<section id="H9CAFF76D1E9C4B5FB6F1A75A305FB31F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting American Agriculture from Foreign Adversaries Act of 2025</short-title></quote>.</text></section> <section id="HD90FC839EC4E4233BF5C977C380C5C87"><enum>2.</enum><header>Inclusion of Secretary of Agriculture on Committee on Foreign Investment in United States and consideration of certain agricultural land transactions</header> <subsection id="H920FFB3B6AD548C79454EE91AA2926BD"><enum>(a)</enum><header>Inclusion on the committee</header><text display-inline="yes-display-inline">Section 721(k) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(k)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H77452D3284FF4B72AD98C445E09A62FF"> 
<paragraph id="H92E22090FB4F4DBEB27F1AED3E327D6B"><enum>(8)</enum><header>Inclusion of the Secretary of Agriculture</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall be a member of the Committee with respect to a covered transaction that involves—</text> <subparagraph id="H2CEB4A81BAE1420D8F58D4B1B97D4C00"><enum>(A)</enum><text>agricultural land;</text></subparagraph> 
<subparagraph id="H4F69DB65C0594C1DB1B53BF49B74E6A8"><enum>(B)</enum><text>agriculture biotechnology; or</text></subparagraph> <subparagraph id="H21715D60358445B7B03D11CBD6CAD61D"><enum>(C)</enum><text>the agriculture industry, including agricultural—</text> 
<clause id="H3C7C06DDFFCC403B90E8A9BB74CB31A8"><enum>(i)</enum><text>transportation;</text></clause> <clause id="H16D66E06612E459C90CB838E5B8ABFEC"><enum>(ii)</enum><text>storage; and</text></clause> 
<clause id="HC196D981410B4F389D2363209A68FAF1"><enum>(iii)</enum><text>processing.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HEF3CE50764494A9DA916DEBA675B3917" display-inline="no-display-inline"><enum>(b)</enum><header>Consideration of certain agricultural land transactions</header><text>Section 721(b)(1) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(b)(1)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H95BAE253821049938E867354E3418E1A" display-inline="no-display-inline"> 
<subparagraph id="HAEBF4737CC1048C29D729CC05A3DB0D2"><enum>(I)</enum><header>Consideration of certain agricultural land transactions</header> 
<clause id="H033FB07DC465416696E90C707A7BA078"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">After receiving notification from the Secretary of Agriculture of a reportable agricultural land transaction, the Committee shall determine—</text> <subclause id="H887F05BB8F0741DBAEE3083943C8D0D0"><enum>(I)</enum><text display-inline="yes-display-inline">whether the transaction is a covered transaction; and</text></subclause> 
<subclause id="H424F501CE6424907AEF96B6FEB3D2B87"><enum>(II)</enum><text>if the Committee determines that the transaction is a covered transaction, whether the Committee should initiate a review pursuant to subparagraph (D), or take another action authorized under this section, with respect to the reportable agricultural land transaction.</text></subclause></clause> <clause id="H7B8003B298DC4EEF89B84E9A07DD4ABA"><enum>(ii)</enum><header>Reportable agricultural land transaction</header><text display-inline="yes-display-inline">In this subparagraph, the term <quote>reportable agricultural land transaction</quote> means a transaction—</text> 
<subclause id="HFD844BA341EE42628454CCD27AC4779B"><enum>(I)</enum><text display-inline="yes-display-inline">that the Secretary of Agriculture has reason to believe is a covered transaction;</text></subclause> <subclause id="H543535EF075A4BD6861D426289B566F6"><enum>(II)</enum><text display-inline="yes-display-inline">that involves the acquisition of an interest in agricultural land by a foreign person of the People’s Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, or the Islamic Republic of Iran; and</text></subclause> 
<subclause id="H93E0A52E73F5447080EA9A9468DDE38A"><enum>(III)</enum><text>with respect to which a person is required to submit a report to the Secretary of Agriculture under section 2(a) of the Agricultural Foreign Investment Disclosure Act of 1978.</text></subclause></clause> <clause id="HED084836E12F4B9283AB1FF10C78FA96"><enum>(iii)</enum><header>Sunset</header><text display-inline="yes-display-inline">The requirements under this subparagraph shall terminate, with respect to a foreign person of the respective foreign country, on the date that the People’s Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, or the Islamic Republic of Iran, as the case may be, is removed from the list of foreign adversaries in section 791.4 of title 15, Code of Federal Regulations. </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
