<section id="H7B4D4974289C4676823982932D7AABB9" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wireless Broadband Competition and Efficient Deployment Act</short-title></quote>.</text></section> <section id="H27EC4F10F8D9454FA64773ED0F2C06C8"><enum>2.</enum><header>Application of NEPA and NHPA to collocation of certain personal wireless service facilities</header> <subsection id="H30CF2854B9CA4C0C958A3471D4B1F557"><enum>(a)</enum><header>NEPA exemption</header><text display-inline="yes-display-inline">A Federal authorization with respect to a covered project may not be considered a major Federal action under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></subsection>
<subsection id="HF20CF271364B4F1E85FFFE0E19B6861D"><enum>(b)</enum><header>National Historic Preservation Act exemption</header><text display-inline="yes-display-inline">A covered project may not be considered an undertaking under section 300320 of title 54, United States Code.</text></subsection> <subsection id="H1996C07B10524636B41EDE82D1AE72D4"><enum>(c)</enum><header>Definitions</header><text>In this section: </text>
<paragraph id="HC88BB82E1A334E24A73EF67E28474B7F"><enum>(1)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission. </text></paragraph> <paragraph id="H3A0FDE3C0DEA4C2787A73A4E347086CD" commented="no"><enum>(2)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means a project—</text>
<subparagraph id="H56A6789718D7496E95750858D9C9A3B0" commented="no"><enum>(A)</enum><text>for—</text> <clause id="H52CA4AAA7D2040E7A86B882479FCFB9D"><enum>(i)</enum><text display-inline="yes-display-inline">the mounting or installation of an eligible personal wireless service facility with another eligible personal wireless service facility that exists at the time at which a complete request for authorization of such mounting or installation is filed with a State or local government or instrumentality thereof or with an Indian Tribe; or</text></clause>
<clause id="H7FCD96B0DA6D4EE7B08C06853071D21A" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the modification of an eligible personal wireless service facility; and</text></clause></subparagraph> <subparagraph id="H08613A0B4D4C4782AE9E9AB4AAC65181"><enum>(B)</enum><text display-inline="yes-display-inline">for which a permit, license, or approval from the Commission is required or that is otherwise subject to the jurisdiction of the Commission.</text></subparagraph></paragraph>
<paragraph id="H3430825D93294DAD8C9E77B3431F4849" commented="no"><enum>(3)</enum><header>Eligible personal wireless service facility</header><text display-inline="yes-display-inline">The term <term>eligible personal wireless service facility</term> means any antenna, apparatus, or transmitting device, and any equipment, switches, wiring, cabling, power sources, shelters, or cabinets, for the provision of a personal wireless service.</text></paragraph> <paragraph id="H198AD41DCF1A4472AAD3AFAEECB87405"><enum>(4)</enum><header>Federal authorization</header><text>The term <quote>Federal authorization</quote>—</text>
<subparagraph id="H3E34D99A2533494CA5F1E7FF7B0AC5AC"><enum>(A)</enum><text>means any authorization required under Federal law with respect to a covered project; and</text></subparagraph> <subparagraph id="H3082AB04306B4DB5B7E2543E439529EF"><enum>(B)</enum><text>includes any permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law with respect to a covered project.</text></subparagraph></paragraph>
<paragraph id="H1BDDB3AAC37D41B09230DD43742C2D8A"><enum>(5)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <quote>Indian Tribe</quote> has the meaning given the term <quote>Indian tribe</quote> under section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>).</text></paragraph> <paragraph id="HC3BFF4AD6918421BB4B1D61EC4B8FCB0"><enum>(6)</enum><header>Personal wireless services</header><text>The term <term>personal wireless services</term>—</text>
<subparagraph id="H1C3057FF0C3E4F5CA388C7965C71BBF5"><enum>(A)</enum><text>has the meaning given such term in section 332(c)(7)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(c)(7)(C)</external-xref>); and</text></subparagraph> <subparagraph id="H23A522B8524F4328AD7056DE79869865"><enum>(B)</enum><text>also includes commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>)).</text></subparagraph></paragraph>
<paragraph id="HDBB3DDBA015545BFB22AFD651236871D" commented="no"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State of the United States, the District of Columbia, and each territory or possession of the United States.</text></paragraph></subsection></section> </legis-body></bill>
