<section id="H3A39E0A50D1C47A880C1F05B6A297735" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Life from Chemical Abortions Act</short-title></quote>. </text></section> <section id="HC69E655848B64201B42CED095A8C3B6B"><enum>2.</enum><header>No declaration of public health emergency with respect to abortion</header> <subsection id="HF365722D753A4EA2867DD9DBDCD5E320"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall not use or declare any public health emergency under section 319 or 319F–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>, 247d–6b) with respect to abortion.</text></subsection> 
<subsection id="H0D00548FC26D4EA78A2B103C14157FC5"><enum>(b)</enum><header>Termination of any declaration in effect</header><text display-inline="yes-display-inline">Any declaration described in subsection (a) that is in effect as of the date of enactment of this Act is hereby terminated.</text></subsection></section> <section id="H954E7FBD7DBC4BCC83A657D98A92CB2F" section-type="subsequent-section"><enum>3.</enum><header>Limitations on abortion drug</header> <subsection id="HBCE157012FD74EF88B863F1B9AB10319"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, the Commissioner of Food and Drugs, or any other official within the Department of Health and Human Services, with respect to the applicable risk evaluation and mitigation strategy under section 505–1 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355-1">21 U.S.C. 355–1</external-xref>) relating to abortion drugs—</text> 
<paragraph id="H62F11C04C15147A2A8110C615E8AE9D6"><enum>(1)</enum><text>may not exercise enforcement discretion with respect to any requirement under such strategy; and</text></paragraph> <paragraph id="H76878F8C489D428A8D905A17FCBE325E"><enum>(2)</enum><text display-inline="yes-display-inline">shall, effective on the date of the enactment of this Act, reinstate the requirement under such strategy that abortion drugs be dispensed in only clinics, medical offices, and hospitals by or under the supervision of a certified health care provider (commonly referred to as the <quote>in-person dispensing requirement</quote>).</text></paragraph></subsection> 
<subsection id="HEE2C121A0098476EBD7996F90BC02E09"><enum>(b)</enum><header>Other limitations</header><text display-inline="yes-display-inline">With respect to the applicable risk evaluation and mitigation strategy under section 505–1 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355-1">21 U.S.C. 355–1</external-xref>) relating to an abortion drug, the Secretary of Health and Human Services, the Commissioner of Food and Drugs, or any other official within the Department of Health and Human Services—</text> <paragraph id="H4CFC4FEA412F4864B468132CA4C9BDF6"><enum>(1)</enum><text display-inline="yes-display-inline">may not reduce protections (including by means of any update) in such strategy until every State submits to the abortion surveillance system of the Centers for Disease Control and Prevention the abortion data collected in the aggregate from the States and entered into a standardized worksheet that includes questions on the variables specified in subsection (c); and</text></paragraph> 
<paragraph id="H93ECD518976F49528A20629A58E4B1B6"><enum>(2)</enum><text display-inline="yes-display-inline">may not waive the requirement under such strategy that such drugs be dispensed in only clinics, medical offices, and hospitals by or under the supervision of a certified health care provider (commonly referred to as the <quote>in-person dispensing requirement</quote>).</text></paragraph></subsection> <subsection id="H0ACB7697AFD64F31983410DDE295A219"><enum>(c)</enum><header>Mandatory variables</header><text display-inline="yes-display-inline">The mandatory variables specified in this subsection shall be treated as mandatory questions for purposes of section 1903(bb) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(bb)</external-xref>) and shall include the following:</text> 
<paragraph id="HCA959A3A976F4DE68C96C8388CCBCAB1"><enum>(1)</enum><text>Maternal age in years.</text></paragraph> <paragraph id="H14FFE561BB924E00A3CCBFC10B4E2B11"><enum>(2)</enum><text>Gestational age in completed weeks at the time of abortion.</text></paragraph> 
<paragraph id="H7BD08DD581C6479793E29542E6E8A25B"><enum>(3)</enum><text>Maternal race.</text></paragraph> <paragraph id="HC4D1F9662FFB4215A46B3922B8206E4B"><enum>(4)</enum><text>Maternal ethnicity.</text></paragraph> 
<paragraph id="H222ACFDCB1F141D3B896EB6BC68751B2"><enum>(5)</enum><text>Maternal race by ethnicity.</text></paragraph> <paragraph id="H8C848397BC524F8098A97A5367B107D0"><enum>(6)</enum><text>The abortion method type.</text></paragraph> 
<paragraph id="HFA93087DB41A42E9A7808A2AE0CC4446"><enum>(7)</enum><text>Maternal marital status.</text></paragraph> <paragraph id="HC4CA3C84A3BD4549A393DA417DA72241"><enum>(8)</enum><text>Previous pregnancies of the mother, including the number of previous live births, the number of previous induced abortions, and the number of previous spontaneous abortions.</text></paragraph> 
<paragraph id="H5594AA796226484484032BF5F86196AC"><enum>(9)</enum><text>Maternal residence (State or county).</text></paragraph> <paragraph id="H9E26BBA2DA3940E583FE86840B863CE5"><enum>(10)</enum><text>Whether the child survived the abortion.</text></paragraph> 
<paragraph id="H319611336ACA44328CC3DCEC8653DE7F"><enum>(11)</enum><text>Congenital anomalies.</text></paragraph></subsection> <subsection id="H89B8F4AAA38A48E1BCDDCF3F886E8B2C"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H59C3C7BDF625402C99C6322CD1F9DAED"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>abortion</term> means the use or provision of any instrument, medicine, drug, or any other substance or device—</text> <subparagraph id="H73F0600EB80F49D9AC2CAE01C47A2E99"><enum>(A)</enum><text>to intentionally kill the unborn child of a woman known to be pregnant; or</text></subparagraph> 
<subparagraph id="HC52704F81AD648D6B4B28F49D704ECF7"><enum>(B)</enum><text>to intentionally terminate the pregnancy of a woman known to be pregnant, with an intention other than—</text> <clause id="H368EEAAE221D4A2488548589FFA10607"><enum>(i)</enum><text>after viability to produce a live birth that, if premature, is medically indicated, and to preserve the life and health of the child born alive;</text></clause> 
<clause id="HE17E4B02D8AC4D0792B96C7D3ACB224E"><enum>(ii)</enum><text>to treat an ectopic pregnancy; or</text></clause> <clause id="H13E15A3C9FD849D2819596CAED9D0E58"><enum>(iii)</enum><text>to remove a dead unborn child.</text></clause></subparagraph></paragraph> 
<paragraph id="H19FF8623819A446591ED17A0C7EE3E3B"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>abortion drug</term> means any medicine, drug, or any other substance or combination of drugs, medicine, or substances used for an abortion.</text></paragraph> <paragraph id="H30DB938F968A46349F550F8F9FF99CEF"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>certified health care provider</term> means a health care provider that has completed a Prescriber Agreement Form pursuant to the elements for safe use under the applicable risk evaluation and mitigation strategy under section 505–1 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355-1">21 U.S.C. 355–1</external-xref>) relating to abortion drugs, under which the provider agrees to the following:</text> 
<subparagraph id="HA84BD86464494495952AF260D61DA0BF"><enum>(A)</enum><text>The provider has the following qualifications:</text> <clause id="HEF8E6AB5AAC24D9595ACBAAA02E80045"><enum>(i)</enum><text>Ability to assess the duration of pregnancy accurately.</text></clause> 
<clause id="HA7D735FF198343D4AFD381C5FB5F4E18"><enum>(ii)</enum><text>Ability to diagnose ectopic pregnancies.</text></clause> <clause id="H851B804E81CC4D2DACC7F080969B4CAE"><enum>(iii)</enum><text>Ability to provide surgical intervention in cases of incomplete abortion or severe bleeding, or to have made plans to provide such care through others, and ability to assure patient access to medical facilities equipped to provide blood transfusions and resuscitation, if necessary.</text></clause></subparagraph> 
<subparagraph id="H263711901C1447B6A461F35EDFF65E34"><enum>(B)</enum><text display-inline="yes-display-inline">The provider will follow the guidelines for use of mifepristone under the applicable risk evaluation and mitigation strategy under section 505–1 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355-1">21 U.S.C. 355–1</external-xref>) relating to abortion drugs.</text></subparagraph></paragraph> <paragraph id="H8A40002EE1C14ECDAE6972FF13954B0D"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>unborn child</term> means an individual organism of the species homo sapiens, beginning at fertilization, until the point of being born alive as defined in section 8(b) of title 18, United States Code.</text></paragraph></subsection></section>
