R. 1526</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250410">April 10, 2025</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend title 28, United States Code, to limit the authority of district courts to provide injunctive relief, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="H9AE0A41354B14425AD9A5480713D3663"><pagebreak></pagebreak><section id="H9BACA88BADF6486F957AED2A544DC597" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Rogue Rulings Act of 2025</short-title></quote> as the <quote><short-title>NORRA of 2025</short-title></quote>.</text></section><section id="H7E833D6C282345FC814FC44D70538BBA"><enum>2.</enum><header>Limitation on authority of united states district courts to provide injunctive relief</header><subsection id="H5277CE957B9E47C5941DB97BB421FD41"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/85">Chapter 85</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block id="HCB873B9EFDF54A0197714E874A4B01FB" style="USC"><section id="H799EB8FC5D7842ABAAFC2CF0B32471C2"><enum>1370.</enum><header>Limitation on authority to provide injunctive relief</header><subsection id="HFB431B8C20104B74A7ADE0933E01B493"><enum>(a)</enum><text display-inline="yes-display-inline">Except as provided in subsection (b), notwithstanding any other provision of law, no United States district court shall issue any order providing for injunctive relief, except in the case of such an order that is applicable only to limit the actions of a party to the case before such district court with respect to the party seeking injunctive relief from such district court and non-parties represented by such a party acting in a representative capacity pursuant to the Federal Rules of Civil Procedure.</text></subsection><subsection id="HE3697A3CD24D4E58888E6F4C95D9ABB9"><enum>(b)</enum><text display-inline="yes-display-inline">If a case is brought by two or more States located in different circuits challenging an action by the executive branch, that case shall be referred to a three-judge panel selected pursuant to section 2284, except that the selection of judges shall be random, and not by the chief judge of the circuit. The three-judge panel may issue an injunction that would otherwise be prohibited under subsection (a), and shall consider the interest of justice, the risk of irreparable harm to non-parties, and the preservation of the constitutional separation of powers in determining whether to issue such an order. </text></subsection><subsection id="H79682634D5A34C3BA4DF51DFF1525678"><enum>(c)</enum><text>An appeal of an order granting or denying injunctive relief pursuant to subsection (b) may lie to the circuit embracing the district or to the Supreme Court, at the preference of the party.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4BE28C7E6B3940C7ACA6D032FE30047B"><enum>(b)</enum><header>Table of sections</header><text>The table of sections for such chapter is amended by adding at the end the following:</text><quoted-block id="H2E16A99B9B68427EB62AF73133A5421B" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1370.
