R. 1671</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250227">February 27, 2025</action-date><action-desc><sponsor name-id="D000626">Mr. Davidson</sponsor> (for himself, <cosponsor name-id="N000026">Mr. Nehls</cosponsor>, <cosponsor name-id="M001184">Mr. Massie</cosponsor>, <cosponsor name-id="M001211">Mrs. Miller of Illinois</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, and <cosponsor name-id="F000246">Mr. Fallon</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to provide for a presumption of service-connection under the laws administered by the Secretary of Veterans Affairs for certain diseases associated with the COVID–19 vaccine that become manifest during the one-year period following the receipt of the vaccine, and for other purposes.</official-title></form><legis-body id="H20C6EE5EBD164601A0B3F4BF9CF9B3B7" style="OLC"><section id="H2636FA21EE0644EE984C93DDF34B902B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for Vaccine Injured Veterans Act of 2025</short-title></quote>.</text></section><section id="H4D4ECA1AE0F54038A04568B6E13D1DD1"><enum>2.</enum><header>Findings; sense of Congress</header><subsection id="H49E48BD179904602B6E37B6EF2C4B7F5"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph id="H6EC8EBEBCE4B4F3296E03F56B8897B2E"><enum>(1)</enum><text>On August 24, 2021, Secretary of Defense Lloyd Austin issued a memorandum titled, <quote>Mandatory Coronavirus Disease 2019 Vaccination of Department of Defense Service Members</quote>.</text></paragraph><paragraph id="H3E2C372C33A14EA1BB319D065C5F14D7"><enum>(2)</enum><text>This memorandum stated, <quote>I therefore direct the Secretaries of the Military Departments to immediately begin full vaccination of all members of the Armed Forces under DoD authority on active duty or in the Ready Reserve, including the National Guard, who are not fully vaccinated against COVID–19</quote>.</text></paragraph><paragraph id="H5D5F6123709948C3818F903ABA17E771"><enum>(3)</enum><text>In December 2022, the Department of Defense reported that <quote>98 percent of active duty service members and 96 percent of the total force have been vaccinated</quote> from COVID–19.</text></paragraph><paragraph id="H6497FF2F53CF4486A41929B70EC6F917"><enum>(4)</enum><text>As a result of this memorandum, more than 8,400 members of the Armed Forces were forced out of the military for refusing to get the COVID–19 vaccine.</text></paragraph><paragraph id="H3490CEC56ED444B2AFC96E8F2D2448B8"><enum>(5)</enum><text display-inline="yes-display-inline">On January 10, 2023, Secretary Austin was forced to rescind this memorandum as a requirement of section 525 of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>).</text></paragraph></subsection><subsection id="HC0200685BDD749D3BE6D4E7A98AA6A24"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the actions referred to in subsection (a) that were taken by the Department of Defense under the Biden administration caused irreparable harm to the health and readiness of the United States Armed Forces.</text></subsection></section><section id="H44656078669A452F91A8FC998BD04852"><enum>3.</enum><header>Department of Veterans Affairs presumption of service-connection for certain diseases associated with COVID–19 vaccine</header><subsection id="H10D3BE4E4A0443C6941688C5A2BCEB75"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block id="HF680F54C563848048977ACD3156D3CB0" style="USC"><section id="HF05BF505DFF143A1B06E949528F15064"><enum>1120A.</enum><header>Presumption of service-connection for certain diseases associated with COVID–19 vaccine</header><subsection id="H51F2D4A17BF84770B0DFCEB26C742D8F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For the purposes of section 1110 of this title, and subject to section 1113 of this title, a disease specified in subsection (b) becoming manifest in a member of the Armed Forces who, during the period beginning on August 24, 2021, and ending on January 10, 2023, received a COVID–19 vaccine under orders shall be considered to have been incurred in or aggravated during active military, naval, air, or space service, notwithstanding that there is no record of evidence of such disease during the period of such service.</text></subsection><subsection id="H98AB0D1B03DA4AABB33BAB1C858A0198"><enum>(b)</enum><header>Covered diseases</header><text>The diseases specified in this subsection are the following:</text><paragraph id="HBC1FD99A0F2146A9A8B2CA11A3569746"><enum>(1)</enum><text>Myocarditis.</text></paragraph><paragraph id="HC0F57420C97E4A9A8E64674A9D6B94F6"><enum>(2)</enum><text>Pericarditis.</text></paragraph><paragraph id="HD023AB03525347ADB9AAB9A8503A9867"><enum>(3)</enum><text>Thrombosis with thrombocytopenia syndrome.</text></paragraph><paragraph id="HAB192C3397FE4B6A99449FCD89BCF4B6"><enum>(4)</enum><text display-inline="yes-display-inline">Guillian-Barre Syndrome.</text></paragraph><paragraph id="HB2596C5EECCF4B0F965C0255E2FD6014"><enum>(5)</enum><text display-inline="yes-display-inline">Any other disease for which the Secretary determines that a presumption of service connection is warranted based on a positive association with the COVID–19 vaccine.</text></paragraph></subsection><subsection id="H925195316D084367B227D182015DDC7A"><enum>(c)</enum><header>Congressional notice requirement</header><text>If the Secretary determines that an additional disease should be specified pursuant to subsection (b)(4), the Secretary shall submit to the Committees on Veterans Affairs’ of the Senate and the House of Representatives notice of such determination.</text></subsection><subsection id="HC32FDA083AE54B7C85B55F3ED41D4346"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of the <short-title>Justice for Vaccine Injured Veterans Act of 2025</short-title>, and every 60 days thereafter for the subsequent four year-period, the Secretary shall submit to the Committees of Veterans’ Affairs of the Senate and the House of Representatives a report that contains each of the following:</text><paragraph id="HFAFEC2585F644A1980AEB0ED9F50CE00"><enum>(1)</enum><text>The total number of claims for compensation under this chapter related to a disease associated with the COVID–19 vaccine.</text></paragraph><paragraph id="HCD6F1E408455481A84DA8FB42BB12C41"><enum>(2)</enum><text>The status of each such claim, disaggregated by—</text><subparagraph id="H4F97CAFEC33045D6A3A5DE0E7C2F6593"><enum>(A)</enum><text>the number of claims that were approved;</text></subparagraph><subparagraph id="HB34687AB05494570AD3F62238085FCDB"><enum>(B)</enum><text>the number of claims that were denied and for which the claimant took no further action;</text></subparagraph><subparagraph id="HCB3E2DDDC9984DBAB8D3840BCA0DC3DB"><enum>(C)</enum><text>the number of claims that were denied and for which the claimant filed a supplemental claim;</text></subparagraph><subparagraph id="H250653A8BF4D4F74AD3885EBCD4EF610"><enum>(D)</enum><text>the number of claims that were denied and for which the claimant requested a higher level review; and</text></subparagraph><subparagraph id="HF375F8DB61234BDA87D8215E38FBCD6B"><enum>(E)</enum><text>the number of claims that were denied and for which the claimant filed an appeal to the Board of Veterans’ Appeals.</text></subparagraph></paragraph><paragraph id="H1E88F318CAFF4336BC259D5DE9989250"><enum>(3)</enum><text>The total number of such claims that, as of the date of the submission of the report, had been submitted but were pending a decision.</text></paragraph></subsection><subsection id="HB3C676960CF240B39508042452535298"><enum>(e)</enum><header>Public access to reports</header><text>The Secretary shall make each report required by subsection (d) publicly available, including by making publicly available on an appropriate website of the Department each such report together with such additional information or comments as the Secretary considers appropriate to provide context for the report.</text></subsection><subsection id="HF64655BCADB0493A9615BEEE4CDA437A"><enum>(f)</enum><header>COVID–19 vaccine defined</header><text>In this section, the term <term>COVID–19 vaccine</term> means vaccine licensed under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>) or authorized for emergency use under section 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360bbb-3">21 U.S.C. 360bbb–3</external-xref>) for immunization against the virus responsible for COVID–19.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H780DB70E39F64B7BA5F869B3FD8C9985"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1120 the following new item:</text><quoted-block style="USC" id="H34C91094A31B4001824629F473A9CCEC" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1120A.
