R. 1606</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250226">February 26, 2025</action-date><action-desc><sponsor name-id="F000471">Mr. Fitzgerald</sponsor> (for himself and <cosponsor name-id="F000246">Mr. Fallon</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committees on <committee-name committee-id="HSM00">Small Business</committee-name>, and <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To impose additional requirements for covered agencies in regulatory flexibility analysis.</official-title></form><legis-body id="HBE528D9B738642E09F97C3694457C6A6" style="OLC"><section id="H9FE549E7BDEF41C3BD005FD3D3597137" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making the CFPB Accountable to Small Businesses Act of 2025</short-title></quote>.</text></section><section id="HA094715142034CECBA6FC20E8B87C49C"><enum>2.</enum><header>Rulemaking under Dodd-Frank Wall Street Reform and Consumer Protection Act</header><text display-inline="no-display-inline">Section 1022(b)(2)(A) of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512(b)(2)(A)</external-xref>) is amended—</text><paragraph id="H9C410E6D5F9A46149BD190FD7650FE87"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H08E095D104CC44CCB078186303D62728"><enum>(2)</enum><text>in clause (ii), by striking the semicolon at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HFA2BA60BE40142278CD4A6278A187158"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H381F2D18ECE64096A7CAC5C77817EBBA" display-inline="no-display-inline"><clause id="H02A1D34D96284D79AAFD2A6BDECB06B3"><enum>(iii)</enum><text display-inline="yes-display-inline">the impact of proposed rules on small entities, in accordance with section 609 of title 5, United States Code;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HD72FD227C84E49419839AAC0DC8704E5"><enum>3.</enum><header>Initial regulatory flexibility analysis</header><text display-inline="no-display-inline">Section 603(d)(1) of title 5, United States Code, is amended—</text><paragraph id="HC3D13DFD28824094BEC8AFFB52F67A17"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H6228F5CC4CFA44F5989432F2807EED9D"><enum>(2)</enum><text>in subparagraph (C), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H15D4813EA52345CCBD72B428BE8CE7FB"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H4B4B271705C440179C3481F5145E9A16" display-inline="no-display-inline"><subparagraph id="H079ED9A3F299459D9C60AB74A1A22458"><enum>(D)</enum><text display-inline="yes-display-inline">where the covered agency does not adopt any alternatives described in paragraphs (1) through (4) of subsection (c), a detailed justification of the covered agency’s determination that the relative size and resources of small entities should have no bearing on the rule, supported by factual, policy and legal reasons. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H39211CB1C2484C3898529D06CA0E3DAC"><enum>4.</enum><header>Final regulatory flexibility analysis</header><text display-inline="no-display-inline">Section 604(a) of title 5, United States Code, is amended in the second paragraph (6) to read as follows:</text><quoted-block style="USC" id="H1AA9AD1B728447F2BFAB146816AB8E6D" display-inline="no-display-inline"><paragraph id="H24C00DC8E0E24BF8B2E47B4841A52174"><enum>(7)</enum><text display-inline="yes-display-inline">for a covered agency, as defined in section 609(d)(2), a description of the steps the agency has taken to minimize any additional cost of credit for small entities and, where no significant alternatives for small entities was adopted, a detailed justification of the covered agency’s determination that the relative size and resources of small entities should have no bearing on the rule, supported by factual, policy and legal reasons.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
