which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committees on <committee-name committee-id="HAG00">Agriculture</committee-name>, and <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Assistant Secretary of Commerce for Communications and Information to report to Congress on any barriers to establishing online portals to accept, process, and dispose of certain Form 299s, and for other purposes.</official-title></form><legis-body id="HA9773EF785D643D8B976B8DBF02E47EC" style="OLC"><section id="H97C8F38A493E43FBB7F153F4036FF611" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Facilitating the Deployment of Infrastructure with Greater Internet Transactions And Legacy Applications Act</short-title></quote> or the <quote><short-title>Facilitating DIGITAL Applications Act</short-title></quote>. </text></section><section id="H939046711A7944B88CC19264E496D7B2" section-type="subsequent-section"><enum>2.</enum><header>Report on barriers to establishing online portals to accept, process, and dispose of certain Form <enum-in-header>299s</enum-in-header></header><subsection id="H18DD5B4A6CFB4CB2B10F6E0A36A3BF51"><enum>(a)</enum><header>Report</header><paragraph id="H7F44BBA87014436CA3BC86259C233E0C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this section, and every 60 days thereafter until the Secretaries concerned each notify the Assistant Secretary under paragraph (2), the Assistant Secretary shall submit to the appropriate congressional committees a report that describes—</text><subparagraph id="H06987A0E284F46F8A0E82EFC49E32750"><enum>(A)</enum><text>whether the Secretaries concerned have established, with respect to the relevant covered department, an online portal for the acceptance, processing, and disposal of a Form 299 for communications use authorization; and</text></subparagraph><subparagraph id="H71C7648F3C0D410F82502D75D8649F87"><enum>(B)</enum><text>any barrier to the establishment of any such portal.</text></subparagraph></paragraph><paragraph id="HBAE019B1481D4E9BA1752A21AA7F4427" commented="no"><enum>(2)</enum><header>Notification</header><text>Not later than 3 business days after the date on which the online portal has been established by a Secretary pursuant to paragraph (1), that Secretary shall notify the Assistant Secretary of the establishment of such portal.</text></paragraph></subsection><subsection id="HD0B4493C51A34B68811CEF0E2AFCC36A"><enum>(b)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="HA9431A6CB953484A9BE0FFC45B50458E"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H01CB299C155B4C1CB3F5B4B8BF01CE6D"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></subparagraph><subparagraph id="H6B7F96E276DA449AAF581A262BA2BBDF"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives;</text></subparagraph><subparagraph id="H40F4FF454E56482E9FD061670DB7BE5F"><enum>(C)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph><subparagraph id="H686C63180B544F0499D95F0C7D604615"><enum>(D)</enum><text>the Committee on Environment and Public Works of the Senate.</text></subparagraph></paragraph><paragraph id="H5A2462843C404F7FBB080BA7CA3250FD"><enum>(2)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph><paragraph id="H5BABB8C2091F442190A2CE52D5DCD480" display-inline="no-display-inline" commented="no"><enum>(3)</enum><header>Communications facility</header><text display-inline="yes-display-inline">The term <term>communications facility</term> has the meaning given the term <quote>communications facility installation</quote> in section 6409(d) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(d)</external-xref>).</text></paragraph><paragraph id="H2A76E850696C4852BC4F9BAEB7ECD46D" commented="no"><enum>(4)</enum><header>Communications use</header><text>The term <term>communications use</term> means the placement and operation of a communications facility.</text></paragraph><paragraph id="HAED6C7FF50C24D7BB7F84DE2FB2EF28D" display-inline="no-display-inline" commented="no"><enum>(5)</enum><header>Communications use authorization</header><text display-inline="yes-display-inline">The term <term>communications use authorization</term> means an easement, right-of-way, lease, license, or other authorization—</text><subparagraph id="HFC8D1D791F734D10A49BAC66B9A1F95B" commented="no"><enum>(A)</enum><text>provided by the Secretary of the Interior or the Secretary of Agriculture;</text></subparagraph><subparagraph id="H7E3CF84FEF024667A96E9C87F78E7F42" commented="no"><enum>(B)</enum><text>to locate or modify a communications facility on covered land; and</text></subparagraph><subparagraph id="H290CB6BE28CF436E8FB747C30CBFBCEF" commented="no"><enum>(C)</enum><text>for the primary purpose of authorizing the occupancy and use of such covered land for communications use.</text></subparagraph></paragraph><paragraph id="HD361203137D64EE1BC11906DB7841B0F"><enum>(6)</enum><header>Covered land</header><text>The term <quote>covered land</quote> means—</text><subparagraph id="HB6663FFE028C407D9C1E4453EB805A99"><enum>(A)</enum><text>public lands; and</text></subparagraph><subparagraph id="HF142F7C253B74BDA912B1A8F0A7997D1"><enum>(B)</enum><text>National Forest System land.</text></subparagraph></paragraph><paragraph id="HCA8E8A7F7FC24E13BF422A5CA4E1FFF8"><enum>(7)</enum><header>Form <enum-in-header>299</enum-in-header></header><text display-inline="yes-display-inline">The term <term>Form 299</term> means the form established under section 6409(b)(2)(A) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(b)(2)(A)</external-xref>), or any successor form.</text></paragraph><paragraph id="HCC21F05C31FF4DCDB24169B98D926ED2" display-inline="no-display-inline"><enum>(8)</enum><header>National Forest System</header><text>The term <term>National Forest System</term> has the meaning given that term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="H91E41949FD3A438EA906717358EB3FDE"><enum>(9)</enum><header>Relevant covered department</header><text>The term <term>relevant covered department</term> means—</text><subparagraph id="H17400EA8DDD447B1A70957799B34D0C7"><enum>(A)</enum><text>with respect to the Secretary of the Interior, the Department of the Interior; and</text></subparagraph><subparagraph id="H826F7B661F25447CB9A6F17837DB164D"><enum>(B)</enum><text>with respect to the Secretary of Agriculture, the Department of Agriculture.</text></subparagraph></paragraph><paragraph id="H9BC4A04082A24EE39D5710B73A984D23" commented="no"><enum>(10)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="H49318A2B75C34C8D831270B0C5EF4ECA" commented="no"><enum>(A)</enum><text>the Secretary of the Interior; and</text></subparagraph><subparagraph id="H98886A2E56894DEB839B9E521BEF291D" commented="no"><enum>(B)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
