<section id="H802EDBAB3CF84213AF77D7455BB4C1E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Claims Education Act of 2025</short-title></quote>.</text></section> <section id="H2539D45F95564257A53211EAC50F6693" section-type="subsequent-section"><enum>2.</enum><header>Promotion of assistance from persons recognized by the Secretary of Veterans Affairs for individuals who file certain claims under laws administered by the Secretary</header> <subsection id="H4B8F3D7EFCE54E48A617BF518949DE58"><enum>(a)</enum><header>Notice to claimants of available assistance from recognized persons</header><text>Section 5103A of title 38, United States Code, is amended—</text> 
<paragraph id="H99719B25B5604F709379E5CF99DDF818"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (g) through (i) as subsections (i) through (k), respectively;</text></paragraph> <paragraph id="H2CCBD96EFAF04DB6B20970FCD1864641"><enum>(2)</enum><text>by inserting after subsection (f) the following new subsections:</text> 
<quoted-block style="USC" id="HF6EF0CE30DCB481FA306C233942E1320" display-inline="no-display-inline"> 
<subsection id="H1BDB39CDB32945F581CF3C47CD21A99E" display-inline="no-display-inline"><enum>(g)</enum><text display-inline="yes-display-inline">Upon receipt of an initial claim by a claimant not represented by an accredited person, the Secretary shall provide notice to the claimant that—</text> <paragraph id="H9FCEE69B4C8F4F3A8743025424E717CF"><enum>(1)</enum><text display-inline="yes-display-inline">an accredited person may be able to represent the claimant;</text></paragraph> 
<paragraph id="HFBBCFFCFAC80418CBCD898248BC1B497"><enum>(2)</enum><text display-inline="yes-display-inline">a veterans service organization recognized under section 5902 of this title may represent the claimant at no charge to the claimant;</text></paragraph> <paragraph id="H048EB48405544F1089B6854C5567AA90"><enum>(3)</enum><text display-inline="yes-display-inline">provides the web address of the online tool maintained under subsection (h); and</text></paragraph> 
<paragraph id="H483D7CE0915E41058F402B396F20FF06"><enum>(4)</enum><text display-inline="yes-display-inline">provides the web address of an appropriate and publicly accessible website of the Department through which a claimant may report—</text> <subparagraph id="H82E53CB51DF94DCD9A1EEEB956F2B183"><enum>(A)</enum><text display-inline="yes-display-inline">a person, who is not an accredited person, who represented the claimant; and</text></subparagraph> 
<subparagraph id="H18AE28E4A5C841359DAE752101BB6ED4"><enum>(B)</enum><text>any fee charged by such person for such representation.</text></subparagraph></paragraph></subsection> <subsection id="H47A051841A2A4F8A87C03A73BC722E3A"><enum>(h)</enum> <paragraph id="HE0123E5D37174BA9BB0A1084443AB6B0" display-inline="yes-display-inline"><enum>(1)</enum><text>The Secretary shall maintain an online tool that allows a claimant to search a list of accredited persons who represent claimants.</text></paragraph> 
<paragraph id="HFB834988189F4F798572C39960EC68F1" indent="up1"><enum>(2)</enum><text>The Secretary shall ensure that such list is current at least once each calendar quarter.</text></paragraph> <paragraph id="H6C64DD5AAC9C40429A454A1D86A1C621" indent="up1"><enum>(3)</enum><text>The Secretary shall ensure that such tool is easily accessible to a claimant.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HCB2A5847AD8B468DAA08ED39DE161DFA"><enum>(3)</enum><text>by adding at the end the following new subsection:</text> <quoted-block style="USC" id="HC8C86630617541A798A8C056A7DE6F7B" display-inline="no-display-inline"> <subsection id="HC0708B32D5DF4D638C47577A6DB8B503"><enum>(l)</enum><text>In this section:</text> 
<paragraph id="H4F31AE515BBB49658597E4BBA887E051"><enum>(1)</enum><text>The term <quote>accredited person</quote> means—</text> <subparagraph id="HAE1D2D3402524ACE92B86536ABC86EDD"><enum>(A)</enum><text display-inline="yes-display-inline">a veterans service organization recognized under section 5902 of this title; or</text></subparagraph> 
<subparagraph id="H0234ACE9E9794051896DA215D0D7EB00"><enum>(B)</enum><text>an attorney, agent, or other person recognized under section 5904 of this title.</text></subparagraph></paragraph> <paragraph id="H6E1319AF70844822907292D7B297A90E"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>represent</quote> means to prepare, present, or prosecute a claim under a law administered by the Secretary on behalf of a claimant.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4852AC51F2F74D289311A74C7445B3EE"><enum>(b)</enum><header>Online information regarding persons that assist claimants</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall include, in each web portal of the Department of Veterans Affairs, through which an individual may file a claim for a benefit administered by the Under Secretary for Benefits or the Under Secretary for Health, a warning regarding fees an agent or attorney may charge such individual for assistance in filing such claim. Such warning shall include the following:</text> <paragraph id="HA8A936D937BA47CB9818424059F9C91A"><enum>(1)</enum><text>A link to the online maintained under subsection (h) of section 5103A of such title, as amended by subsection (a).</text></paragraph> 
<paragraph id="H04DA0EFD70AF4B3694F84CDD1DD458A3"><enum>(2)</enum><text display-inline="yes-display-inline">A link to the website of the Department described in subparagraph (D) of section 5103A(f)(1) of such title, as amended by subsection (a).</text></paragraph></subsection> <subsection id="HF4C9A2214A24428995D57E26A01C6456"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall—</text> 
<paragraph id="H03F6EF58409447CE8F1D931A874115B9"><enum>(1)</enum><text display-inline="yes-display-inline">complete a review the regulations, processes, and procedures of the Department of Veterans Affairs that pertain to recognition under section 5904 of title 38, United States Code;</text></paragraph> <paragraph id="HDB5D89DC590048B1835E4A4AEA0BC74C"><enum>(2)</enum><text display-inline="yes-display-inline">develop recommendations for legislative or administrative action to improve such regulations, processes, and procedures; and</text></paragraph> 
<paragraph id="H49C9DE504A764144B6FB2DB995138A42"><enum>(3)</enum><text display-inline="yes-display-inline">submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report containing the findings of the Secretary with respect to the review completed under paragraph (1) and the recommendations developed under paragraph (2).</text></paragraph></subsection></section> </legis-body></bill>
