committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc><action-instruction>For text of introduced bill, see copy of bill as introduced on February 27, 2025</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Defense Production Act of 1950 to include the Secretary of Agriculture as a member of the Committee on Foreign Investment in the United States, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HBA00" reported-display-style="italic" id="HA75552FF57214190904D3D25A1F3A15D"><section id="HFA72E8FCD6C04886B143505C0D95CC1B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agricultural Risk Review Act of 2025</short-title></quote>.</text></section><section id="H1D5E366B69B04EBBB4196F80814252F7"><enum>2.</enum><header>Inclusion of the Secretary of Agriculture on the Committee on Foreign Investment in the United States</header><text display-inline="no-display-inline">Section 721(k) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(k)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HF4F6E7E4244E46C1AF7525ABE441FB2B" style="OLC" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="HA7ADCC01C30E4A71BFDCC2423441F8F3"><enum>(8)</enum><header>Inclusion of the Secretary of Agriculture</header><text>The Secretary of Agriculture shall be a member of the Committee with respect to a covered transaction that involves—</text><subparagraph id="H2E061D4EF2534914B1F9CD5BD7E63BB4"><enum>(A)</enum><text>agricultural land;</text></subparagraph><subparagraph id="H5AFF8E68EAD5461282E6FF1E273BFB93"><enum>(B)</enum><text>agriculture biotechnology; or</text></subparagraph><subparagraph id="H95E5EBE29C8A487CA9B3369C5213E424"><enum>(C)</enum><text>the agriculture industry, including agricultural transportation, storage, and processing. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HFB86364E8EB8407F83F2B389A56BD181"><enum>3.</enum><header>Consideration of certain agricultural land transactions</header><text display-inline="no-display-inline">Section 721(b)(1) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(b)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H78F21D9FD8F64146A695583F8B1EBA9D" style="OLC" changed="added" reported-display-style="italic" committee-id="HBA00"><subparagraph id="H7A4BF25ADE8A4FC6B589AD2729121E22"><enum>(I)</enum><header>Consideration of certain agricultural land transactions</header><clause id="HBAF2B13E70AD4C61BDE4CF7EC0D9D5F7"><enum>(i)</enum><header>In general</header><text>After receiving notification from the Secretary of Agriculture of a reportable agricultural land transaction, the Committee shall determine—</text><subclause id="H8BFB7DCACD434E7C882761E081FCE856"><enum>(I)</enum><text>whether the transaction is a covered transaction; and</text></subclause><subclause id="H4E2F7222ED5A4E6EABDB1DD0CF4310D7"><enum>(II)</enum><text>if the Committee determines that the transaction is a covered transaction, whether the Committee should initiate a review pursuant to subparagraph (D), or take another action authorized under this section, with respect to the reportable agricultural land transaction.</text></subclause></clause><clause id="HEECD570BC3F143BA992C492CFD776C56"><enum>(ii)</enum><header>Reportable agricultural land transaction</header><text>In this subparagraph, the term <quote>reportable agricultural land transaction</quote> means a transaction—</text><subclause id="H6994B7BD305D4C93B6C96C3A87E4166D"><enum>(I)</enum><text>that the Secretary of Agriculture has reason to believe is a covered transaction, based on information from or in cooperation with the intelligence community;</text></subclause><subclause id="H84CB84B7AED740AE92A69F3E9015E0C7"><enum>(II)</enum><text>that involves the acquisition of an interest in agricultural land by a foreign person of the People’s Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, or the Islamic Republic of Iran; and</text></subclause><subclause id="HEA4AFB9F8738494EAA83E24DF78E5F93"><enum>(III)</enum><text>with respect to which a person is required to submit a report to the Secretary of Agriculture under section 2(a) of the Agricultural Foreign Investment Disclosure Act of 1978.</text></subclause></clause><clause id="H176EEEFDA9A04D048750EA9D1B51AB11"><enum>(iii)</enum><header>Sunset</header><text>The requirements under this subparagraph shall terminate, with respect to a foreign person of the respective foreign country, on the date that the People’s Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, or the Islamic Republic of Iran, as the case may be, is removed from the list of foreign adversaries in section 791.4 of title 15, Code of Federal Regulations.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><endorsement display="yes"><action-date date="20250603">June 3, 2025</action-date><action-desc>Reported from the <committee-name added-display-style="italic" committee-id="HBA00" deleted-display-style="strikethrough">Committee on Financial Services</committee-name> with an amendment</action-desc><action-date date="20250603">June 3, 2025</action-date><action-desc>Committees on <committee-name committee-id="HIF00">Energy and Commerce</committee-name> and <committee-name committee-id="HFA00">Foreign Affairs </committee-name> discharged;
