which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Horse Protection Act to provide increased protection for horses participating in shows, exhibitions, sales, and auctions, and for other purposes.</official-title></form><legis-body id="H2661E2077D2841CA90E65A7CCE9E921A" style="OLC"><section id="H0F187C18ADDC474AADC1343426B0E4BC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Horses from Soring Act of 2025</short-title></quote>.</text></section><section id="HD8360DA295E64D41B3D2EB0B685B71FA"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1821">15 U.S.C. 1821</external-xref>) is amended—</text><paragraph id="H7FF15005FA5C461299D8FE63D40E64A3"><enum>(1)</enum><text>by striking the section designation and all that follows through <quote>requires:</quote> in the matter preceding paragraph (1) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H279B1910F3FC4E0091DB9C08B54D0043" style="OLC"><section commented="no" display-inline="no-display-inline" id="H0ACFED52AF844E0B8C3F4D7B7D7A6CCC" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HF5336AD78BED4B2DADF3D34CDE80F68E"><enum>(2)</enum><text>by redesignating paragraphs (1), (2), (3), and (4) as paragraphs (2), (4), (5), and (6), respectively;</text></paragraph><paragraph id="H73529F9D59654CD69ACEAE7A9BF46641"><enum>(3)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block display-inline="no-display-inline" id="HEBEDF48DC9584FE6BF8B484C13970093" style="OLC"><paragraph id="HF316A8724B6346358CF1F14306189582"><enum>(1)</enum><header>Horse Industry Organization</header><text>The term <term>Horse Industry Organization</term> means the organization established under section 4(c)(1)(A).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H9D930BBC83EF496D9A6F1428406D53D4"><enum>(4)</enum><text>by inserting after paragraph (2) (as so redesignated) the following:</text><quoted-block display-inline="no-display-inline" id="H7C23636A01A54B7681C1DAC0F44EA4B1" style="traditional"><paragraph id="H78E940BA0C584671802C2725D5797C50"><enum>(3)</enum><header>Objective inspection</header><text display-inline="yes-display-inline">The term <term>objective inspection</term> means an inspection conducted by a veterinarian or veterinarian technician using only an inspection method based on a science-based protocol that consists of, at a minimum, swabbing and blood testing, and that—</text><subparagraph id="H384A814233854901850BA04D8E534C95"><enum>(A)</enum><text display-inline="yes-display-inline">has been the subject of testing and is capable of producing scientifically reliable and reproducible results;</text></subparagraph><subparagraph id="H93DD16E20E824180A126C11708DE2DC5"><enum>(B)</enum><text display-inline="yes-display-inline">has been subjected to peer review; and</text></subparagraph><subparagraph id="HA90DC67C30EC46A6B84FA6863C79C53E"><enum>(C)</enum><text display-inline="yes-display-inline">has received acceptance in the veterinary or other applicable scientific community, as determined by the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HA64D54135BD44A46A056D610E4F3EA11"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Section 3 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1822">15 U.S.C. 1822</external-xref>) is amended—</text><paragraph id="H7A0B48DDE91541B080BC548104814653"><enum>(1)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (5) and (6), respectively; and</text></paragraph><paragraph id="HEF59755B5B95485E92A0AA95DCCC9645"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block display-inline="no-display-inline" id="HCE08E67FF6D24617815D3579EDD49591" style="traditional"><paragraph id="H9D164BB7D94F4713813556B6A288D34E"><enum>(4)</enum><text display-inline="yes-display-inline">the Inspector General of the Department of Agriculture has determined that the program through which the Secretary inspects horses is not adequate to ensure compliance with this Act;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H100B64589FE64341A6E8BAE7C28188BE"><enum>4.</enum><header>Increasing protections for horses participating in horse shows, exhibitions, sales, or auctions</header><subsection id="H6CB5EA0DB30F483D92F27A4333A6AABD"><enum>(a)</enum><header>Horse shows and exhibitions</header><text display-inline="yes-display-inline">Section 4 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1823">15 U.S.C. 1823</external-xref>) is amended—</text><paragraph id="H659AD5754E2247478AC0F47232EEF4B0"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H61DF3E07FB314124AD381F65EF7924DE" style="OLC"><subsection id="H9C28B12BBBC641B79186D639AE58434E"><enum>(a)</enum><header>Disqualification of horses</header><paragraph id="HBED3CD45642D4D2E8F3C4CC1E299EADF"><enum>(1)</enum><header>In general</header><text>The management of any horse show or horse exhibition shall disqualify any horse from being shown or exhibited if—</text><subparagraph id="H0EEDCC4ADF13464EA2540EA72FFB371C"><enum>(A)</enum><text>the horse is determined to be sore by an objective inspection; or</text></subparagraph><subparagraph id="H81E867A670A046E39021019BAF774C9E"><enum>(B)</enum><text>the management has been notified that the horse is sore by—</text><clause id="HDC07740C7A07454F877C9A155ED21426"><enum>(i)</enum><text>a person licensed under subsection (c)(3)(A); or</text></clause><clause id="H71CC10C1CEBD4E1F9CFAD9DE47CECE4A"><enum>(ii)</enum><text>the Secretary.</text></clause></subparagraph></paragraph><paragraph id="H189BD89DE39B4969B690CEBAF9B3DFC3"><enum>(2)</enum><header>Duration of disqualification</header><text>Any horse that is determined to be sore by an objective inspection shall be disqualified from being shown or exhibited—</text><subparagraph id="HC7E54A6DD46E413F8D76B26E1402899F"><enum>(A)</enum><text>for a period of not less than 30 days if it is the first determination; and</text></subparagraph><subparagraph id="H829CCAFDEFD449FCB01C2A1BDD4BC56E"><enum>(B)</enum><text>for a period of not less than 90 days if it is a second or subsequent determination.</text></subparagraph></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="HD27D7E2857EF4DC38457AD3B8C810258"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph id="H3E6B40E2043A41FBBEE64257175A7CE2"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>(b) The management</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HDED8DFB2744248D7B4638151F7E2A07B" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H05A754DE3172431DA5790957C7A96038"><enum>(b)</enum><header>Prohibition on sale, auction, and exhibition</header><text>The management</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H18098662537C4965A1388974A2EA8E0B"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subsection (c) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H45AF34D4CF4A4C5E9A717983B39745F0" style="OLC"><subsection id="H4D49F0807D3340C1AF5A55EC8AFA2FE8"><enum>(c)</enum><header>Horse Industry Organization</header><paragraph id="H75D0284C8E8E4651B6AD38D23093ABAC"><enum>(1)</enum><header>Establishment</header><subparagraph id="H4D85897C54AF49C0922D15CBAF0AEB2C"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Protecting Horses from Soring Act of 2025</short-title>, the Secretary shall establish an organization, to be known as the <quote>Horse Industry Organization</quote> (referred to in this subsection as <quote>the Organization</quote>).</text></subparagraph><subparagraph id="H28406B0C599E4BECB75180F27F7A42E9"><enum>(B)</enum><header>Board</header><clause id="H8DCA9D8B562D45B9AF96AD3EE23E7F0E"><enum>(i)</enum><header>In general</header><text>The Organization shall be governed by a board (referred to in this subsection as <quote>the Board</quote>) consisting of not more than 9 individuals, of whom—</text><subclause id="HE0EE8E910B454B7DBB988DFBA44089CC"><enum>(I)</enum><text>two shall be appointed by the Commissioner of Agriculture for the State of Tennessee;</text></subclause><subclause id="HD46328A4E2D24EA1A17B979D03E04026"><enum>(II)</enum><text>two shall be appointed by the Commissioner of Agriculture for the State of Kentucky;</text></subclause><subclause id="H3741764F16BC478B99B04D4F2B493B3C"><enum>(III)</enum><text>two shall—</text><item id="H726E7A1664E1463AA88E8D439D361E81"><enum>(aa)</enum><text>represent the Tennessee Walking Horse industry; and</text></item><item id="H6B6EEB498872491E92FD1B6EE62E9EAA"><enum>(bb)</enum><text>be appointed by the members appointed under subclauses (I) and (II), in accordance with a process developed by those members; and</text></item></subclause><subclause id="HD5954E2F61FE42BD8E45D88C868DAA88"><enum>(IV)</enum><text>not more than three shall be appointed by the members appointed under subclauses (I) through (III).</text></subclause></clause><clause id="H8C43D0379E494F38AF6C0242BBBCEB9A"><enum>(ii)</enum><header>Quorum</header><text>Five members of the Board shall constitute a quorum for the transaction of business.</text></clause><clause id="H2460AF0DBAF343A2BCCC07F12F7ED36A"><enum>(iii)</enum><header>Bylaws</header><text>The members of the Board, in consultation with the Secretary, shall develop bylaws and other policies to operate the Organization, establish committees, and fill vacancies on the Board.</text></clause></subparagraph><subparagraph id="HD912A10B64C84F87BDEF925852371546"><enum>(C)</enum><header>Vacancies; period of appointment</header><clause id="HFCA9552A8F2A4368ACF3CB25AEE15CAC"><enum>(i)</enum><header>Vacancies</header><text>Any vacancy on the Board—</text><subclause id="HFC0AFC2CD7F34AA193F6A4F932A2BECC"><enum>(I)</enum><text>shall not impair the authority of the Board; and</text></subclause><subclause id="HF6AFF996123B45389139A58BDD4FDF46"><enum>(II)</enum><text>shall be filled as soon as practicable in the same manner as the original appointment.</text></subclause></clause><clause id="HDB8033F356854F9387F5F036E9FC038D"><enum>(ii)</enum><header>Period of appointment</header><subclause id="H7E2969C24A524E2C8415EBA52734DB7D"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), a member of the Board shall be appointed for a term of 4 years.</text></subclause><subclause id="HE911F723D93F40E6B8BC5BBEE8FB63CA"><enum>(II)</enum><header>Initial appointments</header><text>Of the members first appointed to the Board, the members described in subparagraph (B)(i)(III) shall be appointed for an initial term of 3 years.</text></subclause></clause></subparagraph></paragraph><paragraph id="HE62A5793909C4286A9C7131EA3FADB4B"><enum>(2)</enum><header>Responsibilities</header><text>The Organization shall—</text><subparagraph id="H15F0B1F5FB434B459271828BCF9A0300"><enum>(A)</enum><text>establish a formal affiliation with the management of each horse sale, horse exhibition, horse sale, and horse auction;</text></subparagraph><subparagraph id="H31783A64A8994C1AB92B76AAFB199BBF"><enum>(B)</enum><text>appoint inspectors to conduct inspections at each horse sale, horse exhibition, horse sale, and horse auction;</text></subparagraph><subparagraph id="HF0EF03CABC0944519E7BBF63BABF4814"><enum>(C)</enum><text>identify and contract with equine veterinary experts to advise the Board on—</text><clause id="HABC49D5E42F4438B938D2E0B91F30109"><enum>(i)</enum><text>objective scientific testing methods and procedures for objective inspections; and</text></clause><clause id="HAD300448CBCB4DED9AC93A0F470B01B8"><enum>(ii)</enum><text>the certification of objective inspection results;</text></clause></subparagraph><subparagraph id="H4AF5CBE0697E4019A594623D75B4073F"><enum>(D)</enum><text>establish licensing requirements under paragraph (3); and</text></subparagraph><subparagraph id="H1511BF8734CB418FBF5BF23BF640B5BF"><enum>(E)</enum><text>take any other action to ensure compliance with this Act, as determined in coordination with the Secretary.</text></subparagraph></paragraph><paragraph id="H04236AD2CD0543F1BE10A4D26F4CD204"><enum>(3)</enum><header>Licensing requirements</header><subparagraph id="HBCE5EFF7695C4C6FB62C3F44F1A221E7"><enum>(A)</enum><header>In general</header><text>The Organization shall develop licensing requirements to submit to the Secretary for licensing persons qualified—</text><clause id="H43BF83595BA14F0485CDE5A832EA3DF3"><enum>(i)</enum><text>to detect and diagnose a horse that is sore; or</text></clause><clause id="H0B811C30D42D4DF0953DFF2F7E461425"><enum>(ii)</enum><text>to otherwise inspect a horse for the purpose of enforcing this Act.</text></clause></subparagraph><subparagraph id="HB4AD3DF3BF264E39BC9EDEACB5D32AC9"><enum>(B)</enum><header>Conflicts of interest</header><text>Requirements developed under subparagraph (A) shall include the requirement that any person licensed by the Organization, and any member of the immediate family of any person licensed by the Organization, is free from a conflict of interest by reason of any association or connection with the walking horse industry, including through—</text><clause id="H4D007E33A1954049898CB79987639A39"><enum>(i)</enum><text>employment by, or the provision of any service to, any show manager, trainer, owner, or exhibitor of a Tennessee Walking horse, Spotted Saddle horse, or Racking horse; and</text></clause><clause id="H9653534D1AC24369A77E778D6CD71F17"><enum>(ii)</enum><text>training, exhibiting, shoeing, breeding, or selling a Tennessee Walking horse, Spotted Saddle horse, or Racking horse.</text></clause></subparagraph></paragraph><paragraph id="HBB45693E09D443C787B1E98A34B56DC3"><enum>(4)</enum><header>Certification</header><subparagraph id="H6DE86D1C52E6473C832DA5E24F8231AD"><enum>(A)</enum><header>In general</header><text>After the members of the Board described in subclauses (I) through (III) of paragraph (1)(B)(i) have been appointed, the Secretary shall certify the Organization to train and license individuals, including inspectors, as designated qualified persons in accordance with section 11.7(b) of title 9, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph id="H7D3BFF4E44CE4F81AB8D8EE34790D12C"><enum>(B)</enum><header>Revocation of certification</header><text>Not later than 90 days after the date on which the Secretary certifies the Organization under subparagraph (A), the Secretary shall revoke the certification issued to any other horse industry organization under section 11.7 of title 9, Code of Federal Regulations (or successor regulations).</text></subparagraph></paragraph><paragraph id="HDA6502831B4244B2B65E03A2BAF0C64C"><enum>(5)</enum><header>Federal Advisory Committee Act Exemption</header><text>Section 14(a)(2)(B) of the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.) shall not apply to the Organization.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HE257D85319CE4ACCA9F0D125C31EC5CD"><enum>(4)</enum><text>in subsection (d), by striking <quote>(d) The management</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H74F4D2A519BB444185396C3F2F60EAFF" style="OLC"><subsection id="HF950454EB47047499FDDC31B473AFFC6"><enum>(d)</enum><header>Recordkeeping</header><text>The management</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HBE8C683133BE40E1A702E0107DD433D6"><enum>(5)</enum><text>in subsection (e), by striking <quote>(e) For purposes of</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H85433FE265354579A307B28AF6C9C4A0" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="HD81BEEFD4F0846219CC5913F0784BFF2"><enum>(e)</enum><header>Right of inspection</header><text>For purposes of</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA20B865924814641B768D63E241B9FCB"><enum>(b)</enum><header>Unlawful acts</header><text display-inline="yes-display-inline">Section 5 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1824">15 U.S.C. 1824</external-xref>) is amended—</text><paragraph id="H1D196293C26646FAB3074E91087492EE"><enum>(1)</enum><text>by striking the section designation and all that follows through <quote>The following</quote> in the matter preceding paragraph (1) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HECF6ECBBF17A43CCB41E67EBA7D56196" style="OLC"><section commented="no" display-inline="no-display-inline" id="H7EAF05DA5DFE4EC787A22CBC2E1AAE1E" section-type="subsequent-section"><enum>5.</enum><header>Prohibited conduct</header><text display-inline="no-display-inline">The following</text></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H04AF4589A5FC4182895F7B70FC5C928F"><enum>(2)</enum><text>in paragraph (3), by striking <quote>appoint and retain a person in accordance with section 4(c) of this Act</quote> and inserting <quote>have a formal affiliation with the Horse Industry Organization</quote>;</text></paragraph><paragraph id="H0E3B57FC43D94D578BA0AFAE0DA206F7"><enum>(3)</enum><text>in paragraph (4), by striking <quote>appoint and retain a qualified person in accordance with section 4(c) of this Act</quote> and inserting <quote>have a formal affiliation with the Horse Industry Organization</quote>;</text></paragraph><paragraph id="H8874A750873C4332B4CE2D17A6870FC4"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>appointed and retained a person in accordance with section 4(c) of this Act</quote> and inserting <quote>a formal affiliation with the Horse Industry Organization</quote>; and</text></paragraph><paragraph id="H77BC79998D3C4C4BB151E9289DD0731E"><enum>(5)</enum><text>in paragraph (6)—</text><subparagraph id="H7C0BABB6955940808D352F036086512D"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>appointed and retained a person in accordance with section 4(c) of this Act</quote> and inserting <quote>a formal affiliation with the Horse Industry Organization</quote>; and</text></subparagraph><subparagraph id="HF27BE8CC185E4B238C12B77D441A20AE"><enum>(B)</enum><text>by striking <quote>such person or the Secretary</quote> and inserting <quote>a person licensed by the Horse Industry Organization</quote>.</text></subparagraph></paragraph></subsection></section><section id="H167243E89CA94259849D50D8E140A43C"><enum>5.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture shall issue regulations to carry out the amendments made by this Act.</text></section></legis-body></bill>
