which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to direct the Under Secretary for Intelligence and Analysis of the Department of Homeland Security to conduct an annual audit of the information systems and bulk data of the Office of Intelligence and Analysis of the Department, and for other purposes.</official-title></form><legis-body id="H2240317B01E44803AC79D428D1DA5736" style="OLC"><section id="H8B6640A48B65439A894482C5DA8CA18F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Intelligence and Analysis Oversight and Transparency Act</short-title></quote>.</text></section><section id="H7ED6331830D24F228CB7186BCE470750"><enum>2.</enum><header>Annual audit of DHS Office of Intelligence and Analysis information systems and bulk data</header><subsection id="HB72BEB6EE49B44E998E2045E849E38C4"><enum>(a)</enum><header>In general</header><text>Subtitle A of title II of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H848D05B3685F4CC1AC0DCD896B2676B4" style="OLC"><section id="HA5F34AF363444310A982D3A1669EBD92"><enum>210H.</enum><header>Annual audit of information systems and bulk data</header><subsection id="H6FD5031276E4449ABF6C89B06D91F6B7"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD68486AE3C734E629CA54722CE854ECB"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means the Committee on Homeland Security and Governmental Affairs and the Select Committee on Intelligence of the Senate and the Committee on Homeland Security and the Permanent Select Committee on Intelligence of the House of Representatives.</text></paragraph><paragraph id="HE3A54CA8C32D45F89FEA72F0448815AF"><enum>(2)</enum><header>Bulk data</header><text>The term <quote>bulk data</quote> means large quantities of data acquired without the use of discriminants, a significant portion of which are not reasonably likely to have intelligence or operational value.</text></paragraph><paragraph id="H0D57123D589B45FA84F97375C2F79374"><enum>(3)</enum><header>Discriminants</header><text>The term <quote>discriminants</quote> means identifiers and selection terms.</text></paragraph></subsection><subsection id="H756B72E476044D3C99F2F2212154916B"><enum>(b)</enum><header>Annual audits</header><text>Not later than 180 days after the date of the enactment of this section and annually thereafter, the Under Secretary for Intelligence and Analysis of the Department shall conduct an audit of the information systems and bulk data of the Office of Intelligence and Analysis, which shall be consistent with the intelligence oversight guidelines of the Office.</text></subsection><subsection id="H3BA98C8D03EF467485686525CA042FA8" commented="no"><enum>(c)</enum><header>Notifications</header><text display-inline="yes-display-inline">The Under Secretary for Intelligence and Analysis of the Department shall provide the appropriate congressional committees with—</text><paragraph id="H24C5CE1BCC8D400CBFE94AB18D31A7D1" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">a notification not later than 30 days after the first analysis or other intelligence use by the Office of Intelligence and Analysis after the date of the enactment of this section of any new bulk data set and the associated terms and conditions; and</text></paragraph><paragraph id="HA62D2AA2AD8A46958FF461D1E4996075" commented="no"><enum>(2)</enum><text>an update not later than 30 days after any changes to such associated terms and conditions related to the use of such a bulk data set.</text></paragraph></subsection><subsection id="H369DAD2138F2462AB96111D68C175154"><enum>(d)</enum><header>Reports and review</header><paragraph id="HFAD045C4305E468D829535987AFBEFC7"><enum>(1)</enum><header>Reports to Congress</header><text>Not later than 30 days after the conclusion of each audit under subsection (b), the Under Secretary for Intelligence and Analysis of the Department shall submit to the appropriate congressional committees the findings and results of such audit.</text></paragraph><paragraph id="H92C7D2AD16D4462D871FF54041DDD39F"><enum>(2)</enum><header>GAO review</header><text>Not later than four years after the date of the enactment of this section, the Comptroller General of the United States shall provide the appropriate congressional committees a review of the implementation of the annual audit requirement under subsection (b), challenges to the implementation of such requirement, and recommendations for improving such audits.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H44C7DF8627E843878322E9F5390CF199"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; 116 Stat. 2135) is amended by inserting after the item relating to section 210G the following:</text><quoted-block style="OLC" id="H971A7B70973648C99ED51F847E81B518" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec.210H.
