R. 1535</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250224">February 24, 2025</action-date><action-desc><sponsor name-id="M001241">Mr. Min</sponsor> (for himself, <cosponsor name-id="S001218">Ms. Stansbury</cosponsor>, <cosponsor name-id="A000381">Ms. Ansari</cosponsor>, <cosponsor name-id="P000617">Ms. Pressley</cosponsor>, and <cosponsor name-id="C001130">Ms. Crockett</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To repeal President Donald Trump’s January 20, 2025, Executive Order titled <quote>Establishing and Implementing the President’s <quote>Department of Government Efficiency</quote></quote>, and for other purposes.</official-title></form><legis-body id="HDC8F68FD0BB64DB887733598B056F14F" style="OLC"><section id="H31C738B369B0411B8E5B4111C1E37FAC" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bolstering America’s Democracy and Demanding Oversight and Government Ethics Act</short-title></quote> or the <quote><short-title>BAD DOGE Act</short-title></quote>. </text></section><section id="HDC5C44BBD191419CB441D62E58A6E593"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="HBC1B7E3B09DD4DF5B42AD3089F4960E3"><enum>(1)</enum><text display-inline="yes-display-inline">The United States DOGE Service (in this section referred to as <quote>USDS</quote>) (formerly known as the United States Digital Service) and the U.S. DOGE Service Temporary Organization (in this section, referred to as <quote>USDSTO</quote>) created by Executive Order 14158 (90 Fed. Reg. 8441; relating to establishing and implementing the President’s <quote>Department of Government Efficiency</quote>) (in this section referred to as <quote>the DOGE Executive Order</quote>) are operating beyond the scope of their authorities and organizational purposes.</text></paragraph><paragraph id="HEC8E3548FCF84807B83D1EBECDEFC5FC"><enum>(2)</enum><text display-inline="yes-display-inline">The DOGE Executive Order specifically creates the USDSTO as a <quote>temporary organization</quote> in accordance with section 3161 of title 5, United States Code, which limits the purpose of such an organization to <quote>performing a specific study or other project</quote>.</text></paragraph><paragraph id="H352DD1B9601A475B93C2E8FBDDB35582"><enum>(3)</enum><text display-inline="yes-display-inline">The DOGE Executive Order specifies that the USDSTO shall be headed by the USDS Administrator, who is to be appointed by the Office of Management and Budget, and shall be dedicated to advancing the President’s DOGE agenda.</text></paragraph><paragraph id="H71F70CA46A2F4A5DAFBA1696903E6559"><enum>(4)</enum><text display-inline="yes-display-inline">This DOGE agenda is described in the DOGE Executive Order as a <quote>Software Modernization Initiative</quote> led by the USDS Administrator to <quote>improve the quality and efficiency of government-wide software, network infrastructure, and information technology (IT) systems</quote>. </text></paragraph><paragraph id="HF27ED8A91FC64A5D952DA469053DCECE"><enum>(5)</enum><text display-inline="yes-display-inline">The DOGE Executive Order additionally specifies that USDS shall adhere to rigorous data protection standards.</text></paragraph><paragraph id="H1607DDDA861B4AEA8073942B2E9AAC28"><enum>(6)</enum><text display-inline="yes-display-inline">In fact, both the USDS and USDSTO are being led by Elon Musk, who was not appointed as USDS Administrator.</text></paragraph><paragraph id="HCEFD1579D13B416E87619AEB85EF5FB8"><enum>(7)</enum><text>There are no government records indicating that Mr. Musk has any formal role with the Federal Government, or that he is complying with any disclosure or conflict-of-interest requirements that would apply to Federal employees or officials.</text></paragraph><paragraph id="H55E439EEC6B044C3B9864B6CACCEFED9"><enum>(8)</enum><text>The White House subsequently indicated that Mr. Musk is a <quote>special government employee</quote> but has not produced any evidence that he was retained in this role, or that he is complying with any rules or laws that would be required for a Federal employee or the USDS Administrator.</text></paragraph><paragraph id="H21280F9144844E6B8FF5327DEB20DC57"><enum>(9)</enum><text display-inline="yes-display-inline">According to numerous media reports and first-hand accounts, including social media posts and press statements from Mr. Musk himself, under the leadership of Mr. Musk, the USDSTO has taken actions that go far beyond what the DOGE Executive Order authorized either USDS or USDSTO to do, including freezing payments to different Federal agencies and programs, acquiring personnel information for all Federal employees from the Office of Personnel Management (in this section referred to as <quote>OPM</quote>), gaining control over and access to the Department of Treasury’s Bureau of Fiscal Services (in this section referred to as <quote>BFS</quote>) Federal payments system and its associated data, locking Federal employees out of their computer systems, offering Federal employees a buyout, and ostensibly terminating Federal agencies, bureaus, and programs created by and funded by Congress.</text></paragraph><paragraph id="HBF1D1BEF1B7342B18F6C02A8E2B51CA7"><enum>(10)</enum><text>These actions are inconsistent with the provisions of the DOGE Executive Order and also with what a <quote>temporary organization</quote> is statutorily permitted to do.</text></paragraph><paragraph id="H274AC62E8C6449D3A8454A47F9DC1892"><enum>(11)</enum><text display-inline="yes-display-inline">Mr. Musk’s actions and authorities also grossly exceed what he might be permitted to do as a <quote>special government employee</quote>.</text></paragraph><paragraph id="H99B6DC8081A841698BC2E5E41665ED6F"><enum>(12)</enum><text display-inline="yes-display-inline">The USDS and the USDSTO, under the direction of Mr. Musk, are repeatedly violating a number of Federal statutes and provisions of the United States Constitution.</text></paragraph><paragraph id="HD3C4A4E411034E01973F8821AC4F80CB"><enum>(13)</enum><text display-inline="yes-display-inline">USDS, USDSTO, and Mr. Musk have reportedly gained access to OPM’s personnel files, gained control and access to BFS’s payments systems and associated data, sent a buyout offer to all Federal employees, attempted to dismantle the United States Agency for International Development and the Consumer Financial Protection Bureau without congressional approval, and removed public health information from the Centers for Disease Control and Prevention and the Food and Drug Administration websites, among other things.</text></paragraph><paragraph id="HDCF6374467D74BFEB51B42B3F4CD17EC"><enum>(14)</enum><text display-inline="yes-display-inline">These actions violate the Constitution, including Article I, section 1 (Separation of Powers), Article I, section 7 (Presentment and Appropriations Clause), Article I, section 8 (Spending Clause), and Article II, section 3 (Take Care Clause).</text></paragraph><paragraph id="HB5C629B876F045878EEE197D38B109F2"><enum>(15)</enum><text display-inline="yes-display-inline">These actions also violate a broad array of Federal statutes, including—</text><subparagraph id="H93E156817EB043BDBA0E609CF325487C"><enum>(A)</enum><text>the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/601">2 U.S.C. 601 et seq.</external-xref>);</text></subparagraph><subparagraph id="HB4DBBC7DDD9A407DA9A96BC9BFBE38E0"><enum>(B)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/15">chapter 15</external-xref> of title 31, United States Code (commonly known as the <quote>Anti-Deficiency Act</quote>);</text></subparagraph><subparagraph id="H488719861FF84C2887FCD144CEF9BDDF"><enum>(C)</enum><text>section 6329a through 6329c of title 5, United States Code (commonly known as the <quote>Administrative Leave Act of 2016</quote>);</text></subparagraph><subparagraph id="HE075DD10D5BF454D8F59B012689C1A22"><enum>(D)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/36">chapter 36</external-xref> of title 44, United States Code (commonly known as the <quote>E-Government Act of 2002</quote>);</text></subparagraph><subparagraph id="H164C0C7122E14BB7A046812FA25A708D"><enum>(E)</enum><text>section 552a of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>);</text></subparagraph><subparagraph id="HC23B22B7E64C485AAC0CAF7C862E7439"><enum>(F)</enum><text>subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Federal Information Security Modernization Act of 2014</quote>);</text></subparagraph><subparagraph id="H2FEAC6BD72DA41F39FE9B0875BC1B930"><enum>(G)</enum><text>the Foreign Affairs Reform and Restructuring Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6501">22 U.S.C. 6501 et seq.</external-xref>);</text></subparagraph><subparagraph id="H81CAE1F829C443389E0EFD4AA514D4CA"><enum>(H)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code (commonly known as the <quote>Federal Advisory Committee Act</quote>);</text></subparagraph><subparagraph id="H641B1EDB18D34257898645D405354FCE"><enum>(I)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/41">chapter 41</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act of 1995</quote>);</text></subparagraph><subparagraph id="H99EE2C4851F846CB883E34C26DBB9876"><enum>(J)</enum><text>numerous Federal ethics regulations; and</text></subparagraph><subparagraph id="H68851533F2214F958B584C70DC0BC118"><enum>(K)</enum><text>various provisions of subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subparagraph></paragraph></section><section id="H455335FC354A4AFFAF3821F113B6AB85"><enum>3.</enum><header>Repeal of Executive Order 14158</header><text display-inline="no-display-inline">Executive Order 14158 (90 Fed. Reg. 8441; relating to establishing and implementing the President’s <quote>Department of Government Efficiency</quote>) shall have no force or effect.</text></section></legis-body></bill>
