United States Virgin Islands, Ghana, and Nigeria.</official-title></form><legis-body id="H029DA708625244FAB58EC9AFDF831248" style="OLC"><section id="HE340C8CDB66E4377A2D487D1487A5AAE" section-type="section-one"><enum>1.</enum><header>Assessment of trans-Atlantic submarine fiber optic cable</header><subsection id="H2C6DACEE1C9F4F8C8AF77A3E2187B4BC"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary, in consultation with the heads of other Federal departments and agencies as necessary, shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing an assessment of the value, cost, and feasibility of a trans-Atlantic submarine fiber optic cable connecting the contiguous United States, the United States Virgin Islands, Ghana, and Nigeria, to enhance the national security of the United States.</text></subsection><subsection id="H854B5C4D871043109C8A80568FDBE244"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall include an assessment of—</text><paragraph id="H58C900EEA75F42AEAA0A55E9F4F17D30"><enum>(1)</enum><text>the digital security, national security, and economic opportunities associated with a trans-Atlantic submarine fiber optic cable described in subsection (a); </text></paragraph><paragraph id="H78B64076B14D4986A5AC576924E04AD9"><enum>(2)</enum><text>the lifespan of submarine fiber optic cables currently connecting the United States Virgin Islands to the contiguous United States; </text></paragraph><paragraph id="H83D7C884E10F4F09A3AFE18BFB54ACC0"><enum>(3)</enum><text>the current security of telecommunications between the contiguous United States and the United States Virgin Islands; </text></paragraph><paragraph id="HDE1315FD35B14AF4B1912C4B7A2C6D54"><enum>(4)</enum><text display-inline="yes-display-inline">the readiness of telecommunications infrastructure in the United States Virgin Islands to support a trans-Atlantic submarine fiber optic cable described in subsection (a);</text></paragraph><paragraph id="HB0864490FA3A4D03B67C95DD1F1DCFD9"><enum>(5)</enum><text>the potential for engagement with trusted entities in the deployment of a trans-Atlantic submarine fiber optic cable described in subsection (a), and the associated geopolitical and economic advantages; </text></paragraph><paragraph id="HC10F39AA08FF4D218C669DA6EEFAEFB7"><enum>(6)</enum><text>the potential connectivity opportunities to maximize investments in the United States economy through the use of a trans-Atlantic submarine fiber optic cable described in subsection (a); </text></paragraph><paragraph id="HC8EC5C21578647C197A65A8C9D27ED63"><enum>(7)</enum><text>the value, cost, and feasibility of establishing a data center and high-security cloud services facility, with independent power generation, in the United States Virgin Islands for communications of the United States Africa Command, communications of the United States Special Operations Command, and national security communications;</text></paragraph><paragraph id="HCD5BB4D1B33B4F3A84DAD4EE1F624C69"><enum>(8)</enum><text display-inline="yes-display-inline">the state of submarine fiber optic cables connected to United States telecommunications infrastructure; and</text></paragraph><paragraph id="H63A2B64B013445FD92DC68CBE3FDAAD8"><enum>(9)</enum><text>any other related matters the Secretary determines are appropriate. </text></paragraph></subsection><subsection id="H52F147D1DAF646998008EB688A6D4179"><enum>(c)</enum><header>No mandatory data collection</header><text display-inline="yes-display-inline">The Secretary may not require any entity to provide data for purposes of preparing the report required by subsection (a).</text></subsection><subsection id="H5EA67E081951482F8AEA4BB37B4DEA20"><enum>(d)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form without any designation relating to dissemination control, but may include a classified annex.</text></subsection><subsection id="HE58DCEC8E6F147E59EE36936E08BAA58"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H47BE9ECC9C1F4342B3B09B56D4652B09"><enum>(1)</enum><header>Not trusted</header><text display-inline="yes-display-inline">The term <quote>not trusted</quote> means, with respect to an entity, that the entity is determined by the Secretary to pose an unacceptable risk to the national security of the United States, or the security and safety of United States persons, based solely on one or more determination described under paragraphs (1) through (4) of section 2(c) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1601">47 U.S.C. 1601(c)</external-xref>).</text></paragraph><paragraph id="HFB6D452B81D4490999BAAF5A9B01CFEE"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Commerce, acting through the Assistant Secretary of Commerce for Communications and Information. </text></paragraph><paragraph id="HBAD72D1C12484B1885B959F64E3440A2"><enum>(3)</enum><header>Trusted</header><text display-inline="yes-display-inline">The term <quote>trusted</quote> means, with respect to an entity, that the Secretary has not determined that the entity is not trusted.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20250623" chamber="House">Passed the House of Representatives June 23, 2025.</attestation-date><attestor display="yes">Kevin F.
