<section id="H93DFD074E02B48C7AE00359389076519" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the “<short-title>No Funds for Fascists Act</short-title>”. </text></section> <section id="HF9512F4171CC4B06B5DC7F1BBA04E28A"><enum>2.</enum><header>Prohibition on assistance to certain foreign governments</header> <subsection id="HDEBEBAD2848C4438AF0E3D5F95B1A450"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">None of the funds authorized to be appropriated or otherwise made available for assistance, including assistance under the Foreign Assistance Act of 1961, for any fiscal year that begins on or after the date of the enactment of this Act may be obligated or expended to provide assistance to the government of any foreign country if the Secretary of State determines that—</text> 
<paragraph id="H9B9611FEE0854E6DA394E116BA5371F1"><enum>(1)</enum><text>such government, or any employee acting under official authority or influence—</text> <subparagraph id="H802C5AB3054F41F6A17A993AA0B7D8BF"><enum>(A)</enum><text>abridges the right to free speech that would be speech protected by the Constitution of the United States; or</text></subparagraph> 
<subparagraph id="H44A7F29676894B2DB4F6770C2B685031"><enum>(B)</enum><text>censors speech that would be speech protected by the Constitution of the United States; and</text></subparagraph></paragraph> <paragraph id="H5E212FCD9DCB4DE9B1BA3D4E56AE9EB5"><enum>(2)</enum><text>such government, or any employee acting under official authority or influence, uses any form of communication (without regard to whether the communication is visible to members of the public) to direct, coerce, compel, or encourage a provider of a covered platform to take, suggest or imply that a provider of a covered platform should take, or request that a provider of a covered platform take, any action to censor speech that would be speech protected by the Constitution of the United States.</text></paragraph></subsection> 
<subsection id="HC4A21876B8FD4A15B9050EF9D35EBCE7"><enum>(b)</enum><header>Publication in Federal Register</header><text display-inline="yes-display-inline">The Secretary of State shall publish in the Federal Register each determination made under subsection (a).</text></subsection> <subsection id="HEB4EC71BC7214F938345F6313D77A9E0"><enum>(c)</enum><header>Waiver</header><text display-inline="yes-display-inline">Assistance prohibited by subsection (a) may be provided to a country described in that subsection if—</text> 
<paragraph id="HA714BB681B134777BED8BB7349A3AF22"><enum>(1)</enum><text>the President determines that national security interests justify a waiver of subsection (a) with respect to the country; and</text></paragraph> <paragraph id="H5F41DEF7A7AD4825A955BA8C7BDC35E0"><enum>(2)</enum><text>at least 15 days before the waiver takes effect, the President—</text> 
<subparagraph id="H8C66F740B83846FA94376513DBB7E70F"><enum>(A)</enum><text>consults with the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate regarding the proposed waiver; and</text></subparagraph> <subparagraph id="HCA25E67283E1400499B221081057100A"><enum>(B)</enum><text display-inline="yes-display-inline">submits to the Speaker of the House of Representatives and the chairman of the Committee on Foreign Relations of the Senate a report containing—</text> 
<clause id="H2694FA1AB7BF4D06A871ACB690ACCE1D"><enum>(i)</enum><text>the name of the recipient country;</text></clause> <clause id="H58A02202C38A426491B6D6822386BA38"><enum>(ii)</enum><text>a description of the national security interests which require the waiver;</text></clause> 
<clause id="HFEA045765C504FE5B441E41D7B925B91"><enum>(iii)</enum><text>the type and amount of and the justification for the assistance to be provided pursuant to the waiver; and</text></clause> <clause id="HFC292975D3694EC58F2B245B6D10A744"><enum>(iv)</enum><text>the period of time during which such waiver will be effective.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H151C3EBC6C9F492787543472628B11F1"><enum>(d)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H0C18BFB274EB453991DB66359CFFC28E" commented="no"><enum>(1)</enum><text>the term <quote>covered platform</quote> means—</text> 
<subparagraph id="H2422317212B04EDD825BFA84322EBBAE" commented="no"><enum>(A)</enum><text>an interactive computer service, as that term is defined in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>); and</text></subparagraph> <subparagraph id="H7507A24F8CB6400FA411C3A2625694D8" commented="no"><enum>(B)</enum><text>any platform through which a media organization disseminates information, without regard to whether the organization disseminates that information—</text> 
<clause id="HA10C03D72E60433DA56F20AF9764F6C8" commented="no"><enum>(i)</enum><text>through broadcast or print;</text></clause> <clause id="HB45D19AFB867477B92F3F1E566EAE9BD" commented="no"><enum>(ii)</enum><text>online; or</text></clause> 
<clause id="H164E16EF661043C8A91314A3438E92B1" commented="no"><enum>(iii)</enum><text>through any other channel; and</text></clause></subparagraph></paragraph> <paragraph id="HE078AB9E9BE14C22939AD7A8B5F2DB8A"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>employee acting under official authority or influence</quote>, with respect to a foreign government, means—</text> 
<subparagraph id="H09CF1A61271449FC86E21B10495D131E"><enum>(A)</enum><text>any employee of such government; and</text></subparagraph> <subparagraph id="H307BFDE367DD4DC78AB2C584EAAFB0E7"><enum>(B)</enum><text>includes—</text> 
<clause id="H6BCA275D3C4B4197A48EF62DFB8E10D2"><enum>(i)</enum><text>a head of state or head of such government; and</text></clause> <clause id="H1FA1F3EC960B43C486F3B473CCB41310"><enum>(ii)</enum><text>an individual working under contract with such government.</text></clause></subparagraph></paragraph></subsection></section>
