which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require Federal employee health benefit plans to include assisted reproductive treatment benefits, and for other purposes.</official-title></form><legis-body id="H0967E8704B3944E2997DC69B94998844" style="OLC"><section id="HFC52041023F747418FD7F205E7E4ACEC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Family Building FEHB Fairness Act</short-title></quote>.</text></section><section id="H33E6FE9A535E412EB0360FFDC87F7E9E"><enum>2.</enum><header>Fertility treatment benefits</header><subsection id="HE90BE984B54C45A5820CE71F1A4DA64D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 8904 of title 5, United States Code, is amended—</text><paragraph id="HD122B9DB062A401C84B3563598CDC301"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H9EFA853DEEBB4BBAB5663A88C5B98A6A"><enum>(A)</enum><text>in paragraph (1), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9C5B36F625734245B2962105A673443E"><subparagraph id="H7D9EE0539F184C7B9B3E332939E900DD"><enum>(G)</enum><text display-inline="yes-display-inline">Fertility treatment benefits.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HD2D4ACBA17E94E03974D02E3F1AD8F6C"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HD213CDAC4398490C8556AA3C9E3CC76C"><enum>(i)</enum><text>by redesignating subparagraph (F) as subparagraph (G); and</text></clause><clause id="HAC43057A73F2409E9D45A2EF04489BC5"><enum>(ii)</enum><text>by inserting after subparagraph (E) the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H121974C7D77C4B479FBF8BA3CEE9492E"><subparagraph id="HAEFE4070037C4589B63797045E902F18"><enum>(F)</enum><text display-inline="yes-display-inline">Fertility treatment benefits.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HED6C11F2B4C944399124A9EB4F22C28F"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1140B3388AC443E3ADA2017D18CEBBCE"><subsection id="H27507968044447D396E4FC393C4FEE7B"><enum>(c)</enum><text display-inline="yes-display-inline">In this section, the term <term>fertility treatment</term> means—</text><paragraph id="H0DBA12E4B5DF4B69B7E2BE20991510DC"><enum>(1)</enum><text display-inline="yes-display-inline">preservation of human oocytes, sperm, or embryos for later reproductive use;</text></paragraph><paragraph id="HF9F81D5D850447F58A26973807533F85"><enum>(2)</enum><text display-inline="yes-display-inline">artificial insemination, including intravaginal insemination, intracervical insemination, and intrauterine insemination;</text></paragraph><paragraph id="H41C1A99486164ED1ADCDAA55B090909E"><enum>(3)</enum><text display-inline="yes-display-inline">assisted reproductive technology, including in vitro fertilization and other treatments or procedures in which reproductive genetic material, such as oocytes, sperm, fertilized eggs, and embryos, are handled, when clinically appropriate;</text></paragraph><paragraph id="H5076750FC486412DB4EBA38747AC6AFB"><enum>(4)</enum><text display-inline="yes-display-inline">genetic testing of embryos;</text></paragraph><paragraph id="HD8D44BFFC3844EC2B81F0A9883911725"><enum>(5)</enum><text display-inline="yes-display-inline">medications prescribed or obtained over-the-counter, as indicated for fertility;</text></paragraph><paragraph id="HCFD3DD629B4A4CBEBC0460F6FE58F6B5"><enum>(6)</enum><text display-inline="yes-display-inline">gamete donation; and</text></paragraph><paragraph id="H6121EAD53D4B4E2A9DEB5A7C3FD1AF04"><enum>(7)</enum><text display-inline="yes-display-inline">such other information, referrals, treatments, procedures, medications, laboratory services, technologies, and services relating to fertility as the Director of the Office of Personnel Management, in coordination with the Secretary of Health and Human Services, determines appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB46EE242C4CA4C39A631DF49F617FE35"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this Act shall take effect on the date that is 1 year after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
