which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Mineral Leasing Act to streamline the oil and gas permitting process and to recognize fee ownership for certain oil and gas drilling or spacing units, and for other purposes.</official-title></form><legis-body id="H25EEEDE4625E4A2CBF13BC8E10D76772" style="OLC"><section id="HAAC8EBA99CA547918AFC13EF936F8650" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bureau of Land Management Mineral Spacing Act</short-title></quote>.</text></section><section id="HCFE0F08C971D4B70A7B8FB700046FE00" section-type="subsequent-section"><enum>2.</enum><header>Access to federal energy resources from non-federal surface estate</header><text display-inline="no-display-inline">Section 17 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H4E6F48DD1BBA4586B321810B0942F771" style="OLC"><subsection id="HBF9C81FB78CC4108B4CC0FE8F38692DB"><enum>(r)</enum><header>No federal permit required for oil and gas activities on certain land</header><paragraph id="HBAF7817044E4454FA4E16AB84063B594"><enum>(1)</enum><header>In general</header><text>The Secretary shall not require an operator to obtain a Federal drilling permit for oil and gas exploration and production activities conducted on non-Federal surface estate, provided that—</text><subparagraph id="H6D81E17554F04B8D991289F9793E1D9D"><enum>(A)</enum><text>the United States holds an ownership interest of less than 50 percent of the subsurface mineral estate to be accessed by the proposed action; and</text></subparagraph><subparagraph id="H8CF39310C3184531B70C3FCC4A7B9FB7"><enum>(B)</enum><text>the operator submits to the Secretary a State permit to conduct oil and gas exploration and production activities on the non-Federal surface estate.</text></subparagraph></paragraph><paragraph id="HECE1C28922B046B1BD7A6708A2A70451"><enum>(2)</enum><header>No federal action</header><text>An oil and gas exploration and production activity carried out under paragraph (1)—</text><subparagraph id="H50230FBAAD044A5AA1DE807583CF2EA5"><enum>(A)</enum><text>shall not be considered a major Federal action for the purposes of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>);</text></subparagraph><subparagraph id="H33111ADF617A4A2B9054A2347A349F10"><enum>(B)</enum><text>shall require no additional Federal action;</text></subparagraph><subparagraph id="H943ABE3035DD46F193C340E67E3D7E8E"><enum>(C)</enum><text>may commence 30 days after submission of the State permit to the Secretary; and</text></subparagraph><subparagraph id="HEFE90BACB2FF4CC6ABC7F41B075887B7"><enum>(D)</enum><text>shall not be subject to—</text><clause id="HA2DA66289EC14D1EA86C9A1CA247506B"><enum>(i)</enum><text>section 306108 of title 54, United States Code (commonly known as the National Historic Preservation Act of 1966); and</text></clause><clause id="H72944795C0A84A258E578574CB51ABF0"><enum>(ii)</enum><text>section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="H2C158C386D9040F4A01CC78A40BBED4B"><enum>(3)</enum><header>Royalties and production accountability</header><subparagraph commented="no" display-inline="yes-display-inline" id="H4BC095E634E1489A9A36F2AA80C0F785"><enum>(A)</enum><text>Nothing in this subsection shall affect the amount of royalties due to the United States under this Act from the production of oil and gas, or alter the Secretary’s authority to conduct audits and collect civil penalties pursuant to the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1701">30 U.S.C. 1701 et seq.</external-xref>).</text></subparagraph><subparagraph id="HE4369D0BB623432D8EB8199DB422378B" indent="up1"><enum>(B)</enum><text>The Secretary may conduct onsite reviews and inspections to ensure proper accountability, measurement, and reporting of production of Federal oil and gas, and payment of royalties.</text></subparagraph></paragraph><paragraph id="H97F79D488B3D41DBA6361E2820ACE125"><enum>(4)</enum><header>Nonapplicability to Indian lands</header><text display-inline="yes-display-inline">This subsection shall not apply to Indian lands.</text></paragraph><paragraph id="H934AC84C8F08443F97DD2544A896907C"><enum>(5)</enum><header>Indian land</header><text>In this subsection, the term <term>Indian land</term> means—</text><subparagraph id="H92E1608A44764FD8B568860C95399BB9"><enum>(A)</enum><text display-inline="yes-display-inline">any land located within the boundaries of an Indian reservation, pueblo, or rancheria; and</text></subparagraph><subparagraph id="HE3F42C31E1114BD09A4ED6C06BA864FB"><enum>(B)</enum><text>any land not located within the boundaries of an Indian reservation, pueblo, or rancheria, the title to which is held—</text><clause id="H94E0220C7A05445591BF51AD0858E288"><enum>(i)</enum><text>in trust by the United States for the benefit of an Indian tribe or an individual Indian;</text></clause><clause id="HFE708BC1CA304D6B93A906C1A5CE3161"><enum>(ii)</enum><text>by an Indian tribe or an individual Indian, subject to restriction against alienation under laws of the United States; or</text></clause><clause id="HD4B2C23111CE41E7BD006E44C5D69748"><enum>(iii)</enum><text>by a dependent Indian community.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
