<section id="HACB5375D698044B79DF8FD44EA388332" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Student Access to Mental Health Services Act</short-title></quote>.</text></section> <section id="HF8015FB433644C97BFE88E3C1C05C036"><enum>2.</enum><header>Supporting mental health</header> <subsection id="HAC5306D0035C46BE97F4AF12FA8C5420"><enum>(a)</enum><header>State use of funds</header><text>Section 4104(b)(3)(B) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114(b)(3)(B)</external-xref>) is amended—</text> 
<paragraph id="H4A70E43584EA41DDAF11AB87C372B518"><enum>(1)</enum><text>in clause (iii), by striking <quote>and</quote> at the end; and</text></paragraph> <paragraph id="H5FA252713FE84F5FAE982D2E8E4059CF"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H444FFB3582004BB4B53503B7815E1749" style="OLC"> 
<clause id="HFE89A0C44A1749B6AC15AF205ED86105"><enum>(v)</enum><text>improving the mental health services available to students, which may include—</text> <subclause id="H17D1F47F1587402DA89E4AF8D9EA7E22"><enum>(I)</enum><text>identifying and disseminating best practices for mental health first aid;</text></subclause> 
<subclause id="HACBE92DB1EDC449DAEA5796CC00EBBA8"><enum>(II)</enum><text>assisting in the establishment or implementation of emergency planning, which may include emergency response teams to address emergencies at schools;</text></subclause> <subclause id="H24DDE2E3181C4F8D92857AA275FB71BE"><enum>(III)</enum><text>establishing or identifying agreements with local health agencies, including nonprofit, public, and private mental health agencies and institutions, to improve coordination of services; and</text></subclause> 
<subclause id="H552A665264594DE2A68B1D999B6E7237"><enum>(IV)</enum><text>telehealth services; and</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H50C3233F4F1A4370AFABE42187C3E066"><enum>(b)</enum><header>Local educational agency applications</header><text display-inline="yes-display-inline">Section 4106(e)(1) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7116">20 U.S.C. 7116(e)(1)</external-xref>) is amended—</text> 
<paragraph id="H1B5E3316ABEF4D9FB01036125DE627E2"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H2CC777B0FF3942D7B7C53A66B952C5CA"><enum>(2)</enum><text>by redesignating subparagraph (E) as subparagraph (F); and</text></paragraph> 
<paragraph id="H78E1CF9EA2724DF688F8CBBE52E4867B"><enum>(3)</enum><text>by inserting after subparagraph (D), the following:</text> <quoted-block id="H0B02EC5A3FA74BD8B9A0987BA14FE869" style="OLC"> <subparagraph id="H3EBC7C32048E467D818DA72F129ACBFE"><enum>(E)</enum><text>if applicable, how funds will be used for activities related to providing mental health services under section 4108; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H14782A1D7D2B419EABC516EEECB1EBC5"><enum>(c)</enum><header>Activities To support the effective use of technology</header><text>Section 4109 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7119">20 U.S.C. 7119</external-xref>) is amended—</text> <paragraph id="H0F5DE87203534047B00E789D8827BC70"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H3DE3E61D27294FFEAAF9CB646C3BBE22"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H8F65E7891DD04185915028CBB86EBAD1"><enum>(B)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="HD0B868D7587548618BED2BC69BBE8712"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="H1FDEA72A9C4D493786BF1EDF86EB4171" style="OLC"> <paragraph id="H7BF4D6F3B949411289643536F2AD4429"><enum>(7)</enum><text>providing technology to improve mental health services.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H97F572B1176F442390E9D678771307D9"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="HA56F3A9FAA1F465DB7E46D6A6F83CF6E"><enum>(A)</enum><text>by striking <quote>A local</quote> and inserting the following:</text>

<paragraph id="H46EF9EBF9D6E4301981E431385272E73"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A local</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H768887BDE28D4169B8EC35A9E976DF1F"><enum>(B)</enum><text>by adding at the end the following:</text>

<paragraph id="H76B032B6914B4A23B814E5AB2C11AEFE"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The limitation described in paragraph (1) shall not apply to technology infrastructure that is also used for mental health services.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section> </legis-body></bill>
