R. 1605</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250226">February 26, 2025</action-date><action-desc><sponsor name-id="F000471">Mr. Fitzgerald</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to clarify the nature of judicial review of agency interpretations of statutory and regulatory provisions.</official-title></form><legis-body id="H342100391080415D9F8E4E906AC47D82" style="OLC"><section id="H76F4E019170145B4BF704A2E633086F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Separation of Powers Restoration Act of 2025</short-title></quote> or the <quote>SOPRA</quote>.</text></section><section id="HFA7CEB385C674B619C1F4DCA6E4A8D6F"><enum>2.</enum><header>Judicial review of statutory and regulatory interpretations</header><text display-inline="no-display-inline">Section 706 of title 5, United States Code, is amended—</text><paragraph id="HAC8B1C199A5F46C4A5EB815AEDEC3DD8"><enum>(1)</enum><text>by striking <quote>To the extent necessary</quote> and inserting <quote>(a) To the extent necessary</quote>;</text></paragraph><paragraph id="H9295FDEC88B04D3F912799A1AC150C38"><enum>(2)</enum><text>by striking <quote>decide all relevant questions of law, interpret constitutional and statutory provisions, and</quote>;</text></paragraph><paragraph id="HA4EE02B39D244B15BC06096CFD4F877D"><enum>(3)</enum><text>by inserting after <quote>of the terms of an agency action</quote> the following <quote>and decide de novo all relevant questions of law, including the interpretation of constitutional and statutory provisions, and rules made by agencies. Notwithstanding any other provision of law, this subsection shall apply in any action for judicial review of agency action authorized under any provision of law. No law may exempt any such civil action from the application of this section except by specific reference to this section</quote>; and </text></paragraph><paragraph id="H2DB92B56C8A94ED980068C522C21E575"><enum>(4)</enum><text>by striking <quote>The reviewing court shall—</quote> and inserting the following: </text><quoted-block style="USC" id="HF9058B9DD1834FAE9DE1BFF41CE1A35F" display-inline="no-display-inline"><subsection id="HB72D9E778F464DAAA29D6F6457EADA63"><enum>(b)</enum><text display-inline="yes-display-inline">The reviewing court shall—</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
