which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit abortions in the admiralty and maritime jurisdiction of the United States, and for other purposes.</official-title></form><legis-body id="H54FF5A6465004E6FBC6A03788848CF0D" style="OLC"><section id="HE869B01BB0BB4CF49C0437298AA63D70" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ban Offshore Abortion Tourism Act</short-title></quote> or the <quote><short-title>BOAT Act</short-title></quote>.</text></section><section id="H221AE2AB85194833BDB33ECAC31108C0"><enum>2.</enum><header>Prohibiting abortion in the certain jurisdictions</header><subsection id="H96E1989137E4444699241853A115AE11"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/74">Chapter 74</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/1531">section 1531</external-xref> the following:</text><quoted-block style="USC" id="H5866835248B44FAC9BBA6B0147245D10" display-inline="no-display-inline"><section id="HF56CB90A21734444A5D82BBEF7A83E23"><enum>1532.</enum><header>Abortions in the admiralty and maritime jurisdiction of the United States</header><subsection id="H27FE64B054C24A9AA8A4C9C7724578C0"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Subject to subsection (b), any person who, in the admiralty and maritime jurisdiction of the United States, knowingly performs an abortion and thereby kills a human fetus shall be fined under this title, imprisoned not more than 5 years, or both.</text></subsection><subsection id="HFD5E64E3C755495E93A1F5C851404D81"><enum>(b)</enum><header>Exception</header><text>Subsection (a) does not apply if—</text><paragraph id="H434BEA23F2024A7AAC4F7A25D78D9B2D"><enum>(1)</enum><text display-inline="yes-display-inline">in reasonable medical judgment, the abortion is necessary to save the life of a pregnant woman whose life is endangered by a physical disorder, physical illness, or physical injury, including a life-endangering physical condition caused by or arising from the pregnancy itself, but not including psychological or emotional conditions;</text></paragraph><paragraph id="HEAFD1309BCE14048A1DD214EE0ED2D4D"><enum>(2)</enum><text display-inline="yes-display-inline">the pregnancy is the result of rape against an adult woman, and at least 48 hours prior to the abortion—</text><subparagraph id="H3DF37D7D4053405892BC8C59E97DBD9F"><enum>(A)</enum><text display-inline="yes-display-inline">she has obtained counseling for the rape; or</text></subparagraph><subparagraph id="HEA7B8745145644DA8C7758DA347A6B3F"><enum>(B)</enum><text display-inline="yes-display-inline">she has obtained medical treatment for the rape or an injury related to the rape; or</text></subparagraph></paragraph><paragraph id="HC62A80B9331746F68FAB1B4F1C2A13BD"><enum>(3)</enum><text display-inline="yes-display-inline">the pregnancy is a result of rape against a minor or incest against a minor, and the rape or incest has been reported at any time prior to the abortion to either—</text><subparagraph id="HE929673D1573456F8ACE67B566EEB748"><enum>(A)</enum><text display-inline="yes-display-inline">a government agency legally authorized to act on reports of child abuse; or</text></subparagraph><subparagraph id="H4CA3E76FBF4240CEB87FC13565649FFA"><enum>(B)</enum><text display-inline="yes-display-inline">a law enforcement agency.</text></subparagraph></paragraph></subsection><subsection id="H54F83C9EA3B04C5494DC8913E38C360E"><enum>(c)</enum><header>Bar to prosecution</header><text display-inline="yes-display-inline">A woman upon whom an abortion in violation of subsection (a) is performed or attempted may not be prosecuted under, or for a conspiracy to violate, subsection (a), or for an offense under section 2, 3, or 4 of this title based on such a violation.</text></subsection><subsection id="HBCF9F10C868D46EC916486EAB37862CD"><enum>(d)</enum><header>Civil remedies</header><paragraph id="HEB75523F1B094180BC6765BB91B0AD36"><enum>(1)</enum><header>Civil action by a woman on whom an abortion is performed</header><text display-inline="yes-display-inline">A woman upon whom an abortion has been performed or attempted in violation of any provision of this section may, in a civil action before the appropriate district court of the United States against any person who committed the violation, obtain appropriate relief.</text></paragraph><paragraph id="HDAEB92D957864845B478BC0420280BD5"><enum>(2)</enum><header>Civil action by a parent of a minor on whom abortion is performed</header><text display-inline="yes-display-inline">A parent of a minor upon whom an abortion has been performed or attempted under an exception provided for in subsection (b)(2)(B), and that was performed in violation of any provision of this section may, in a civil action before the appropriate district court of the United States against any person who committed the violation obtain appropriate relief, unless the pregnancy resulted from the plaintiff’s criminal conduct.</text></paragraph><paragraph id="H77A166AA6F30422CAC67AA99BDA35159"><enum>(3)</enum><header>Appropriate relief</header><text display-inline="yes-display-inline">Appropriate relief in a civil action under this subsection includes—</text><subparagraph id="H81927CFCCE9E432BB2B2D572FF0D9F77"><enum>(A)</enum><text display-inline="yes-display-inline">objectively verifiable money damages for all injuries, psychological and physical, occasioned by the violation; </text></subparagraph><subparagraph id="HA8326F6503954B54A21C5051FBDADD71"><enum>(B)</enum><text>statutory damages equal to three times the cost of the abortion; and </text></subparagraph><subparagraph id="H5927495928974953AB77561E314CFCF7"><enum>(C)</enum><text>punitive damages.</text></subparagraph></paragraph><paragraph id="HD8892EFEE2374B13A7E8B1F59CB82037"><enum>(4)</enum><header>Attorneys’ fees for plaintiff</header><text display-inline="yes-display-inline">If a plaintiff in a civil action under this subsection prevails, the court shall award a reasonable attorney’s fee in favor of the plaintiff against the defendant.</text></paragraph><paragraph id="H3FDBF6D7555E4A5B89C1D0828AC519CB"><enum>(5)</enum><header>Attorneys’ fees for defendant</header><text display-inline="yes-display-inline">If a defendant in a civil action under this subsection prevails and the court finds that the plaintiff’s suit was frivolous, the court shall award a reasonable attorney’s fee in favor of the defendant against the plaintiff.</text></paragraph><paragraph id="H4F5B061F340744D9815ED1C7FE822171"><enum>(6)</enum><header>Award against woman upon whom abortion is performed</header><text display-inline="yes-display-inline">Except under paragraph (5), in a civil action under this subsection, no damages, attorneys’ fees, or other monetary relief may be assessed against the woman upon whom the abortion was performed or attempted.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H67246E5BAB024452898D75BC356F5BC3"><enum>(b)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/74">chapter 74</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/1531">section 1531</external-xref> the following:</text><quoted-block style="USC" id="HBAF25B2236C94C7A9FF5E5FF261F96E3" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1532.
